Response:
This letter
is in response to complaint # [redacted] filed against Thompson Building
Associates regarding work performed by us for [redacted], the insured
homeowner at [redacted]
Though this
complaint was filed by a third party, specifically Mr. [redacted]’s girlfriend who
was uninsured at the time of the fire, Thompson Building Associates would like
to address the events and conditions surrounding this job.
Thompson
Building Associates was hired to address the post-fire renovation of the
structure at [redacted]. There
were also contents in the home that were removed and cleaned and returned to
the insured, Mr. [redacted].
Thompson
Building Associates, maintaining typical industry standards, provided estimates
via Xactimate estimating software to [redacted], and the insured was
compensated by the insurance company. Thompson Building Associates then
completed the renovation work on the structure in good faith, and also
professionally cleaned all contents that were considered salvageable. Even when
we were made aware that some of the contents we removed were not actually
property of the insured, but items belonging to his girlfriend, we kept and cleaned
them in good faith.
Mr. [redacted]
then signed off on the completion of the renovation work on 03/21/14 and the
contents were returned on 04/17/14. Upon returning to the residence Thompson
Building Associates were instructed to leave 180 cartons of contents and
multiple pieces of furniture in the yard and not the garage or house, as
insured’s girlfriend was attempting to sell cleaned items in a yard sale that
weekend. She had even stated that she had run an ad advertising the contents as
“professionally cleaned”. Homeowner was
cordial and happy with return of items, but his girlfriend was difficult to
deal with the entire time.
On 04/18/14
Mr. [redacted] called Thompson Building Associates to report a few small items
broken upon opening the boxes returned the previous week. He was assured we
would return and examine the items in question, and during that phone call he
was interrupted several times by the girlfriend in the background who hurled accusations
and derogatory comments the entire call.
A meeting
was set for 05/05/14 for representatives of [redacted] and Thompson Building
Associates to meet and discuss any issues. At that meeting the insured was
mostly quiet as his girlfriend ran through a laundry list of things that she
personally was not pleased with, including some structural issues and some
contents issues. She made claims that Thompson Building Associates had not
properly cared for her belongings, even though the [redacted] representatives
made it clear that none of her belongings were covered under the insurance
policy for this event. She argued about the condition of some of the contents
and questioned the absence of others, even some that were never cataloged by
Thompson Building Associates to be cleaned.
Mr. [redacted],
the insured, led me into a bedroom to show me the handful of items that he had
found while unpacking that had been damaged, but they were all small, low cost
items and none were of great value. We
explained that some items were returned even in a broken state as they might
have some sentimental value, and he understood. He was cordial in discussing
the damaged items, but when we returned to the group his girlfriend once again
began to accuse us of mishandling her contents and losing her belongings. She
was once again reminded that she had not contracted with Thompson Building
Associates and was not the insured, so her belongings would have had to have
been covered under rental insurance which she had not secured for herself.
Thompson
Building Associates maintained a professional decorum at all times, and endured
berating and verbal abuse from the insured’s girlfriend the entire meeting. [redacted] had no issues with the quality of the work that Thompson Building
Associates did on the structure, and joined in questioning the logic of leaving
hundreds of boxes and multiple pieces of furniture in the yard overnight
without security.
All payments
to Thompson from the insurance company went directly to the mortgage company
and then to Thompson: only the deductible was remitted directly from the
insured. There is still $2160.63 unpaid by insured as of 05/27/14.
Please see
attached the Certificate of Completion signed by the insured. We have also
provided the pictures of the broken items returned, as well as a small
battery-powered clock that insured claims does not work, although we do not
know if it was functional at the time we removed it. Also shown pictured is the
remaining furniture left outside for 2 weeks and covered with a tarp.
Thompson
Building Associates has identified the value of the broken items at about $100,
and we are willing to deduct that amount from the $2160.63 still owed as a show
of good faith. Though there is some question as to whether these items are
those of the insured or his girlfriend, we are amenable to making this offer to
placate the offended party.
Thompson
Building Associates maintains that we did a quality job and provided services
as per industry standards for this client.

Response:
I am rejecting this response because:i believe that the cost to replace the lost ,stolen ,missing items exceeds the amount that tompson's says that the balance is . also tompson's told me at the start the only thing that I would be responsible for is my deductable which has been met.Regards,[redacted]

I am a tenant renting a house that suffered some major damage that was supposed to be fixed within a week after permits were issued. Two workers arrived Saturday, Sept 20th without prior notice and completed concrete block repairs to foundation. Here it is October 4th and still no one has contacted me about finishing the job. My garage and all the contents have been inaccessible for nearly two months now. I wouldn't recommend this company to fix a dog house.
