Initial Business Response / [redacted] (1000, 5, 2015/10/22) */ As the homeowner has indicated in the complaint, work was conducted on the northern edge of his/her property as well as neighboring properties in this vicinityNow, this work was the result of a true deficiency that was initially created during new production and was brought to Thomsen Homes' attention by another client/homeowner in the areaEssentially, properties in this area were holding water and not draining properlyThus, Thomsen Homes corrected the issue by having the land graded to what was specified by the engineering company working in conjunction with the land developer/City of West FargoThis is how the property should have originally been graded, but there was some sort of miscommunication when the properties were initially constructedAdditionally, this homeowner is not the original buyer; thus, when sending out letters explaining the scope of work to be conducted, the letter was returned as it was addressed to the original homebuyersHowever, multiple phone calls were made after the fact to the current homeowner to discuss concernsSince then, the land has been properly graded and hydro-seeded, and Thomsen Homes, along with its sub-contractor, have covered the costs of repairsAs a homebuilder, we do not have the authority to alter drain tile systems (city drains, sewers, etc.), and the current condition of the property will allow for proper drainage Initial Consumer Rebuttal / [redacted] (3000, 7, 2015/11/01) */ (The consumer indicated he/she DID NOT accept the response from the business.) As Thomsen Homes has indicated, a couple of properties in surrounding area were experiencing drainage issuesOur property was not one of them and water has always drained correctlyThe City of West Fargo Public Works Director has confirmed that the City of West Fargo has no jurisdiction in this matter since all work is being completed on private propertyThomsen Homes is correct in that we are not the original buyer of the property - we purchased the property from the previous owner in April However, as Thomsen Homes addressed, the 'letter explaining the scope of work' that was sent out by them, was returned to their office and NO subsequent attempts were made to contact us to inform of planned workAs a result, Thomsen Homes authorized their sub-contractor to begin excavation work with full knowledge that we had not been notified and without first gaining permission to enter our propertyFurthermore, the 'multiple phone calls' that Thomsen Homes refers to in their Revdex.com response, were only made AFTER we initiated our original complaint and AFTER excavation work had been startedWe continue to have significant concerns with Thomsen Homes' failure to address the blatant trespassing and damage to our private property and find their actions and response unacceptableWhile it is accurate that the newly created drainage ditch has been properly graded and hydro-seeded, our yard overall is now improperly graded as a result of the recent excavation work completed by Thomsen Homes and their sub-contractor(s)
