Thorn Run Apartment Complex

Review: I was to sign a 6 month lease with Thorn Run Apartments as a temporary living space for a job relocation. I was in daily contact with Thorn Run Apartments, and completed all of the necessary paperwork via the internet (background check, credit check, application, ect.), so that upon my arrival, everything would be set to go, including a $150 dollar earnest money fee.

I was told via phone that the apartment was a first floor apartment, and I felt comfortable with this, as a first floor apartment was what I was looking for. However, when my mother and I arrived, before signing the lease, we asked for a tour of the apartment. We were taken down a flight of stairs to a BASEMENT apartment. I was told one thing, and under that premise, I decided to accept the apartment. Not until I saw the apartment and was now aware it was not a first floor apartment, was I unwilling to accept. Information was falsified from Thorn Run apartments, and because of this, I wish to have my earnest money returned. If it was upon my own choosing with the correct information that I had decided to not lease the apartment, I would not be requesting a refund. However, in this case, Thorn Run mislead me, and I would like my money back.

In addition, I have contacted the complex and Rosemary, the MGR, via phone and email numerous times, to which I have not received a response.

Rental Application states the following:

"I hereby deposit $ ____ as earnest money to be refunded to me if this application is not accepted. Upon acceptance this deposit shall be applied towards the first month's rent of the apartment. I hereby waive any claim for damages by reason of non acceptance. Owner or agent may reject without stating any reason for doing so. I understand that if I decide that I do not wish to sign a lease for the apartment, I must notify the leasing office within 48 hours from the date below. I understand that if I fail to do so, I will forfeit my earnest money."Desired Settlement: Return of $150 earnest money fee.
