Review: To Whom It May Concern:In November of 2012 I purchased a 2009 Piaggio Fly 150 scooter from [redacted]. At the time of sale she made it clear to me that the vehicle was under warranty, showing me the 1-800/866 number listed under the seat in case of emergency services. Upon calling the number in April 2013 I was made aware that the bike was actually not under warranty at all as it was still listed under it's previous (first) owner. Having damaged my bike in an accident, I reached out to Vespa Thousand Oaks and arranged to have the vehicle towed for $48 to their shop location. [redacted] made me aware that a damage estimate would cost $150. The vehicle was towed on Tuesday May 14, 2013 around 12 noon. Over the next few weeks I called multiple times inquiring about the bike, never getting a solid answer. Both [redacted] and [redacted] offered the excuse that they were in the middle of moving to another location and had not gotten around to doing the estimate. On April 25, 2013 I broke my left fibula and dislocated my ankle, leaving me unable to ride a motorbike for the next 6-12 months. I requested an offer on the vehicle and after 3 weeks [redacted] let me know that they were not interested in buying the bike back even though she sold it to me on the premise that an Italian bike will "retain its value". Now I have private buyers making offers on the bike, but when they go to look at it there are panels and pieces removed and [redacted] has basically backed me into a corner: either leave the bike there with them or pay to have them repair it. The vehicle was in running condition on May 14, but now they say the battery is dead, the tires that were sold as "indestructible" need to be replaced and so on. Upon speaking live with them, my phone call is handed off from one person, Eddy who takes my credit card info, to [redacted] who took 3 weeks to appraise the damages , to [redacted] who says he'd like my bike out of their shop just as much as I would. Any and all help will be greatly appreciatedDesired Settlement: I would like half of the retail value I paid for the 2009 Piaggio Fly 150 refunded to me or the scooter replaced. Being that I bought the bike under the pretense that it was under warranty I know that I have been taken advantage of and it is costing me more and more money as they take their sweet time in "getting around" to estimate the damages and ultimately destroy the bike upon offering an estimate of the damages. I purchased the vehicle for $2500 plus tax out right.

Thank you for contacting us regarding the complaint made by [redacted] in regards to his 2009 Piaggio Fly 150. To begin, when [redacted] purchased this used scooter, he was made aware and even signed a document stating that there is no warranty on the vehicle and it was sold in "as is" condition. Eric first contacted us about having crashed his vehicle on December 18th, 2012. He asked for an appraisal, but I stated that we needed to see the vehicle first. If there were any sort of warranty on the vehicle, this crash would have left it void. I heard nothing from Eric until he called in May to have his vehicle towed in for a damage estimate. We picked up the vehicle on May 21st, 2013 to perform a damage estimate. Mr. [redacted] put 20 miles on the vehicle between when he crashed it in December and when we picked it up in May. Typically, a motorcycle battery will die from 1 - 3 months of non-use. In this case, the vehicle had not been used in 5 months. It was just after this that our service department was closed for a week so we could re-locate. I sent [redacted] a full damage estimate totaling $2438.54 for the very extensive damages on the vehicle, which he originally purchased for $2,195 plus tax and license, on June 11th. Mr. [redacted] did not want to have his vehicle fixed and our service manager informed him over the phone that we could not safely put all the plastic body panels back on the vehicle, as many of them were broken from the inside. Mr. [redacted] had already agreed to pay the estimate fee of $170 and the transportation cost of $51 if he elected not to perform any repairs. Mr. [redacted] was informed of all of this over e-mail on June 14th and responded on June 15th to pay his outstanding bill and release the vehicle. I believe that the matter has been resolved.
