RE: ID# [redacted] RESPONSE TO CUSTOMER’S STATEMENT.The buyer was represented by her own real estate agentAll communication were through her agentWe never saw the buyer until the closing dayThe home came with an automatic garage door opener with an outside key entryAt no time were there transmittersTransmitters are not listed in the listing contract or the sales agreementThe bar stools she is referring to are staging stoolsThey are for decorating the home onlyThey have bent legs and would not support an average person.The day of the closing the buyer had to go to Cleveland to close her loanThe closing company was to wire the proceeds into our account when it closedAt 4:PM that day we still did not receive the fundsThere is no way I would give up keys to the house I own without funds being transferredThe transaction is not complete until all funds have transferred to the sellerAt 4:PM, I called my bank and they confirmed the funds were there at about 4:PMMy wife sent the agent a text saying I just received the funds and was on my way to meet them at my officeI got to the office within five minutesThe second I got out of my vehicle, a woman I didn’t know came running at me calling me every foul four letter word you could imagineShe lunged at me to grab the envelope in my hands and I pulled it awayShe again used exterme profanity saying “Give me the xxxxxxx keys you xxxxxxxx"I refused because I did not know who she wasHer agent introduced herself to me and I handed her agent the keysAt that point the buyer continued her profanity while a young lady was standing by her vehicle and an older lady was in the vehicleAll this was going on while other tenants in the building witnessed her actions.The buyer did a walk through with her agent before the closing and all the staging items were removed at that timeShe never mentioned a thing until after the closingThere was quite a bit of paint and floor tiles leftvin the garageThis are our material that we used on a regular basisWe would be happy to exchange our staging stools for our materials, we already made this offer to her agentAgain, they are staging stools and may not support an average personWe do not have transmitters for the opener, there are only keys for the outside key pad and the buyer was already given themI do not want to deal with her direct because I don’t want to be subjected to her foul language around the officeWe would be happy to make the exchange with her agent.Thank you for taking your valuable time to listen to such a ridiculous complaint.Broker/OwnerCc: file, Attorney

At 4:50 PM, I called my bank and they confirmed the funds were there at about 4:53 PM. My wife sent the agent a text saying I just received the funds and was on my way to meet them at my office. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
section 7(A) of the attached signed sales agreement clearly states that a "garage door opener and transmitter" is included in the sale. The 2bar stools were clearly included in the sales agreement section 7(A). See photo of stools that shows that they are in excellent condition and not damaged. He did not meet us until almost 5:30, much more than the five minutes he claims. The title agent gave him the federal transfer ID number which is typically proof of funds transfer but he wouldn't accept the ID as proof. At NO TIME did I run towards him OR lunge at him and that is an absolute lie. I did swear at him AFTER he extended me the envelope with the keys then jerked it over my head and told me to "say please" to him. He DID call me and my daughter "white trash" and called me a "[redacted]" They refused us access for the final walk through until after 6:00 pm the evening before the sale. It was a rushed walk through because my agent had another appointment and had to send a colleague. We asked them for access at 10:00 am that morning. They had weeks to retrieve their paint and tiles from the house but never did. There is very little of either item in the garage but they are now using them to bargain for items that they sold to us with the house but intentionally removed. I do not need to bargain for something I legally, in writing, bought from them - in excellent, like new condition.
