Complaint:
I am rejecting this response because: she did not offer me the money I paid as credit on another item. She offered me another water bottle and I asked her if we could test the bottle to make sure it did not leak like the one purchased. She also stated if the 2nd bottle leaked I would not be allowed another exchange.She then got angry and told me she did not have to exchange or refund without a receipt and that I could file a complaint with the Revdex.com or court. I specifically asked for credit towards another purchase

The company looked up the consumer's file and determined the consumer didn't send any written cancellation notice. The membership was cancelled but the consumer now wants the balance of $59 waived. The consumer claimed she used the gym once - the company believes that the consumer realized that she is still paying for a gym she is not using.

On 1/19/2015 a customer did come in to ask for a refund on a water bottle the she had purchased....

I informed the customer that every purchase is a final purchase and that we do not offer any kind of refunds, however we do offer exchanges on defective DVDs and toys. This product is neither a DVD or a toy but I would have been happy to exchange it for her with a receipt. The customer did not present a receipt so she had no proof of purchase. I informed her that I would not be able to process an exchange for it but that I would be happy to offer her a discount on another product. She did not appreciate that and got angry and said she was going to fill a complaint and left. Our policy states on the receipt “thank you for shopping with us exchanges on defective DVDs and toys with receipt no refunds”. I could assure that any products that we carry that get a high defective review we discontinue and no longer carry them. We work real hard to carry only products that are good quality and could assure satisfaction. we deeply apologize for the inconvenience.Regards,

Review: I purchased a water bottle that open from the bottom on 01/16/2015. I returned the bottle on 01/18/2015 because it leaked and would not hold water. The clerk recorded the sale in the inventory book. When I returned, the clerk called the manager and I was told to return on 01/19/2015 after 11:00 a.m. I returned and spoke to the manager who offered me another bottle. She also stated this was the only time she would do an exchange. I asked her to test the bottle to ensure it worked and she refused. She then stated she would not do an exchange and told me to file a complaint which I am doing. I asked her to pull the defective bottles from the shelf and she refused.Desired Settlement: Store credit or refund for violation of California Civil Code 1791.1(a) and (c) 1792., 1792.3, 1793.2(d)
