About 3 weeks ago on Saturday 2/22 me and my boyfriend went apartment hunting. We found an apartment listed online that was in our price range so we went to look at it. We were informed from the leasing agent that there were no units available at that price or on the first floor (they said they only had third floor units available & my boyfriend has a heart condition so he prefers the first floor, which we explained). The next day Sunday 2/23 the leasing agent called us around 2pm and said that there was a unit available for the price we saw online and it was on the first floor. We immediately went down to the apartment complex to sign the application. We were told there would be a security deposit we would get back if we changed our mind or did not pass the application. We were told the application fee went towards running our credit check and running our backgrounds. We filled out the paperwork and pay the $100 security deposit and the $101.88 application fee (for both our applications). Within 10 minutes of us leaving the agent called to say he got one set of reports back already and we passed those reports. Our leasing agent emailed us over paperwork that Monday for us to review and sign. We did that. On Tuesday 2/25 we got an email with the manager signature on the paperwork we signed the day before. We spoke with our leasing agent and he said everything looks good just waiting on the verbal from the manager were in the clear. That Thursday 2/27 we were informed from the manager that the unit we applied for was no longer available. The current tenant decided not to leave. The manager said that we would get our security deposit back but not our application fee back since they ran all the reports. I informed her that we passed the credit check and the background which was the condition of the application, and since we passed all that and the current tenant is not leaving we should still get our application fee back. She said she would speak with her regional manager and I needed to call back in a couple hours. Every phone call between us and the apartment complex we had to call, even when we found out we weren’t getting the unit, the manager did not call us. We had to call her. During that phone call *** did say she would keep an eye out for any openings and let me know right away. She also said that if there was openings in the next couple months we would not have to pay the application fee again she would make sure of that. So I called her (the manager) back that afternoon and I was unformed that she spoke with the regional manager and they said there’s nothing they can do we will not get our application fee back. I then asked what does that mean for us since we passed everything and applied for a unit that was available and then suddenly it wasn’t. *** (The manager) told me there was nothing they could do but send us back our $100 security deposit. I asked for the regional managers email so I can email her and try to speak to her myself, I wanted to ask her what their policy was on this issue and where does it state that, this was all on Thursday 2/27. As of today 3/9 I still have not heard back from the Regional Manager ***. During my call with *** she told me that usually between the 1st-3rd of the month people put in the notice to leave so if something becomes available she’ll call me. Tuesday 3/3 I still have not heard from *** so I called her around noon and was informed she was busy and would call me back. She called me back at 7pm that night and informed me that there was no units available in our price range, and if she wanted me to return my security deposit still. I thought she was going to return that the week prior so she was keeping that money longer then she said she would. She then informed me that my application was only good for 30 days, per their policy, and if something became available after those 30 days I would need to pay an application fee again. Everything they have said or advertised has all been false.
