Review: Hello,

Back on 7/23/12 my wife ([redacted]) and I purchased a property on [redacted] in [redacted], PA 18621. We decided to hire Tiger Abstract as the title research and title insurance company. To our knowledge, everything came back fine and it was stated that our property has road access according to our deed. This information was also conveyed to us from the seller and their listing agent. Since then, we have been trying to get electric back to our property through [redacted]. My wife and I ran into a road block when we tried to get a gate removed from the road that blocks the entrance to our property (We have a key to get through the gate, but we want it removed for the convenience of the electric company, and us, etc.). My wife went over to the [redacted] Township building and they stated that the road has been abandoned. This is certainly not what was stated on our title insurance.

[redacted] went over to Tiger Abstract on 6/4/13 and talked to [redacted] at Tiger Abstract and she was more than helpful when listening to the situation. She was going to give the documents to Tiger Abstract’s lawyers for investigation. Quite some time has passed since, and we finally heard back from [redacted] (I do understand research takes some time). She said that according to our deed, we have the road access. [redacted]’s paperwork was never filed in the courthouse. [redacted] suggested contacting a lawyer who specializes in land. We contacted a lawyer and explained the entire situation to him. His very first question was did you hire a title insurance company before purchasing the property. He said to work with Tiger Abstract because this situation falls back on them because they are the title research and title insurance company.

I called and asked for [redacted], but she was on vacation. I started to talk with [redacted] on the phone about the situation which I thought would be good because she was the person who closed on the property for us. After a couple of minutes, [redacted] started raising her voice at me. I politely asked why is she raising her voice? She stated, “Because you keep calling us and we feel bad because of your situation.” Does that seem like a good reason to raise your voice at someone. She also stated that you keep calling us and what do you expect Tiger Abstract to do. My reply was you are the title insurance company and you should straighten out this. We currently have no clue if we have road access or if the property is landlocked since no easement or right of way exists. According to what Tiger Abstract stated for us in the closing paperwork, they should utilize their lawyers to make sure we have the road access on our property which is what was stated to us. They should contact [redacted] and tell them their paperwork is not binding because it was never filed in the courthouse, therefore granting us road access as stated in out deed. I also called on Monday, 7/8/13, and left a message for [redacted] and I still haven’t received a return call. This situation has been going on long enough and my patience has run out. I would like Tiger Abstract to fix this situation before I return to the lawyer.

First and foremost I would like to address the fact that [redacted] and [redacted] felt the responsiveness of Tiger Abstract was lacking. We would like to express our apologizes that the communication was not satisfactory to meet their needs. Due to the large volume of calls and e-mails I received, occasionally some are not received and or addressed by the correct person. In this case I received a voice mail with just a name and a request to call them back; as magnet for telemarketers, I have message like this vetted, forwarded to a team member to see if it something I need to handle. I received no notification back. This was a mistake on our part, a corrective action notice has been reviewed with all team members involved. Again I apologize, we certainly do regard every client past and present as important to us.

That being said, from a title standpoint we did research their problem and found that their deed contained access to the property and nothing was filed from the township stating otherwise. We rely on recorded documents in the Court House in order to insure the property. We did convey this information to them and let them know they should contact an attorney for this type of dispute. We cannot contact the township for this dispute as we are not the owners of the property. We are not attorneys and this dispute does not relate to the title insurance that we provided. We are willing to provide any research needed to help them in their dispute with the township. However the actual dispute will have to be made by the owner of the property. From a title insurance standpoint Tiger Abstract fulfilled its due diligence and obligation on this transaction. We do however understand their frustration and again would be willing to do anything we legally can during their dispute with the township.
