First of all, I don’t think you even listened to my message from 6/30/16.What it said was that while we were installing the fence in the front yard, we were stopped by a representative from South Bloomfield.They said that your neighbors had called and complained about the fence in the front yard Apparently you have a deed restriction that does not allow fencing in the front yard We asked South Bloomfield why they would allow a permit if that was the case and they said they were backed up by the Pickaway County recorder’s office ( [redacted] ) and that it is the homeowner’s responsibility to know the restrictions of their deed, not the contractor’s or the city’s.I also told you that you would need to try to get a variance to get that changed And I said we would have to work together to work through this situation.I did not in any way imply that I had some problem I was saying I would work with you however I could We decided to pull off the job until this issue was resolved so that we did not perform any more work that was not allowed I’m going to try to address some of your complaints / issues but there are some that I don’t think I possibly can.? You refer to using “pesticide soaked” wood? There are types of lumber; “pressure treated” and regular Pressure treated is designed to use outdoors and doesn’t rot as quickly as regular If we had used un-treated wood the structure would be rotting by now.? black ant hills?? This has nothing to do with anything we did.? Extra expense: We met and I explained to you the reason and you understood and we met in the middle.? “Pounding” on the door and ringing the bell: I did not count the number of times I rang or knocked I was not angry or upset and you did not have to pay me then You could have mailed it at your leisure.? “Pesticide reeking” “ant swarmed timbers” I don’t even know what to say to that statement.? Time to begin fence installation: Most cities issue permits in days For some reason South Bloomfield has subbed out the process to an outside firm and it took almost a month for them to issue the permit.? Trimmed shrubs: We can take a look at the shrubs, but please keep in mind they had to be trimmed to allow the installation of the fence which is to run right through portions of the Junipers on both the North and South side.? Crawlspace: The crawlspace was done several weeks ago and this is the first I have heard of an issue We would be happy to look at it and modify as needed.? Lawn mowing service: I have no control of the types of companies you hire for lawn services I am required by law to leave OUPS flags in the ground until a certain time period You did not have to cancel your mowing people at any time They can mow around the flags or move the flags, mow the area and then replace them.? I’m sorry, but I could not follow how the escape of wild cats was somehow our fault.? Are you saying that we have left lumber piled in your yard? To my knowledge no lumber or trash was left in your yard.? South side fence: I truly believe the fence would have looked better if it were to continue in the same line as the existing and not jog one foot to the south and then continue towards the road Even so, we removed the posts and were prepared to re-install one foot to the south for no extra charge.? When you realized they were not where you wanted them, a simple call was all that was required It wasn’t necessary to call and berate and belittle me on your messages.? Have reviewed your letter and would like to take one more sip from the positive and constructive well before plunging into the chore of responding.  I will repeat here that my experience with your company in 2011 was very good.  I also repeat here that the repair work you did on the backyard privacy fence was good work.  Now to respond to your letter:  I was startled to find virtually every statement in it to be false.  Inaccuracies took a variety of forms, such as:1. Misdirection and non sequitur. This category included departing from relevance to focus on matters of no significance.  An example would be the discussion of treated versus untreated wood, which you apparently tendered as an attempt to deny having replaced misaligned locking gates with pesticide reeking wood crawling with ants.  Similarly pointless was the implication that the mowing service I had employed was somehow substandard because they took the entirely reasonable step of dismissing me as a client when I signed a contract for weekly service and then cancelled each week for a month.  And I have no idea what was meant by what neighbors put in their yards not being your fault.  The reference completely eludes me.2. Denials of Fact.  One example would be the outright lie that you did not doggedly emphatically and urgently demand to take final payment before COB on the day you claimed to have completed work in 2015. There could be no delay.  On this you were utterly clear.3. False Accusations.  One example would be the characterization of all clear direct feedback I have delivered in civil language and using an indoor voice as “berating,” “belittling” and – what I have to view as not a difference in perspective but an outright lie – calling you “nasty names.”   Your response is a bizarre mix of personal demonization and claims of concern  and respect mixed with fake piety (you’ll “pray” for me) and sneeringly dismissive disdain for the personal concerns of your client.  Quite right my personal concerns and goals were none of your concern or of your business.  But your performance having created such obstacles to the realization of same, I have offered the details of some troubles caused by this situation so you can see you are not, as you seem to feel, screwing up in a vacuum.  Your every wrong move impacts your client negatively.  You need to realize that.  Your avowals of having nothing to do with the loss of my mowing service or the missed opportunity to ameliorate a situation involving homeless kittens are without merit.  Any rational person reading my original statement could see the obvious and direct link between your delays and disorganization and the negative outcomes your client has experienced, the list of which has grown since the original statement.  Damages Include:? Lost mowing service? Lost shrub you were told to transplant rather than remove, leaving a deep depression where shrub was removed – sprained ankle? Sky rocketing blood pressure now under control with two previously unnecessary medications? One dead kitten? Loss of peaceful use of property for almost four months and counting over a one week job? Only completed piece of fence too close to building to admit a riding mower, which concern was discussed in advance? Loss of functional crawl space entry and black paint on door where white or light gray was suggested? Loss of entire month of July by which time you were emphatically directed to be finished, as I had another project to complete before autumn.Your letter diagnoses my very rational frustration as me being an angry person and makes various false claims and denials.   As answering every slanderous accusation and providing more detailed documentation on every action you have denied promises to be a pursuit as endless and negative as everything else about this experience, I choose to single out and emphasize two issues above all the rest of this time-sucking mess you have compelled us into:First: After paying you $5K to begin work on April 15th, your crew finally arrived on June 27th to begin work on the fence.  We can stipulate here that you continue to blame this almost three month delay on the fact that a permit issuer took a two week vacation.  That morning I fed breakfast to the wild mother cat and her four 9 week old kittens living on my front porch.  Pause here for you to snort disdainfully at the irrelevance of these animals who appeared shortly after I hired you and my concern for them and the fact they wouldn’t have been living on the front porch if I could have enjoyed the use of the locked walkway behind the house (which continues having to be left unlocked awaiting your completion of the directed repair of the crawlspace entry located within).  I arrived home that evening to find the south side fence posts all set in the wrong position, the yard covered with more than half a dozen armpit high piles of lumber, the large water bowl I kept on the porch for the cats emptied and moved to the opposite side of the porch, a water bottle standing in the driveway for me to fetch and throw away so I could get in the garage without driving over it, and the mother cat with three of her four kittens,(who had yet to be completely weaned).  The fourth kitten has never been seen again and knowing it would not leave its mother at that age I live with the assumption it was either crushed by dumped lumber or else interfered with in some other way indicated by the disturbance and rearranging of its living area and its permanent absence. Your insistence on viewing this as none of your cause or concern is self-serving and without value.Second:When, after having utility company call-before-you-dig flags accompanied by spray-painted lines and arrows planted all over the yard, you told me you could not begin work on the fence due to permit issues, I expressed concern over what not mowing for an indefinite interval would do to my lawn.  You chuckled and got off the phone.  When I at last, after a wait of over a month, called and asked you to remove the flags so mowing could occur, you neither complied nor acknowledged the request.  Now you remark that the planting of the flags and spray painting of the lines and arrows on the grass were not a hindrance and I needn’t have cancelled the mowing at all, but could have pulled up the flags, mowed off the painted marking and then stuck the flags back in the ground somewhere.  I will call the gas company to be sure, but this sounds like potentially dangerous instruction you offer.  Please verify with the call-before-you-dig office whether that is safe advice for you to hand out.  At any rate, you did not offer that solution to me.  I did nothing so risky as remove the flags and markings prior to the work beginning, which is why the mowing service quit and I am back to mowing my own lawn In additional to dealing with the seemingly endless unpleasant demand load it has added to my already packed agenda to have hired you; this response to your slanderous posting being a prime example.  If you had phoned as requested when you received my letter, you would have been informed the Village has no issue with the fence.  Their advice is to complete the fence.  I have also spoken with the originator of the deed, and they have no vested interest and will pursue no sanctions with regard to the fence.  Their advice is to complete the fence.  If the woman who complained wants to take me to court she will have to demonstrate the fence somehow lowers her property value, and that is no concern of yours.If you are able to complete the job you accepted, these are my expectations:1. Get the black paint off my crawlspace door and replace it with light grey or white.2. Restore the crawl space entry to the state it enjoyed in 2015 before your crew damaged it – six inch run-off block of a seamless character and entry space area as large as the area of the door3. Complete the front yard fence, hang the gates without causing any more animals to disappear4. Lower and level the ground at the gate to the back yard as discussed.5. Verify all fence openings will admit a riding mower or adjust accordingly6. Get the flags out of the ground so I can mow7. Replace missing shrub with new shrub to be installed in the southwest corner of the currently fenced in area of the front yard, preferably red, and fill and level the sunken area from which the large and healthy shrub was removed, as it is a danger8. Make an earnest attempt to render the trimmed shrubs neat and aligned in shape and dimension without killing them.  If this cannot be accomplished, leave them alone.9. A reasonable interval in which to inspect the final product and report issues, receive prompt address of any such issues, and render the balance of payment.Owing to longstanding plans it will not be convenient to have workers on the property from July 25th through July 29th, but the soonest recommencement and conclusion of the work following that interval is fervently requested.  Reasonable notice by phone that the back locking walkway should be left unlocked will be complied with, and I request the black paint be removed from the crawlspace door before any other work resumes.

We received your reply from the Revdex.com in an email Monday, August 8,2016 at8:41 a.m.Please understand the only reason we pulled off the job on June 28, 2016 is because we wereinstructed to do so by the Village of South Bloomfield. We were never informed that it wasokay to return to the job until your letter (referenced above) indicated this.We have always had every intention of completing the tasks outlined in our contract. Weagreed to the following:1) We will paint the crawl space door grey, as requested after the original contract was     approved.2) If the opening is smaller than before, we will make it the same size it was.3) We will complete the front yard fencing and gate.4) We will lower the ground at the back gate.      a. I don't recall that you mentioned this, but we still need to re-work the gate into      the back yard to make it larger for mower access.5) The only gate designed to permit a riding mower entry is the one going into the back    yard/South side "fence gate South side grade and latch". The contract says 4'-5' gate    opening. We will make it a 5' opening.6) We will remove all flags.7) You may need to show Randy, my Production Manager, what you are referring to where     the shrub is concerned. The only shrub I am aware of us moving was a Boxwood in the    North East corner of the front yard. But we will certainly correct any issues.8) We will look at pruning the shrubs differently, but please keep in mind that in order for    the fence to run in the pattern you wished, it was running through the shrub    so we had to prune out large sections of the shrub to accommodate tbe fence.9) I will make sure Randy notifies you as to when we will be back on your property. Upon    completion we will mail you an invoice and you can take up to 10 days to inspect the    work and mail us a payment.I will tell them to change the color of the door on the first day they are back on your property.Randy will also be instructed to make sure there is clear communication as to when you will beleaving the back gate unlocked for us.Randy will be attempting to contact you on Monday August 15, 2016 to arrange a date tocomplete the work.
