Revdex.com: I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # [redacted] Dear Gentlemen:I must say I’m totally taken aback by such half-truths and outright lies contained in this responseI can’t believe how a person can be so deceitful and dishonest in order to avoid returning a deposit held in trustSadFortunately, we had a contractUnder the terms of our contract (seller-drafted), this was a refundable depositThe contract was utterly silent with respect to the refundability of the depositFor a deposit to be non-refundable it has to clearly state it in the contractIn this case, the subject matter called for a “black female from Eros and Olinka due mid-December 2016” (period)These pups were all boys, thus rendering the contract immediately void and deposit returned to purchaser based on Impossibility of Performance of sellers contract dutiesThere was also no agreement for me to pay seller “ [redacted] fees”, nor was there any agreement for me to pay seller for seller’s “time in trying to sell me a puppy”, as silly as that soundsThis contract is governed by the Uniform Commercial Code (UCC)As you know, in every contract with a merchant for the sale of goods there is an Implied Covenant of Good Faith and Fair DealingThis implied obligation assumes that the parties to a contract will act in good faith and deal fairly with one another without breaking their word, using shifty means to avoid obligations, or denying what the other party obviously understood at the time of contractingUnfortunately, this business clearly failed to live up to that trust and must be held accountable.? November 06, 2017 In response to a complaint made by *** ***: Prior to signing a contract for a puppy from the Eros and Olinka litter I had a lengthy phone conversation with Mr*** about the process of putting deposits down on unborn pups. I clearly stated that deposits
were non refundable however they could retransferred to a different litter. I also Informed him that there were several people ahead of him who had already put deposits down for a female from this litter. I explained to him that people chose in deposit order. The litter was born and all five pups that were born were males. I informed Mr*** that there were no females in the litter and that I would transfer the depot to the next litter of his choice. He Choose to put his deposit on the Porto and Bessi litter for a black female that would be born mid January.This litter produced some black females. I notified Mr*** that there was a black female in the litter for him. Now the deposit order would come into play. He would be the last to pickWhen the pups were weeks old he came to the farm to meet the pup. He spent over an hour asking questions on feeding, training and raising a pup. I also sent him my puppy training video that goes out to my puppy buyers. When Mr*** left He said he would be back in a week to pick her up. Once He returned home he sent me an e-mail stating that if he could not have the bigger female he did not want the smaller one. So I told him he would have to wait until the next litter and he would be higher up on the picking order. Then on March 23rdI had a tragic fire and lost two of my pregnant females.My next litter of pups was Link and Mafi. I sent Mr*** another email stating there were some black and red pups available. He thought about it but ultimately did not take one of those pups.The next litter I had I notified Mr*** again that I had black females available. He then informed me that he had just bought a pup and wanted his deposit back. I told him his deposit was not refundable and only transferable. Since then he he has been bullying me and threatening me with law suits. So I made an exception to try to end this with out any hard feelings and made a partial refund of the $deposit. Mr*** payed through *** *** and I did subtract the *** *** fees I was charged for his transaction. I also deducted the hour of my time he took answering all his questions on raising and training a pup. he also received the training video I sent to him. So I feel He has gotten his moneys worth.Now he is contacting the Revdex.com and promises to make my life hell until he is paid in full. I now have to waste my precious time replying to his claims. You can see from my *** page and my *** page that I have a very high customer satisfaction rate.So I hope that you will see that some people can never be made happy. I have offered Mr*** several options and he seems to have left all of that out of his side of the story.I hope this clears up this matter and I can put it behind me
