Complaint: [redacted] I am rejecting this response because: Timberline Fence Timeline October 23, 2015: 5:00pm Initial Fence Appointment at [redacted] with Sam & Christina C***, discussed staining and black wire fence October 26, 2015: 8:23am Received Official Bid via email 11:35am [redacted] responded to bid asking “That’s stained with the black wire, right?” 11:56am Timberline responded “Yes :) Please me know if you have any more questionsChristina” 1:41pm Phone call to Timberline Fence: (min conversation) I (***) verified with Christina that it was the stain and BLACK wire fence and confirmed that we have an agreement and we would like to proceed with getting on the scheduleWe discussed staining timeline-whether it would be done during installation or at a future date, after wood curedShe stated there should be no problems and that she would get us on the scheduleShe would have to check on the black wire as it is a special order and they would look at starting, most likely on November 9th, if she could get the wire ordered and they would bring the paper contract out at that time to get it signed at that time, when they start the projectAt this point, we were in full agreement about the staining and wire and were on the schedule, so a verbal contract was reached as both parties agreed to all terms October 27, 5:18pm I emailed Timberline to ask about the official start date, due to the special order about the wire 6:39pm Received another email, contradicting the previous email, and conversation on the phone, now stating that the stain was NOT to be covered and we would need to buy the stain ourselves and pay an additional $for labor 6:40pm *Also received this email [redacted] "Monday Nov9th if that works for you :) Christina” 7:10pm I emailed Timberline stating that Timberline had already confirmed stain would be included and not extra 10:00pm Sam emailed stating that there was a misunderstanding and that his wife read my (seven word) sentence incorrectlyHe stated that she only saw the information about the black wireHe apologized for their misunderstanding but was unwilling to honor the verbal/email agreement that his business partner had already entered into previously 10:Christina emailed saying she was sorry she misread the (seven word) question (Please remember there was also an minute PHONE conversation where the stain was discussed and agreed to verbally by Christina, along with the email in writing) 10: [redacted] forwarded the original email to both parties to show that there was no way to misread the seven wordsHe also explained that it was discussed in detail over the phoneThere was no room for “miscommunication” October 28, 7:02am Timberline emailed stating that they cannot do business for a “loss”Sam also states in the email, that we were on the schedule for November 9, but would like to refer us to another company*He didn’t want to do our job because he didn’t want to do a job for a client that he felt would give him a bad review Synopsis: In our initial meeting with the C***s, we discussed our interest in staining the fence with the color of our existing stain outside our houseWhen I sent the first email questioning the bid, it was very clear that I asked “That’s stained with the black wire, right?” and it was again confirmedThen, I had a verbal conversation with Christina C [redacted] over the phone confirming everythingAt no point, was there any way to misunderstand our desire for a stained fenceWe are not trying to get “freebies”We’ve been clear since the beginning, what our interests wereThis is a clear case of a business not owning up to their promises, and providing poor business practicesThis is an example of a business getting in the door and then trying to raise the price once they gain the contractA company should be held accountable for such practices October 8:am Received Bid October 11:am Asked if stain & wire were included in bid October 11:am Timberline Confirmed stain & wire WERE included in bid October 1:pm Phone Conversation agreeing to all terms and put on schedule October 6:pm Timberline tried to change the terms of the agreed upon verbal contract and written contract (email) **ALL email correspondence can be submitted with date and time stamps (unedited) for your review upon requestPhone records available as wellSincerely, [redacted]

We were never in agreement in any aspectWe did want to secure a spot for their project on the schedule while working out the detailsOnce we realized that we were not going to be able to come to a mutual agreement we let the customer know immediately (that day)All communication
with Timberline Fence and the customer was within a day period of timeWe have all corresponding emails between our company and the ***sWe would like to send all copy's of emails to the Revdex.com for reviewThis is simply a consumer that wants something for nothing

1:41pm Phone call to Timberline Fence: (8 min conversation) I ([redacted]) verified with Christina that it was the stain and BLACK wire fence and confirmed that we have an agreement and we would like to proceed with getting on the schedule. We discussed staining timeline-whether it would be done during installation or at a future date, after wood cured. She stated there should be no problems and that she would get us on the schedule. She would have to check on the black wire as it is a special order and they would look at starting, most likely on November 9th, if she could get the wire ordered and they would bring the paper contract out at that time to get it signed at that time, when they start the project. At this point, we were in full agreement about the staining and wire and were on the schedule, so a verbal contract was reached as both parties agreed to all terms.

  6:40pm *Also received this email* "Monday Nov. 9th if that works for you :) Christina” 
  7:10pm I emailed Timberline stating that Timberline had already confirmed stain would be included and not extra.
10:00pm Sam emailed stating that there was a misunderstanding and that his wife read my (seven word) sentence incorrectly. He stated that she only saw the information about the black wire. He apologized for their misunderstanding but was unwilling to honor the verbal/email agreement that his business partner had already entered into previously. 
10:01 Christina emailed saying she was sorry she misread the (seven word) question (Please remember there was also an 8 minute PHONE conversation where the stain was discussed and agreed to verbally by Christina, along with the email in writing). 
10:44 [redacted] forwarded the original email to both parties to show that there was no way to misread the seven words. He also explained that it was discussed in detail over the phone. There was no room for “miscommunication”.
October 28, 2015 7:02am Timberline emailed stating that they cannot do business for a “loss”. Then, I had a verbal conversation with Christina C[redacted] over the phone confirming everything. At no point, was there any way to misunderstand our desire for a stained fence. We are not trying to get “freebies”. We’ve been clear since the beginning, what our interests were. This is a clear case of a business not owning up to their promises, and providing poor business practices. This is an example of a business getting in the door and then trying to raise the price once they gain the contract. A company should be held accountable for such practices.
