In response to the complaint from [redacted] let me first address the remark about a day graceperiodThat is only referring to when a late charge is appliedIt has nothing to do with beingobligated to make your payments on the day that they are dueLet me point out the section of thecontract that is titled Default“Time is of the essence in this contractI will be in default of thiscontract if I fail to make any payment when it is due, or if I fail to comply with any other terms ofthis contractIf I fail to cure a default in the manner prescribed by applicable law, you mayrequire me to pay all remaining payments, unless my default is based solely on my failure tomake a payment when due, in which event you may require me to pay all remaining paymentsonly if my failure has continued for at least thirty days.”We understand that [redacted] has traded in her vehicle and the dealer is supposed to pay off her loanbalance with TimebuyerUnfortunately the dealer has not done so [redacted] must understand thatlegally, she is responsible for this loan and is obligated to continue to make her monthlypayments or pay the balance offIf the dealer has not fulfilled its contractual obligation with herthat, unfortunately, is between [redacted] and the dealer.To resolve this complaint Timebuyer, in good faith, will not call or text ***If the monthly loanpayment is not paid by September 26, that will cause the loan to be over days late.Please be advised that Timebuyer may choose to pursue all legal rights and remedies it has underthe financing contract which include commencement of a lawsuit for the collection of theoutstanding monies owed Timebuyer and such amounts include but are not limited to the unpaidprincipal balance of the loan, accumulated interest, court costs, and collection and other fees,including attorneys’ fees.We regret that [redacted] is in this unfortunate positionWe do appreciate [redacted] as a customer andbelieve that we can have a good working relationship moving forward!Sincerely,Anthony [redacted] VPO

In response to the complaint from [redacted] let me first state that Timebuyer, Inc does not do the final NYS inspectionAll vehicles sold have the final NYS safety inspection performed by outside vendorsThis is to insure that a third party reviews the vehicle for final inspection before delivery to the customer [redacted] purchased a Dodge Avenger with roughly 61,miles on 09/08/This vehicle came with the standard day 3,mile warranty [redacted] also purchased a month 24,mile service plan that covers major engine and transmission failure only [redacted] brought her vehicle in on 9/17/to check the brakes and belt squealWe replaced a faulty alternatorWe test drove the car and it drove fineWe pulled all four tires and showed [redacted] that the brakes looked new [redacted] stated “I can see that they are new” so we did not replace them On 10/27/ [redacted] called and stated that the brakes were still not functioning properly so we scheduled an appointment for 11/3/and told her that we would be willing to put new brakes on as a courtesy [redacted] did not show up for that appointmentOn 11/16/ [redacted] rescheduled her appointment for 11/18/because she felt that her transmission was shifting funny [redacted] again did not show up or call us to rescheduleOn 11/20/ [redacted] called and complained about her brakes again so we set up an appointment for 11/23/Again [redacted] did not show up or call us To resolve this complaint Timebuyer ended up reimbursing [redacted] for the brake job that she had done by someone else while she was out of state [redacted] is satisfied with the resolution to her brake repair issue

In response to the complaint from *** let me address the statement he made that said “I’monly weeks late on my car payment”The contract that *** signed states that if any paymentis not made by its scheduled due date you will be in default of your contractIf you are in defaultof your
contract we can, contractually, repossess your vehicle“If I fail to make any payment infull when it is due according to the payment schedule or if I break any of the agreements in thiscontract (default), you may take the vehicle from me.”The allegations that *** made are unfounded*** was upset that we found out his newaddressWhen he asked us how we found him we simply told him that Timebuyer received aphone call from someone who wished to remain anonymous*** did not like that answer andsaid he would not pay until we told him who the caller was*** never mentioned anythingabout a service issue*** became argumentative, swearing and refusing to pay so ourmanager simply told him that there was nothing more to discuss and that he was going to end thecall.Our goal is that every customer makes their payments on time and pays off the loanWe realizethat customers do run into financial difficulty from time to time and we expect them tocommunicate with us so that we can try and work out a solution if a serious problem occursThelast thing that we want to do is repossess a vehicle but *** is currently days late and indanger of having his vehicle repossessedWe are in the process of working out a paymentsolution and hope to have it finalized quickly.We do appreciate *** as a customer and believe that we can have a good working relationshipmoving forward!Sincerely,Anthony ***VPO

vehicle for final inspection before delivery to the customer.*** purchased a Dodge Avenger with roughly 61,miles on 09/08/This vehicle came with the standard day 3,mile warranty*** also purchased a month 24,mile service plan that covers major engine and transmission failure only.*** stated in her complaint that she has driven over 24,miles and is out of her extended drive train service plan*** must understand that miles driven is the primary factor in terms of wearing out partsThat is why most warranties and extended service plans include both time and mileage, whichever one comes firstTimebuyer has fulfilled all of its legal obligations with respect to warranty repairsThis vehicle is no longer covered under any warranty or extended service planIn consideration of the amount of miles that are being driven with this used vehicle it is obvious to Timebuyer that *** will not be satisfied with her purchase.To resolve this complaint Timebuyer will allow *** to surrender her vehicle to the Timebuyer location that she purchased it fromAs long as there is no damage to the vehicle Timebuyer will accept the surrendered vehicle in full satisfaction of the loanThere will be NO REFUNDS issuedThe vehicle must be surrendered by 01/28/Sincerely , Anthony ***VPO

[redacted] purchased a 2008 Dodge Avenger with roughly 61,000 miles on 09/08/2015. This
vehicle came with the standard 60 day 3,000 mile warranty. [redacted] also purchased a 24
month 24,000 mile service plan that covers major engine and transmission failure only.
[redacted] brought her vehicle in on 9/17/15 to check the brakes and belt squeal. We replaced a
faulty alternator. We test drove the car and it drove fine. We pulled all four tires and showed
[redacted] that the brakes looked new. [redacted] stated “I can see that they are new” so we did
not replace them.
On 10/27/15 [redacted] called and stated that the brakes were still not functioning properly so we
scheduled an appointment for 11/3/15 and told her that we would be willing to put new brakes on
as a courtesy. [redacted] did not show up for that appointment. On 11/16/15 [redacted]
rescheduled her appointment for 11/18/15 because she felt that her transmission was shifting
funny. [redacted] again did not show up or call us to reschedule. On 11/20/15 [redacted] called
and complained about her brakes again so we set up an appointment for 11/23/15. Again
[redacted] did not show up or call us.
To resolve this complaint Timebuyer ended up reimbursing [redacted] for the brake job that she
had done by someone else while she was out of state. [redacted] is satisfied with the resolution
to her brake repair issue.

In response to the complaint from [redacted] let me address the section of the contract that [redacted]
quoted. This section is titled Default. “Time is of the essence in this contract. I will be in default
of this contract if I fail to make any payment when it is due, or if I fail to comply with any...

terms of this contract. If I fail to cure a default in the manner prescribed by applicable law, you
may require me to pay all remaining payments, unless my default is based solely on my failure to
make a payment when due, in which event you may require me to pay all remaining payments
only if my failure has continued for at least thirty days.”
This section of the contract simply says that making your payments on time, meaning on or
before your scheduled due date, is very important. It also states that if any payment is not made
by its scheduled due date you will be in default of your contract. If you are in default of your
contract we can, contractually, repossess your vehicle. “If I fail to make any payment in full when
it is due according to the payment schedule or if I break any of the agreements in this contract
(default), you may take the vehicle from me.”
The section that addresses “if my failure has continued for at least thirty days” is strictly
speaking about what it would cost you to get your vehicle back after a repossession. If we did
repossess your vehicle before you are 30 days late then you will not be required to pay it off in
full. If we repossess your vehicle and you are over 30 days late then we can demand that you
must pay the loan off before you get it back.
[redacted] has made every payment late. Our goal is that every customer makes their payments on
time and pays off the loan. We realize that customers do run into financial difficulty from time to
time and we expect them to communicate with us so that we can try and work out a solution if a
serious problem occurs. The last thing that we want to do is repossess a vehicle!
We hope that this explanation of the contract is helpful. We do appreciate [redacted] as a customer
and believe that we can have a good working relationship moving forward!
