Review: [redacted]/Timeless Films NY/[redacted] films has failed to deliver a wedding video with a final time in the 30-40 min range, and a 3 min vignette paid for in full on October [redacted] 2012. Just after my wedding was shot on September [redacted], 2012 [redacted]/Timeless Films NY/[redacted] films informed me that early receipt of the final payment of $1030.00 would "secure a spot in the editing queue." The final edit would include a video in the "…30-40 min range, and…a 3min vignette. I sent a check for the specified amount but was not given a specified time as to when the video would be completed. In an email received on September [redacted] 2012 the defendant would "start the edit within the next few weeks and it takes about 2 weeks per edit." On November [redacted] 2012 I requested an update on the final video; I didn't receive an update until December [redacted], 2012. The defendant stated that his home sustained significant damage due to Hurricane Sandy and that he would be "up and running in January to start editing the film." I then sent a private message to the defendant via his company [redacted] page on December [redacted] with the following:

"Hello [redacted]. I received your email regarding our wedding video. I'm sorry to hear that you were a victim of the storm and we wish you a steadfast recovery.

While we are sympathetic to your situation, is there any way we can have a more definitive timeline? Given that we paid you in full in September, we thought we would have something closer to a finished product by now.

[redacted]/Timeless Films NY/[redacted] films responded with the following:

"Regardless of my personal situation, the normal timeframe for an edited film is in the area of 6 months which is typical in the industry. Starting the edit in January is within that time frame. I would love to give you a more definitive answer but based on the fact that I am a smaller company and do all the editing myself, it is not possible. I will make sure sure it is done within that time frame."

This "industry standard" timeline was not defined in the original contract. After months of no response from the defendant I send the following message, on April [redacted] 2013 also via [redacted] private message:

"It's been some time since we spoke. I'd like to know how our wedding video is coming along. Can you please update me as soon as possible?"

[redacted]/Timeless Films NY/[redacted] films responded with the following, four days later on April [redacted], 2013:

"[redacted].....I do apologize. I was in the middle of editing the job and the hard drive failed. I am able to recover this information and this is what I am in the process of doing (I have already delivered the hard drive to a recovery expert). Of course, not your fault and I do apologize but due to this unforeseen issue, it has caused a delay. I expect to have this software recovered by the latter part of next week. Once I get it back, I can finish editing (I was at the tail end) and burn the CD's. I the meantime, can you give me an address of where to mail them so once I get the software, I can get it finished and mailed. Thanks for your patience and understanding."

Since this last private message the defendant has admitted—in various email messages and voicemail—to losing the raw footage shot on the date of the wedding and has shown extreme negligence in attempting data recovery and communicating the progress of that recovery. The defendant has claimed to have attempted data recovery several times and has not produced any proof of receipt corroborate his claims. After June 2013 the defendant ceased interfacing with me completely and seemingly handed all communication over to a [redacted], a colleague who has since acted as a proxy on behalf of the defendant. On September [redacted] 2013—over a year from the date of the wedding—the defendant produced a wedding video of fourteen minutes and twenty five seconds in length, well below the promised thirty to forty minute range and no vignette. The defendant claims that missing/corrupt video footage was the reason for the brevity of the film. I've tried negotiating several agreements with the defendant to avoid litigation but he has been uncooperative in remedying the breach of contract. The defendant promised financial compensation in addition to a re-edit of the shortened video only to renege on the terms the defendant set forth. I can no longer trust that the defendant will produce a quality product as he has not only mishandled the original footage but has displayed withdrawn and errant behavior when negotiating any terms. I am requesting a full refund of the amount paid in full of $3095.00.Desired Settlement: I am requesting a full refund of the amount paid in full of $3095.00
