Tile and grout for this project was supplied by the client and installed by the contractor as per the manufacturers recommendations the sealer we supplied and installed was Impregnator SealerWe did not at any time install wrong or defective materials. The grout materials the client is
claiming are wrong, These materials were supplied by the client. At time of installation we advised the client that the bathroom heat needs to be controlled to a moderate level and if not the caulk will continue to fail. From our experience the reason the grout is failing is due to excess heat in the bathroom, the bathroom has inadequate ventilation and fresh air. The bathroom has no windows or order means for venting the excessive heat and cigarette smoke we observed while working at the apartment SWe will gladly sent the men back to repair the grout and caulk at the bath tub area secure the electrical under cabinet lighting and inspect the wrong grout supplied by the client. Please advise on how we should proceedRegards

Our records indicate I was attending to my ill mother and was in and out of the country several time`s from October through January, until her death on January 6-th. We did not take any new work and the response to any inquires from new or existing clients was very limited. Since our contact in January we have always offered to do the repairs. Thank you for providing the information regarding the venting system and scientifically proving what we have stated all along, The bathroom does NOT have any fresh air intake into the bathroom, what the experiment clearly demonstrates is an exhaust system, as pointed out in the demonstration it removes air without mechanical means at the source, there is no direct fresh air into the bathroom to balance the moisture levels, there-four when taking showers there is high build up of moistureAs the experiment with the paper clearly points out its an exhaust system, where is the fresh air coming in to the bathroom from? There is not a second duct delivering air into the bathroom and no window The sink photo is there for the sole purpose to demonstrate that the tile work behind the sink areas, the tile and grout that does not receiving direct water are in perfect condition in comparison to the other photos of the bath, shower tile, and exhaust grill area photos that receive extensive water and moisture. When you compare the many photos they clearly show a build up of heavy dirt on the tiles, grout and the grill indicate and clearly demonstrate that the bath tub / shower area is in need of a professional cleaning and has not received a professional cleaning since the tiles were installed, Is also shows no failed or gooey grout We would like to see the report and photographic evidence taken during the repair from the licensed contractor that made the repairs, How much failing grout was removed, How deep was it removed, What type of grout was used to replace the mapi grout, If the old grout was not removed what measures were taken to prevent the grout from doing the same again What measures were taken so the new grout will adhere to the old, You cannot just re grout part of the floor, To a licensed contractor that would not make any sense What lab results did the licensed contractor received from Mapi the manufacturer of the grout as to why there grout was failing and gooey as stated. The contractor does not manufacturer the grout so it will be interesting to see what the results are from Mapi as to why some of the grout from the same mix and bag is gooie and other areas are notWhat is Mapi report of the gooey grout, Why does it only be gooey sometimes and not others, When the tile was inspected on February 27-th almost one year after completion there was no signs of gooye grout or failing grout on the walls or floor as our photos of the tile and grout demonstrateThis can be clearly seen from the photos we provided of the walls and floor, We are willing to settle this ASAP How long did the repairs take, Was the repair done over the existing or was the existing grout removed? Was the repair a one or two day repair a fair compensation for a licensed contractor would be $for a two day repair. We will be willing to pay that amount in compensation, As the total renovation cost $12,after sales commission was paid, that included demolition, plumbing, carpentry,tile,waterproofing, electrical, plaster and paint and the other work in the kitchen, unless the repair involved replacing the entire tile and grout then the client request for $is extremely excessiveAs the original tile install was $ to install the tiles, grout, sealers and saddles On advise from our attorneys that is a very generous and fair cost for this repairs, otherwise we may as will take our chances in court and present our evidence and witnesses with their inspection, analysis and reports from the site inspection on February 26th Let the judge and the attorneys compare the repair evidence provided by the clients licensed contractor to our evidence and decide the out come. We think that is a fair compensation to settle the minor grout repair carried outWe will also throw in a good professional cleaning of the tile as a complementary offering. I believe contractor should honor his guarantee.          The contractor states the grout is failing because my bathroom does not have awindow, is not ventilated properly, and is hot. He claim this is based on hisexperience.  At no time before, during, or after the renovation did the contractor tell me the bathroom had to beclimate controlled. It is true that my bathroom does not have a window. Manybathrooms do not have windows. Also, professional company cleaned my building’sventilation system five months before renovations began. At that time, thesystem was checked to make sure the liters of air pulled met NYC Code. Theventilation system is in compliance City Code. My bathroom has no heater. Usinga thermometer, I monitored the temperature over a three week period. Theaverage temperature of my bathroom is 76 degrees.           In November, the contractor also did not respond when told the electric wiring theyinstalled is held up by tape. Electrical wiring should not be secured withtape.          I did not buy the grout. That is untrue. I supplied fixtures and tile only. That aside, thecrew mixed and applied the grout. That is work. The contract states that allwork performed by his company has a one year guarantee. He will not honor thatguarantee.  No contractor should share any personal information they discover about their clients. Clientstrust that no contractor or crewmember would embarrass cause him or herembarassment by sharing personal information they discover while in a privatehome with third parties – especially on a publicly accessed internet site suchas the Revdex.com. The contractor revealed that I have a bad habit and that, in hisopinion, my apartment stinks. So long as I don’t disturb my neighbors, mypersonal lifestyle choices (healthy or unhealthy) and what I do in my home aremy business. I was living off site for the duration of the renovation. Therewas no smoke at that time. Whatsmore, smoke should not cause grout to crumbleand fall out in chunks in a matter of a few months.

I already have 'disclosed' everything to you...and more.  By the way, disclosure between claimant and defendant is not required for Small Claims cases (claims for $5000 or under.) I think your attorney is confusing a Small Claims hearing with a Civil Court case (claims for above $5000 up to $25,000). I believe that is where disclosure might come into play. I'm not sure...but I don't care.As far as your request for me to do research and compile reports and all that other stuff for you....No. Please stop criticizing my house-cleaning and other things. You have never been here when work was not in progress. Not that it matters, nor is it any of your business, but I am meticulous. This is not the first time you have been personally insulting on this site . I have kept my responses focused on the work your company performed....I have asked you more than once to stop insulting me. I have never insulted you on a personal level. So stop. It is unattractive behavior, unprofessional, and it really does nothing to help move this issue to a civil resolution. I am glad you are willing to settle. Thank you. Review: Timoncon contract for bathroom renovation included guarantee of work performed for one year after completion of work. On November **, 2014, I contacted Timoncon and sent pictures of tile grout an tub seal in bathroom, floor grout staining, and installed wire for undercabinet lighting in kitchen with tape. hanging down. Timoncon response on December *, 2014 that repairing both issues was not Timoncon responsibility. I want Timoncon to repair work using correct materials as per break-down submitted to me in repair quotes from other contractors - all are consistent scope of work.Desired Settlement: Proper repairs using correct materials. Regrout bathroom wall tile using correct grout and sealant. Seal tub surround with silicone. Remove grout on floor tile and regrout using correct tile grout and correct sealer. Secure under-cabinet lights properly. All corrected work completed by March *, 2015 at latest.
