I received your letter dated August 12, 2016 concerning [redacted] complaint about her driveway damage. First, I did take a look at the damage to the apron of her driveway. I stopped at the house and no one answered the door. We also called and left her messages.There is no where in our... snowplowing contract that states that we repair driveways. We have no knowledge as to what condition the driveway is in or how it was resurfaced. Ms. [redacted] driveway had been resurfaced at some point and the thickness of asphalt at the apron was very thin. As she lives on a state road (Route 98) the apron damage was most likely done by thestate plow truck's wing. My office manager left that in her message and advised Ms. [redacted] to contact the state highway department.Finally, our plows do not have the down pressure sufficient to peel back solid asphalt. We try to do the best snowplowing that is possible. We do repair any damage to lawns in the springtime. Everything that we can do is done. We have been plowing in the Orleans county area for over 20 years. This is the first time that anyone has complained about driveway damage.I'm sorry that we cannot do more for Ms. [redacted] . She does have a balance on her snowplowing contract of $315.00. If she continues to ignore the amount due we will be forced to turn the account over for collection.Sincerely,Timothy [redacted]

It is clear that a plow entering the driveway did the damage since the pieces of asphalt were within the piles of snow pushed by the plow on the sides of the driveway. The owner states their contract doesn't state anything about repairing damage, but he then goes on to say they repair damage to the lawns.
