Review: My roommates and I signed a lease in July of 2012 that ended in June of 2013 for a townhouse. We paid a $1,000 refundable deposit and a $400 nonrefundable deposit. The $400 nonrefundable deposit was to go towards carpet cleaning and what little amount needed to be painted in the house after moving out. During the beginning of our vacancy, the carpets were clean. Eventually as foot traffic had gone over the carpet, multiple stains from the carpet padding appeared in all areas of the house. They were pet urine stains from the previous renter. We told Timothy Park about the predicament and how the stains did not come from us, and they still deducted an additional $60 off of what was the already $400 deposit for the carpets. Their reasoning was they had to clean the carpets twice. Understandable that they had to clean the carpets twice. However, I contacted them after moving out as to why we were forced to pay for someone else's mess. Their reply was that we don't know if it was them or if the stains were from my roommates and myself. I promptly asked them to go retrieve the file from the previous lessee in order to inform them on the conditions of the carpet before we moved in. The lady in the office asked me if she could get the file and return my call in five days. I told her that would be okay, and she never returned my call. I called her back a week and a half later, and she had not retrieved the file and they were too busy. She asked if they could get the file sometime in the next 3-4 weeks and then call me back. In the end, nothing is getting resolved. Their customer service is severely lacking. The deposit check that they sent me did not have the information as to why we were not getting the full amount returned to us. Lastly, this will become an ongoing problem, because next year they will put another poor renter in the same position and continue to charge their renters unfairly.Desired Settlement: I would like the $60 that they charged us for what was very clearly not our fault, and for them to pull the file of the previous renter. This way it can be proved that the carpets were in that condition before our moving in.

Explanation of complaint:

My daughter and 3 roommates had a signed lease agreement with co signers and a security deposit paid in the amount of $1880 since early April with [redacted] duplexes for a townhouse they were to move into on Sept. 1st. They are all college students at CWU and are all from Spokane. We had to make several trips over to Ellensburg ourselves to pay the deposit and to sign papers. (They kept sending us emails to co-sign, but they never sent an email with the correct link) We called and emailed them letting them know this but they never could get it right and so we had to drive over to Ellensburg to sign paperwork a couple of times and leave a deposit. Then at the end of July, [redacted] called [redacted] (one of the tenants) and told him the townhouse was no longer available. We have had to drop our summer plans to hurry back over to Ellensburg to secure another apartment for these 4 college students. Amidst our signing with a new apartment company, I told them what had happened and [redacted] (the company) said that this wasn't the first time [redacted] has done this. I also read a complaint about this on line about [redacted] from 3 years ago. I myself own a rental and could not even imagine doing this to prospective tenants, let alone from out of town! I really think this needs to stop. It's a waste of everyone's time and money, not to mention it goes against the landlord/tenant laws. I have tried my best to settle this with the owner, [redacted], but she is less than compliant. She has in fact been getting away with this for quite some time now and probably thinks this will just get dropped and she will continue this practice. This has been very time consuming, but I will do whatever needs to done to stop this illegal practice of this business owner and to make it right for us and future tenants of this rental business.

This practice violates the landlord/tenant law RCW 59.18.253Desired Settlement: For this business to abide by the law and to refund us $1440 in current expenses.
