Titan Tree Service

My significant other, *** and I have a 50ft cottonwood tree that we hired *** of Titan Tree Services to remove on July 1,2020. The tree has still not completely been removed currently the date is 7/21/2020. Last week we expressed to him that he needs to be careful with his trainee as his trainee kept damaging our gutters and dropping large limbs on our house. Yesterday, 7/20/2020, I, *** heard a loud thud that shook the whole house as I work from home. I was on a work call when this happened. When I was done about 45 minutes later I looked outside and *** and his team were no longer in sight. I went outside and he was no longer to be found. I looked down the street, *** and his crew was servicing another house and approached him. I said is everything okay? I heard a really concerning loud thud that shook the whole house. *** said yes everything is fine. We dropped that big limb on your roof and it left four small 2" holes on your roof so I'm going to have my guys come over and fix it for you tomorrow, no worries it will be brand new. I said to *** well I would appreciate it if you speak to *** about this matter since he has been in contact with you from the beginning and know's more about the situation. *** said no problem I will give *** a call when I get home. I called my *** and told him about this situation which was at 2:10PM on 7/20/2020. He was working and said he would get on the roof when he gets home but was very concerned that *** did not even try to attempt to contact one of us when this all happened. *** is a contractor so I knew he would be able to handle the situation appropriately and be able to assess the situation properly. *** text messaged *** about the situation and told him I heard your girlfriend updated you about the tree, my team will have these patched up for you in no time. *** called *** and said there are not small holes and sent *** the pictures of the holes. There are 4 holes that you can see right through into our attic way bigger than 2 inches each and 5 holes that punctured the decking. As well as multiple scratches where *** and his team drug the branch off of our roof. *** said that he already had a roofer quote him for $400 to fix the damage and that it would be all taken care of. *** being familiar with codes and how big the holes were, that most likely our whole front panel of our roof would have to be replaced. *** said he would not pay for someone else of our choosing to do our repairs. We asked *** for his insurance and he stated that he is not going to fix this through his insurance that he is doing it out of pocket. *** said can we have your insurance information so we can handle this properly. *** refused. *** said then we will have our lawyer contact you so we can get your insurance information. Which leaves us where we are now. *** said to not contact him unless we have payment for his labor of 3 weeks of removing our tree with it still having 25% of it left to finish. We do not feel comfortable having *** and his team finish the job as he broke major safety precautions and did not contact us when the tree damaged our roof. We have 2 eye witnesses, even one of our neighbors came over and knocked on my door to ask if I was okay because she saw the whole thing happen. Now *** said he will see us in court if we expect him to pay for the damages. All we wanted to do was get his insurance information so we could handle this appropriately.
