for an apartment on July 29, 2015 and was promptly approved, however he notified the office on August 6, 2015 that he no longer intended to rem the apartment for which he was approved. The rental application that [redacted] signed is quite clear regarding the disposition of the deposit in such a situation: "It is further understood and agreed between the parties that in the event that payor withdraws said application, or in the event said application is approved and accepted by TRMCO, and payor refuses to enter into a lease agreement for the period of time as called for in said application, then the sum so received herein and the balance of the deposit as indicated on page one of this application shall be retained by TRMCO, to serve as liquidated damages for damages it will suffer by reason of payor's failing to enter into tenancy of the above stated suite." Under the circumstances, our decision stands. Sincerely,Scott ** G[redacted]
