As stated in my initial response we are willing to exam the issues further and make every effort possible to eliminate a squeak to the floorWhile we can not guarantee any floor to be 100% squeak free we have made attempts and are willing to do so again if permissible by owner The ABS Warranty department has also made this offer clearly, in writing to the customer that builder and warranty department have agreed as stated to work on eliminating floor squeak to their satisfactionWe have not had a response to that offer at this pointThe work needs to be scheduled to allow access for repairs

TJB Builders response:TJB Builders provides an ABS Homeowner’s Warranty to all customers that build a home with us. This warranty is the sole warranty provided and all customers acknowledge receipt of this warranty within the warranty guide provided at building contract signingThis warranty provides that the home is warranted by the builder to be free from defects in materials and workmanship described in section VII of the limited warranty orientation guide. In addition to the one year material and workmanship warranty also provided is years of major structural defect warranty and both of these warranties take effect from “delivery date” of the home In this case, the customer closed on the home in question on April 9, so his one year warranty period expired on April 9, 2016, thus the standard warranty period has ended. I have attached copies of the warranty requests that were provided TJB Builders during the active warranty period for this home that will show the warranty items that we scheduled for repair honoring our commitment to the customer on behalf of the ABS warrantyAs you can find outlined in Section of Section VII, Construction Performance Guidelines”, Floor squeaks are addressed directly. There is no guarantee of squeak free floors in the home but reasonable efforts are made to eliminate squeaks where feasible. TJB made previous attempts to eliminate floor squeak issues and even after the 2nd attempt the client had no issues with squeaks and told the Superintendent as much before the visit was over All local and state building codes were met during the construction and is evidenced by approved inspections and an issued certificate of occupancy for the home by the building department. We made every effort to resolve an issue that has no guarantee of squeak free and even did so after the outlined warranty period. The ABS Warranty department has also informed the owner of warranty expiration periods for the standard warranty and has advised him to refer to the warranty guidelines to follow should he feel this is a structural issueOur position is currently, and has always been, that we want to honor our commitment to customers after the build but certain criteria must be followed and adhered to so that we can maintain consistency. Although we are not obligated to any extended warranty time period we would be open to the possibilities of an additional attempt to resolve some squeak issues but by doing so make no guarantees that the customer would be 100% satisfied

I have received communication from the warranty/ ABS....by email. The e-mail stated that I would be contacted soon about resolving the flooring but dry wall  cracking issues still exist. It's been almost 2 weeks and no one has contacted or reached our to me to schedule anything at my hone.

The septic system and drain field on [redacted] property were designed by, approved by, and passed inspection(s) by the County of [redacted] South Carolina.  The Health Permit that was issued by [redacted] County, detailing the design and location of [redacted] septic system and drain field is also...

attached here.  The installation was completed by a separate contractor, [redacted] Construction, in adherence to the design and location as decided by [redacted] County, South Carolina.  We know this because in order for [redacted] home to receive a Certificate of Occupancy, which deems the house live-able, and all systems in good working order and the home meets all code including plumbing, the County must send an inspector to check and pass all these systems.  The Certificate of Occupancy was issued by the County of [redacted] on 10/8/2014, and the signed Certificate is attached here.    According to the signed contract between [redacted] and TJB Builders,  # 4. Conditions of Property:  The Owner warrants that the Property is suitable for the subject construction and the owner hereby agrees to indemnify and hold Contractor harmless against any and all liability, at law or equity, arising out of the conditions of the property.  These conditions include adverse soil conditions.  Further in the signed contract # 12. Provisions For Owner Responsibilities: "Contractor (TJB Builders) does not warrant any of the Schedule "B" items as warranty would be the direct responsibility of the vendor of such service".   Installation of a septic system is included in the Schedule B items as [redacted] is aware, as indicated by his signed and dated contract which is attached here.  We support [redacted] in returning to his septic system installer [redacted] Construction, as per his contract, to resolve his septic issues.  The [redacted] Limited Home Warranty provided also advised [redacted] to contact the septic installation vendor.

We have not had a response to that offer at this point. The work needs to be scheduled to allow access for repairs.
