I intent to pay him back and I'm having surgery and out of work for a few weeks - I understand it's late and you he stated paying $in May $in April which will give an extra $

My initial response to this is,
Mr*** has made a number of promises over the last months that have not been fulfilledFurthermore his reason does not explain why no attempt has been make to return my messages, contact me, or respond directly to the letter from my attorneyIt also does not explain why after having many previous months to come up with these funds as well as having other sources of family income (which I will not name at this time), that I must still wait for my money to be returned to me
I believe a responsible contractor's first obligation is to their customersIf you are eager and willing to take a person's money, then you should be just as willing and eager to return it when it is requiredCommunicating with customers in a direct manner when they have concerns is all part of doing good businessAnything less than that can be considered shabby and underhanded
Contrary to my better judgment and legal advice, I will continue to wait, againAny further delay no matter what the excuse is and I will proceed with having my attorney file in courtAll court fees and attorney fees will then fall to Mr*** as well as the original amount owedI will pursue this to the end

My initial response to this is,
Mr. [redacted] has made a number of promises over the last 7 months that have not been fulfilled. Furthermore his reason does not explain why no attempt has been make to return my messages, contact me, or respond directly to the letter from my attorney. It also does not explain why after having many previous months to come up with these funds as well as having other sources of family income (which I will not name at this time), that I must still wait for my money to be returned to me.
I believe a responsible contractor's first obligation is to their customers. If you are eager and willing to take a person's money, then you should be just as willing and eager to return it when it is required. Communicating with customers in a direct manner when they have concerns is all part of doing good business. Anything less than that can be considered shabby and underhanded.
