I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear while they did refund the$150, they lied to me and lied throughout their response to you. I was never without any paperwork and gave them everything they requested. They were lazy and incompetent and never requested of me what they needed to give escrow. They also did not gladly provide the refund. They were rude and unprofessional throughout. The excuses for delays, etc are also lies. However I am satisfied no further action by you will correct the issues and very much appreciate that it was only after your intervention that they grudgingly refunded the $150

To Revdex.com,   We are responding to the complaint assigned an ID of [redacted].   We have already been in contact with Ms. [redacted] in regards to the complaint, however, we feel she has misrepresented the facts and is not entitled to any compensation from TLC Manufactured...

Homes, Inc other than the $150 already refunded to her on 5/24/16, check #[redacted].   To address her concern about escrow fees, it is true she was not required as a seller to pay for any closing costs, other than repairs, back taxes, or space rent. The escrow company, Ticor Title Company, withholds $275 at the close of escrow in case of any issues that may arise due to titling. Ms. [redacted] will be, if not already, refunded this 30-60 days after the close of escrow. When signing escrow papers, this is mentioned in the documents she read and signed. We aren’t sure where she came up with the $475 number.  Unfortunately, the closing was delayed, but not by the buyer. The buyer paid for health and safety and termite inspections, and the seller, Ms. [redacted], was unhappy with what was found in the termite inspection due to her home not having regular maintenance for the 5 years she lived there. She delayed the closing by trying to find another termite inspector that would have found less issues that would in turn have cost less for her, however the buyer has the choice of which inspection they wish to accept. Rent is pro-rated at the close of escrow, and since Ms. [redacted] delayed closing to search for a second termite inspection, she received less rent pro-ration, as it was on her end. The buyer’s escrow on their home was delayed by two days, however during that time Ms. [redacted] spent an additional two weeks searching for a second quote for termite inspections, which is out of the control TLC Manufactured Homes, Inc.  Ms. [redacted] mentions a $150 rent charge, we are unaware of what she is referring to here as well.  We have a listing agreement signed by Ms. [redacted] approving the fact that TLC Manufactured Homes, Inc. had her manufactured home listed as an exclusive listing. Our licensing laws are with the Department of Housing and Community Development, not Bureau of Real Estate. She signed both the listing as well as the original offer from the buyer showing that [redacted] was both the listing agent and selling agent for her home. Ms. [redacted] and the tenants of the home (Her son and wife) were aware that [redacted] showed the buyer the home originally and submitted their offer to her.  His signature is on both the listing and buying side of the document she signed. We are a small office with 5 sales people, it is very common for a listing agent to sell their own listing. We do not have other dealers or realtors show our homes, it is all in house and exclusive, which gives our sellers peace of mind knowing random strangers won’t be viewing their home at all hours. Ms. [redacted] contacted us after leaving a poor Yelp review requesting that she wants $150. She was charged for a duplicate title and registration, and we gladly refunded her when she was able to find her original title. When the listing agreement was signed, she did not have this paperwork, so escrow assumed that she had lost it and charged her a fee. She had signed escrow papers aware of this fee, however, we did take some of the blame so refunded her the money to keep her from being unhappy. Unfortunately some people are never happy.
