Complaint  IDN:              [redacted]}In reply to Revdex.com complaint submitted by our patient [redacted] (copy attached): I would like to first address the factual inaccuracies in Ms. [redacted]'s statement.We did not see...

her in December 2017. We first saw her on 3 January 2018.The amount collected for the initial appointment was not $300; it was $259.The fee for the orthotic was $2600 not $2300.Ms. [redacted] stated "I called Dr. Berry", when in in fact, she has never actually contacted our office herself regarding this issue. Her friend, [redacted], has been the person who has called our office.On 1 January 2018,Ms. [redacted] presented at this office. She filled out a medical history questionnaire. Under current symptoms/chief complaint she wrote
"chronic jaw, neck, head, back pain" which began "10 years ago, but flared up 1 month[ago]." She also reported moderate to severe headaches 2-3 times per day, pain and congestion in her ears, left face pain, pain and
popping/grinding sounds in the right and left temporomandibular joints, and a
feeling of a misaligned bite. She reported that she had worn an oral orthotic in the past to treat her TMJ condition. When asked if she had tooth pain, she indicated yes and that she had had "recent fillings to left side." She reported that these fillings were placed in late
November and since then she has been unable to wear her current oral retainers . 3D panoramic and lateral skull x-rays were taken and physical examination was performed. Recommended treatment plan was discussed and consisted of a computerized scan of her bite for $150, a new upper oral orthotic for$2600 and extensive review of her x-rays by
an oral radiologist for $150. At that time, she indicated she wanted to proceed with
the recommended treatment .  She
scheduled an appointment  for  9 January 2018 @ 8:00am to have the impressions, scans, and readings
taken. She paid $259.00 with a credit card .On 9 January 2018, she presented for her
appointment with her friend, [redacted]. At that time the computerized bite scan
taken, i-CAT x-ray images were sent to [redacted] for review and an
impression of her upper teeth was taken to fabricate the new orthotic. Mr. ** paid for this visit and the orthotic treatment totaling $2900 with his credit
card. She scheduled for 10 January 2018 @  2:15 (the
very next day} to receive the orthotic.On 10 January 2018, she failed to come to her appointment
to pick up her orthotic .On 29 January 2018, Mr. **, spoke with my
office manager, Joan K[redacted] . Her written notes state that he said [redacted] has decided
not to pursue treatment at this office at this time. She might think about
coming in March or April. He said he wanted a refund for the orthotic .  He stated Dr. Berry misdiagnosed [redacted], that she didn't
have a TMJ problem, but an infection in one of her teeth whichHeadachewas whyshe had pain and that needed to be addressed first.                                     ...                                         ... [redacted] Page 2On 1/31/2018 Joan discussed the issue with me. I decided that, since we had already made the orthotic
and completed 90% of the work on it, I would not be able to give a full refund. I would, however,refund½ of the orthotic
fee. $1300 was refunded to Mr. [redacted] credit card. I re-examined the i-CAT scan
and reviewed the radiologist's report and could find no evidence of any dental abscess .I also said if Ms.
[redacted] came in to get the orthotic within 90 days,all she would have to pay for the orthotic would be
the $1300 that was refunded. Joan spoke to [redacted]
and relayed this information.On 2/12/2018, Mr. ** called the office. In short, he requested refund of the remaining $1300 or he
would post negative reviews and complain to the Revdex.com and would take it to small claims court. He was told that there would be no further refund.I do not believe that further refund is warranted for the
following reaso ns:I do not believe that I mis-diagnosed Ms. [redacted] as Mr. ** claims. She has TMJ dysfunction and this is evidenced  in the exam  results and in her history questionnaire that she filled out. She may indeed have a separate dental issue, however it was not evident in the x-rays taken at this office. Although I am a dentist, I no longer treat general dentistry; my practice is currently limited to the treatment of TMJ disorders and dental sleep medicine.M s. [redacted] agreed to the treatment plan and agreed to have the orthotic fabricated and scheduled an appointment to pick it up. We fabricated the orthotic and therefore should be compensated.Despite Mr.  [redacted] actions, I am more than willing to treat Ms. [redacted] for  her TMJ condition if she chooses to come in for treatment. If the orthotic no longer fits due to  dental work,  I am willing to remake the orthotic at no additional charge except, of course, for the $1300 that was refunded.   There would  be no charge for the follow  up visits to  adjust the orthotic for the next 90 days. Adjustments are every 2-3 weeks.
