July 26, 2016RE: Compliant ID [redacted] To Whom It My Concern:This letter is being written in response to a customer service compliant dated July 15, submitted by a [redacted] C [redacted] .I am the preparer of Ms [redacted] 's personal income taxes for the years through to 2013_ After reading Ms [redacted] 's compliant, I would like to clear up any misconceptions about both my role in the preparation of her tax return as well as any questionable behavior I have been accused of.Ms [redacted] is a former customer who was asked in January of to not return because of her behavior as she becomes both accusatory and confrontationalI had always dismissed Ms [redacted] 's confrontational behavior as a product of stress, as most people do not handle receiving correspondences from the Internal Revenue Service nor New Mexico Taxation and Revenue in a favorable manner.In Ms [redacted] received a proposed bill from the Internal Revenue Service stating that she could possibly owe $Internal Revenue Service claimed that a 1099-M1SC form in the amount of $was not reported on her The 1099-MISC was submitted from a lender for a vehicle that had been repossessed previouslyMs [redacted] brought me the letter and sent a responseThe income had been reported on Ms [redacted] tax return and she did not owe additional taxesApparently Ms [redacted] did not agree with the time that it was taking the Internal Revenue Service to handle the matter and this is when she became accusatory and confrontational about the issueAt this time, Ms [redacted] needed her income taxes prepared, which I agreed to do as long as this would be the last time we did business with one anotherShe agreed.In April of 2016, during my busiest time of year, Ms [redacted] brings to me correspondence from New Mexico Taxation and Revenue Department stating that she owes gross receipts, or sales tax, for the years that she was selling Avon, which were the years of & Avon sales are not subject to gross receipts tax as the parent company is liable for thatI explained to Ms [redacted] on two occasions, once when she first brought the letter to me and again in May 2016, why she was being billed the amount she was and also that she was not liableI agreed to send a response to New Mexico Taxation and Revenue, which as of July 26, I have done so twiceMs [redacted] called New Mexico Taxation and Revenue Department, they informed her they required more information, which Ms [redacted] could not produce as a significant amount of time has passed since she sold Avon independentlyThe information they requested was not relevant to Ms [redacted] 's situation as she should not be liable for gross receipts from her home-based sales.From the onset of this latest issue, I informed Ms, [redacted] that handling any and all correspondence related to my work was covered by the fee of $per yearSo a total of $She agreedI will admit that I was not the best at keeping Ms [redacted] informed of every response that was sentMost clients trust that I am responding to an issue in a timely fashionM [redacted] again began to accuse me of not responding to Taxation and Revenue and called me 'liar' once again and that this was 'the game' I played and that I was tfukd'(sic) in response to me saying I would no longer complete the work as she is too confrontational to deal withr do admit to responding to Ms [redacted] in the way she outlined in response to being threatened by how she would report me to the Revdex.comI responded from a state of frustration as this is Ms [redacted] 's usual response when issues are not to her liking and it is both insulting and tiresome.Furthermore, I do not understand why Ms [redacted] would include information about our personal relationship in the compliantText messages of a personal nature were never sent to Ms [redacted] without her consentMs [redacted] has responded with personal messages of her own which was usually a picture or a worded response or an invitation to join her and her children, I am only mentioning this as Ms [redacted] and I tended to blur the lines of our professional and personal relationshipAlso, I have no hidden agenda for revengeThere is not any reason why I would not assist Ms [redacted] in the manner I promised.On July 15, Ms [redacted] was asked to pick up her paperworkEnclosed is her initial correspondence she received from New Mexico Taxation and Revenue as well as all correspondence that was faxed to Taxation and RevenueAs of July 28, 2016, Ms [redacted] has yet to retrieve her paperwork.I am willing to answer questions in regards to this situationI am also willing to respond to any more letters or bills Ms [redacted] receivesShe is not liable for the gross receipts tax and this has been explained to her.Thank you, Gabriel *V [redacted] Senior Office ManagerTNT- Financial Services

I am rejecting this response because:I was contacted from NM Tax and Revenue regarding my taxes for 2010-requesting copies of Schedule C's and 1099'sDue to missing information my state taxes are being seized for an outstanding balanceI had contacted Gabriel V*** regarding this since he was the tax preparer for me these yearsAfter months of no resolution I finally contacted Revdex.comThe original complaint was filed 7/15/#***He had responded with a satisfactory outcome and I acceptedHe had stated that necessary paperwork had been sent to NM Tax and Revenue on 7/26/and I would not be responsible for this balanceIf this was true then that is perfect and there is a resolutionI contacted NM Tax and Revenue's David U*** this morning via email inquiring if any papers had been received on my behalfAnd if the balance owed is still pending or would I be receiving a refund of the money taken? He responded to me promptly back that nothing has been receivedThe last communication he has regarding this is from me on 5/11/He has not been contacted by no other person nor received any documentsI still owe the taxes for 2010-He did include if the documents are provided then they can be submitted for an abatementSo once again this leads me to believe that Gabriel has not fulfilled his part of what he said he was going to do or had already doneAccording to his response to Revdex.com papers were sent 7/26/but according to NM State Tax and Revenue nothing has been receivedI do not have the time to go back and forth with someone who is not doing what they are claiming is being done to resolve this mess! I am filing another complaint since the response to the original one was not honest or been completed as said.If Gabriel is unable to resolve my tax issue I would like a refund of the preparer's fee I paid to him for the 2010-tax yearsIf he is able to resolve this then I want proof of what is being doneNot just a personal text message from him or some generic response to Revdex.comI do not have months to continue to wait while the interest being charged on this balance accrues dailyIf I need to find another preparer who is competent to handle this then I will do so as soon as I know that is necessary to resolve this

[redacted]'s compliant, I would like to clear up any misconceptions about both my role in the preparation of her tax return as well as any questionable behavior I have been accused of.Ms. [redacted] is a former customer who was asked in January of 2014 to not return because of her behavior as she becomes both accusatory and confrontational. I had always dismissed Ms. [redacted]'s confrontational behavior as a product of stress, as most people do not handle receiving correspondences from the Internal Revenue Service nor New Mexico Taxation and Revenue in a favorable manner.In 2014 Ms. [redacted] received a proposed bill from the Internal Revenue Service stating that she could possibly owe $4598. Internal Revenue Service claimed that a 2012 1099-M1SC form in the amount of $7462 was not reported on her 2012 1040. The 1099-MISC was submitted from a lender for a vehicle that had been repossessed previously. Ms. [redacted] brought me the letter and 1 sent a response. The income had been reported on Ms. [redacted] tax return and she did not owe additional taxes. Apparently Ms. [redacted] did not agree with the time that it was taking the Internal Revenue Service to handle the matter and this is when she became accusatory and confrontational about the issue. At this time, Ms. [redacted] needed her 2013 income taxes prepared, which I agreed to do as long as this would be the last time we did business with one another.
