We hired Todd to build our dream home. Halfway into the build we received a lean our our new build. Called Todd he gave us some lame excuse. That lean was 40,000 from him not paying lumber and Windows and the doors. Than a month later we received a bill for 20,000 . Which was from him, Todd not paying havac and plumbing. We called the bank, went over the numbers than noticed he even took 20,000 for himself for supposedly building our house. Which we paid him 10,000 cash to start the build. For the deposit and signed contract...We are 16 months into this build...

Desired Outcome

No further contact by the busi We would want everybody paid and our dream home finished...

I am in receipt of Mr. complaint against my company. I respect the fact that Mr. Watts is disappointed with the situation. I felt he and I shared clear communication throughout the entire process and the factual information was clear. It is true there was a lien in the amount of $38,000. Regarding the money owed to the HVAC/Plumbing company, that bill had nothing to do with me and was not considered paid at the time this issue surfaced. I honestly don't know how that's being included in the situation. The work was completed and as such that contractor should be paid. As it stands currently, Mr. is owed approximately $22,000 by my company. That can be used to satisfy the lien and pay the mechanical contractor as appropriate. The money that my company was paid was exactly the correct amount as per our contractual agreement. I personally take ownership in the failure of this job being not executed as hoped. There were many outside influences that were part of the issue. The bottom line was the inability to cash flow the job with the bank draw system and the inability on a personal level to carry that debt and float it out to completion. I take full professional and personal responsibility for that. It has proven to be the toughest situation in the past 18 years of contracting. I have been relieved of contract by Mr. Watts however, I will look forward to satisfying my remaining debt to him in the near future.

We do not agree with his response about the hvac and plumbing money, Because we signed the affidavit to release the money to the contractor to pay the hvac/plumbing guy, which he did not pay. We have no control over our money, the contractor did. So yes he did have control to pay all trades.

The information and response I gave was as accurate. The Plumber/HVAC installer is owed by the bank/ and or homeowner. I do not have an invoice but I am sure that if you would look at the date of submittle, you will find my statement accurate. I can provide you with the Plumbing/HVAC contractor information if necessary. The money that was drawn on the account is completely accounted for and I would be glad to send a copy of that as well. I do not wish to go back and forth. I understand fully that the homeowner is trying to absolve his/her responsibility to pay the HVAC/Plumber. I find that to be sad, and understand the angle in which he is pursuing to that degree. If you need anything further, I will be glad to respond accordingly.
