Business responded to complaint See attached.Business response also copied and pasted below by Revdex.com staff 8/19/15.Re: Response to Complaint ID [redacted] Dear Ms [redacted] :In response to the above complaint, I want to repudiate the Claims as follows:The damage to the bathroom ceiling was not caused by our construction of the rubber roof over the new addition, but was created due to the old leaking wooden windows located above the roof line I showed the client that there was a ¼ inch gap between the sandstone bottom sill and the wood trimI placed my putty knife through this gap all across the gap and the client observed this demonstrationUpon heavy rain, water easily flows through this opening and drips belowThe client has subsequently installed new vinyl windows to cure the problem Never the less, I repaired the ceiling damage and repainted same, as a courtesy from my companyThe garage roof covering was never completed because prior to the installation of the “modified bitumen membrane” as indicated in the contract, I photographed several sections of the deteriorated and damaged wood sheathing that would have to be torn out and repaired, prior to the covering installationThe client declined to incur additional cost, at the time I have credited $from the contract to cover the cost of the roof coveringThe complaint about the wacloset is un-merited The closet was built exactly as indicated on the drawing with one shelf on one side and one shelf along the back side The client said that there was a need for extra storage, so we installed additional shelving above the clothes hanging shelf and added other shelvingObviously you cannot hang clothes on both sides of the closetThe extra storage shelving, was not intended for hanging clothes, but was for storage The extra shelving and an extra light fixture outside of the closet were installed as a courtesy and no charges were submittedThe client wanted to remodel the kitchen while we working on the other work We removed all of the old cabinets and had them hauled awayWe removed the old plumbing and re-located the drain lines and water lines to the new location at owner’s request A kitchen window was to be installed over the new kitchen sink areaI indicated that the Electric Meter and the electrical service conduit would have to be relocated for the window to be installedI had kitchen drawings completed indicating the new layout and submitted marble samples for the counter top, in order to determine the cost of the new kitchen The client indicated that there was a financial problem, because of some checks were not received that were due to herWe shelved the Kitchen remodeling until her financial affairs were in orderThat is the reason the window was never installed I have not been remunerated for the preliminary kitchen work to dateAs far as the length taken to complete this job, while it has been long, the client has contracted my firm for other work during the construction period The client was selling another house and we were diverted to partially remodel the other house by tearing out ceramic tile, damaged underlayment and installing a new ceramic kitchen floor and trim work Also another problem cropped up and the basement flooded and ceilings and VCT tile were destroyedWe repaired the ceilings, plumbing, and replaced the flooring throughout the basement and recreation room So up to this time the client has used our company satisfactorily, for several projectsI have ALWAYS RESPONDED to my client’s phone calls and or text messages in a timely manner and have printed out text messages for verificationI believe everything was going smoothly until financial problems occurred for my clientI am trying to work out the remainder of the contract if I can be reimbursed for other work completed and not paid for yetThe only work not completed for this project is the deck and two coach lights to be installed The client conveniently neglected to mention the $1,Skylight that was installed in the bathroom and new plumbing and laundry tub that was installed at no charge.Sincerely, Damon CC [redacted]

WOW, In response to Mr C***s responsesDamage to bathroom ceiling has not been absolutely proven to be the gap in window above areaMr C*** pulled the caulking in front of me from the said windowWhile the caulking was old and could have been part of the problemWe will not know because the very next day after he showed me the area I did have the windows replacedI had contracted new windows thru another company about weeks before he determined it was the windowMonths before I informed him of a leak where the new roof met the old part of the houseMr C*** sealed the roof at that time and never mentioned that the window was the problemMr C*** had ample opportunities to notice that window while working on the addition, putting in the skylight, laying the roof etcHe is the professional and I would think he would have noticed potential problems and would have brought them up like he did regarding other issues he found during the projectThis statement is not trueRegarding the garage roof, Mr C*** surveyed the project before recommending installation of the "modified bitumen membrane". There was no discussion of damaged wood being replaced till after the winter season of 2014-when I mentioned to him that the roof needed to be addressed asap because of the damage done by going thru the winterProject was started 4/10/when Mr C*** repaired the overhead garage door to the said garage and could have easily fixed the roof at that timemonths later the damage to roof is considerably moreWhenever if the project including the roof was finished within the days promised, the roof would not be in the disrepair that it is at this timeAgain, untrueRegarding the walk in closet, Drawings show the design that we were promised and agreed too. Attached photos of proposed floorplan submitted by Damon ASC ConstructionEvery closet has a light - that was not a courtesy, neither where the shelvingAgain, untrueI had NO intention of remodeling the kitchenMr C*** informed me that cabinets were falling apart while contractor was closing up windows connecting kitchen to new additionMr C*** asked if I wanted them down and I agreed since he informed me that they were falling apartAs with all other jobs that came up during the project, Mr C*** always gave me a price up frontThere was "NO" mention of any additional cost for the cabinets and hauling them away. Mr C*** always stated when there were additional costs involved. Attached photo of proposed floorplan submitted by Damon ASC Construction showing kitchen windowAs for the other jobsI did contract Damon ASC Construction since they were already working in the Bushnell houseThe basement job did require some work, however not monthsAs for the floor at Lander that took all of one weekAgain, not the reason for the project being delayed monthsAs for money issuesThe money was there for the said projects from the beginning of the agreementInsurance paid two of the projects and the additional money was set aside by my mother back in May I have bank statements that will show money was not the issue. Poor job performance isMr C*** is using a conversation about money that I was inheriting, that I would have been using to fix the house further, as an excuse. However the work that he was contracted to perform was being funded by my mother whom had hoped to live out the rest of her life in the addition contractedThe kitchen was discussed but not signed during a discussion where again, my mother agreed to pay a certain amount for the kitchen and Mr C*** agreed, then came back months later with a larger amount. I told Mr C*** that I would be getting it done myselfMoney was not the issue - the fact that the amount jumped 50% was the issueI have since used my inherited money to put in windows - that Mr C*** could have done had he ever completed the first project he was contracted to perform Mr C*** stated to me that he was attempting the get another job to have the money to complete our jobIt appeared to me during that conversation that Mr C*** floats the money from one job to another and when he did not have additional work, he was unable to finance the rest of our projectI have paid Mr C*** for the majority of the work and only owe $Mr C*** has since added costs that have never been discussed or agreed upon. I just received an invoice with these additional costs todayAs for the $skylight, new plumbing and laundry tub that he installed at no charge. He did those jobs and I do not know that the "new plumbing" was not a part of the projectMr C*** did add new plumbing for the new addition and all those plumbing issues are all in the same area and connected as far as I can seeAs for the kitchen plumbing, I did ask to move the plumbing to be under the new window, but the plumbing again was already being changed because of the new construction in the new addition. Mr C*** never stated that where would be an additional charge to move it from one area to the otherAnd since he has emails I am sure if he did he should have something regarding these issues.If Mr C***s claims that money on my part was the issue, why has he not completed the project he was contracted to complete? For $he would hold up the project for months? Mr C*** does not have the money to complete the job and that is the reason the job is not completeAs you can see I paid Mr C*** $on 10/09/and another $on 11/29/14. Clearly money was not the issue on our partI just put in new windows thru out the homeI need other work done also, however I need a contractor that does the job promised when promisedMr C*** has not delivered and by the way he twisted the truth I would never recommend him. I am very disappointed in him - I thought of him as a friend.
