We were misled and lied to constantly and a poor quality of work and unqualified workers.
The job was completely replacing the railing on two decks. It included triple ribbon 2x6, 1x8 dress board, straight railings w/ ballasters and 38post w/caps. Simpson strong tie on every end of every joist.
Labor and material for temporary support walls during construction end paint to do the job and a permit.
total cost 44,88.
His work was untimely when he started and of poor quality when he did work. He had his two workers build the railings on unuven ground and not in a jig. When he put a couple of railing up they looked awful and poorly built.
He was paid $22,400.00 to start the job and another $5,00.00 for lumber to repair our boat dock.
He was sent one check for $2,500.00 which he said he did not get.
We had another check made out to give to him and then he called and said he just got the check buy we found out he just cashed the check that morning so he lied.He was given two checks totaling
$5,00.00. In total he was given $27.500.00.
We also found out he lied about the $2,400.00 for the permit we did not need a permit for this job.
He also lied about the wood for the boat dock it was not bought.

The board members voted to have him suspense work and we hired another builder to complete the job he took down the work done by Tolman and did an outstanding job.

To whom it may concern,

We signed a contract to install deck railings for the ***. We drew up plans and went over them several times to ensure we were all on the same page. We got the proper permits pulled and purchased the materials needed to complete the project.
There were problems from the beginning, though we did our best to address them. For example, it took them over a week to figure out where we could put our materials along with related trash. We reached an agreement but several people were still angry.
We worked for two weeks, under the deck, as it was largely raining during this period. Either way, the project was started with about 60 feet of railing installed along with pre-assembling a good deal of the railing as well. It was around this time that we were due (but not being provided) with additional labor costs.

We then received a letter from their lawyer demanding that we not return to the property. In our opinion, this was a clear breach of the contract as our company was abiding by the terms agreed to. I do not believe I did anything wrong, rather it felt that I could do nothing right from the moment we began this project.

***'s above statement is false. The Board of Trustees at *** signed a contract with *** in the Fall of 2018 to begin work in the Spring of 2019. He insisted on getting a 50% deposit in the Fall of 2018 in the amount of $22,400.00. The Board did not release the deposit until February of 2019. *** claimed he needed this deposit to buy materials and pull permits with the Town of ***. After speaking with the Building Department at the Town of ***, the Board quickly learned that he NEVER pulled any permits. The cost of the permits were listed in the contract. He also did not supply enough material to complete the job. He did not show up to complete the work for over a period of two (2) weeks. Rain was NOT the case. *** also was required to carry Worker's Compensation Insurance, which he failed to provide. The few days that work was being done, this work was being done by two of his workers who were not licensed carpenters. *** also agreed to repair all the rotted wood on the docks. He was given a deposit for this work, which he never completed. When the Board agreed to terminate the contract, *** stole the materials that did not belong to him. He sent harassing voicemails and text messages to the property manager. At that time, the Board asked their attorney to send a letter to *** advising him to stay off the property. *** failed to provide receipts for the materials,dumpster and the portable toilet he needed to the job. He completed 60 linear feet of deck railing out of the 244 linear feet that was required and he did this work incorrectly. He stole the balance of the funds due back to ***. The Board wishes to move forward with small claims court. The bottom line is *** stole money from *** Condominium Trust for work he did not complete and the public should be aware of this. The public should do their research with the State of MA before hiring him. Is he licensed and insured?

*** was also paid $2500.00 to buy lumber to do our dock. That lumber was never purchased.
If a job requires a permit it should be placed in plain sight before the start of a job. It never was and he charged us $2400.00 for a permit.

There for 4 attachments, one is the receipt from the Town of *** for the permit, the three others are all receipts for materials that were purchased for the job. The materials were left at the job site when my company left the job.

I going through my paperwork and checking into payroll for the two weeks we were on this job site. The two weeks we were on the job between the crew and myself payroll was paid out in the amount of $12,800. If you add that figure to the materials figure that only leaves $6351. With that being said we did nothing to be removed from this job site and we showed up every day. I feel like the customer is in breech of the contract they signed when the job quote. So I will be returning no funds. I have contacted an attorney already regarding this case.
