On 8/ [redacted] I went to check out an apartment At [redacted] ***, the brokers for Tom Crimmins Realty, who were showing the apartment were Paula West-M [redacted] and Donna Urkonis I was given the Mutt and Jeff treatment, and was shown around the apartment by Ms M [redacted] (the person I made contact with for the viewing) Everything seemed friendly and on the level I was handed the application and also a copy of my SS report which shows my earnings for every year since I found this to be strange, I chalk it up to being some sort of intimidation tactic I still filled out the application once with my information and a second time with my step son's information, along with our credit reports My credit was poor and his was no information I wrote a email detailing why these credit checks are inaccurate For the last years my taxes were filled out with my late wife's, and the credit card she had, we shared My step son has no credit card except for the buisness debit card he has for his business During our conversation (at the apartment), I informed Ms M [redacted] the house where I live was being sold and that my brother-in-law was handling it The next afternoon, I called to tell Ms M***, I was emailing my stepson's application info and credit history She informed me I wasn't getting the apartment I thought it was because of my pets, but she told me no it was because of the stories I told in the email 'What stories?" I asked The ones I wrote about how my stepson's income and taxes are tied up in with his business and saying that my brother-in-law was handling the selling of our house, which she insinuated was a lie I told her my wife passed away and that my brothlaw was the executor to her estate And then she had a good hearty laugh over this at my expense I understand my credit history is poor, but it isn't from debt Apart from my bank cards, I've never wanted any credit cards I don't like how they accumulate debt and penalties I understand the social prejudice that comes with my earning on the books history It is the blatant elitism which aimed at me by her laughing and making fun of me One has to assume that this is the Tom Crimmins Realty policy This and the last couple of over priced fire traps I've been shown over the past two weeks sheds light on how creepy brokers can be when it comes to apartment shopping I'll be that there were a couple of thing in the apartment which Ms M [redacted] showed me that weren't up to code For one thing the outside stairs were a little to rickety and slightly rotted Albeit, yes I'm a some what ticked off at not getting the apartment and not being fairly treated but to make fund of me because my wife passed away, that's just down right rotten and nasty I am sure these windbags will have some great excuses about how the handled me Goody goody for them

We will release [redacted]'s short sale listing immediately. For the record we took the listing and gave very good advice to the seller that she should consult a seasoned short sale attorney. We marketed the home as promised very aggressively on the internet in search of a qualified buyer. Almost...

immediately we began to get contacted by a BPO appraiser and another actual licensed appraiser named [redacted] from PHH Mortgage to get in the property. The BPO gained access. This only happens from our experience when there is a buyer in place which was not the case unless the seller was not informing us of one prior to our involvement. We made numerous attempts to contact the seller via phone, text and in person to get a full story. The appraiser was requesting paperwork from us that we did not have basically due to the fact there was no buyer or paperwork supplied by the seller. The paperwork being requested was anti fraud, arm's length a greement,transaction history, purchase contract ect. All forms to support a buyer and purchase offer but there was no buyer to our knowledge. The seller either told the courts there was a buyer when in fact there was not or had her own buyer we were not aware of. Apparently she was using our listing arrangement as a ploy to cease the foreclosure process. From the start the seller was not honest with us and passed on only part of the pertinent information needed. My advice to my agents was to not divulge any personal seller information ( with the seller's interest and confidentiality in mind) to anyone until we had a clear true and honest understanding of what was really going on. But once again she avoided our calls. Because of her lack of cooperation we put the listing on "hold" status so we can regroup with the seller and get an honest answer. We have a record of all the phone and text attempts as well as the listing paperwork throughout the process should they be required to keep our professional reputation intact. On another note we do many short sales in our office and without a doubt this one was well outside the normal process which is why we were very cautious. Review: When I went to court with [redacted] they agreed to allow me to do a short sale instead of foreclosing on my home as long as I cooperate. I was instructed to find a realty and I signed a listing agreement with Tom Crimmins Realty. Shortly after my court date with [redacted] the bank called me to inform me that Tom Crimmins Realty has not submitted paperwork that they required for the short sale of my home. Agents [redacted] and [redacted] made numerous phone calls to me stating that they cannot release any paperwork to [redacted] bank until I hired their lawyer for $500. [redacted] bank stated they had all the paperwork required of me and I do not need to pay for a lawyer for the realty to do their paperwork. I repeatedly stated to the real estate agents I was not interested in hiring a lawyer for them. On November **, 2014 the real estate agents both called me to tell me [redacted] was sending an appraiser to look at my house the following day. On November **, 2014 agent [redacted] arrived at my home with a man who only took photos of the property very quickly.On December **, 2014 I spoke to [redacted] and she informed me my file was closed on my short sale because the realty never sent the paperwork required from them for a short sale on my home. I stated that I do not want to go into foreclosure and that it was not my fault the realty was not cooperating. [redacted] advised me to seek another real estate agency so that I won't go into foreclosure and she also told me [redacted] never sent an appraiser to my home therefore I don't know who was the strange man the agent brought inside my house. Tom Crimmins will not send [redacted] the paperwork they need from them and I cannot hire another realty because I have a listing agreement with Tom Crimmins Realty.Desired Settlement: I am requesting help to have me released from my listing agreement with Tom Crimmins Realty or have them send the paperwork required for me short sale.
