In response to [redacted] complaint, I am going to fill in the blanks.  The [redacted] moved into the area from California when thy bought this house online.
After they moved they find some serious problems with moisture coming in the house around a window...

and kitchen ceiling.  The reason for the new wall around the
window in question was DRY ROT and TERMITS.  When we opened up the rot, the termites came from that area by the hundreds.  [redacted] had gotten some spray and had her
husband [redacted] spray at them as they came out of the wall.  We framed, insulated and drywalled this dormer area that is about 5 x 8’ .  we took out the old window
glazing an reinstalled the old unit.  The old window was not broken at this time, the unit broke when I watched [redacted] put his finger on the corner of the window, that
was when it cracked.  The drywall had 1 coat of mud and tape on, the rest of the house is lath and plaster, so it needs 2 more coats and a skim coat of plaster yet to be done.
As for the outside of the window, the weather was raining and chilly that day not real good for painting.  As far as clean up goes the homeowner is responsible for this, unless
they tell me different.  At the end of this day I was told to give her an invoice, which I did in 2 days.  [redacted] was happy that we dropped what we were doing on other jobs and
that we put her repairs ahead of other and paid me.  The issue with the gutters puzzles me in the regard that [redacted] had somebody power was the wood shake roof, this person
never came back.  This is when she called to clean the gutters, Nick spent more time than Justin did for the gutters which were full of some kind of nasty sledge material.  The
caulk gun was not ours and the crew left it in place, as I wanted, not ours, don’t touch it because somebody will come to get it, whom  ever it belongs to.  [redacted] complains about
clogged gutters, she fails to tell you that this is 5 weeks after we left!  I guess I am supposed to be responsible for the fall time leaves that fell into the gutter over a month latter.
I do not agree, as far as the pressure washer that did not work and the fact that the 2 x 4 area that the other guy left and never came back to finish was probably because he
didn’t want to fall off the roof that is steep. There is no garden hose that can do the pressure washer job.  Justin was not comfortable with being in that section of roofing.
 
As far as the billing went,  it was for 2 different invoices, the invoice listed the time that was used and the material that was used.  What material that was left was scraps that
we hauled to the dump.  I never even charged for any dump fees or even for the trash compactor that I took to the metal recycle for her.  [redacted] did call me 5 weeks after we were
there to complain and wanted a refund for the window unit (under $400.00)  I wanted to talk to Justin about this issue, but he is gone hunting and is unreachable at this time.
this is what [redacted] wanted at the time, I asked about coming over to do the outside of the window that she was mad about, she said it was already done.  [redacted] told me that she hired
somebody that did the repair for $22/hour. So she hired a unlicensed,  unbonded   guy that works out of his truck.  How does she come up with charging me $50/hour for these repairs,
Which would take 2 hours on a good day.
 
As far as the settlement goes here is how I feel.
1)      Gutters and roof bill she wants $300.00 she gets nothing, I am not agreeing to pay anything for the leaves falling in autumn and filling her gutters
She states that she would of fired us then.  Why did she pay the first invoice and call us the second time for the window rot.
 
2)      She wants $1400.00 for the claim about the rot and window issue.  Why would I  pay more for the window  than she was charged from Aro Glass, I
have the receipt for $236.74 plus tax for the glazing  .  The $900.00 for tearing out and replacing the other work, I see no refund for the $900.00 as she only paid somebody $22/hr to
fix what? I really don’t know if that was needed in the first place. Now if [redacted] keeps hiring unlicensed/unbonded workers, I hope for her sake that
no one falls off of her roof.
 
3)      [redacted] states in the settlement , “I would have fired them if I had watched them the whole time.”  Why the claim for the hours spent at the time before
She paid me. Why did she call to have me come back again for the 2nd story dormer repair? I talked to Nick and he said she was there the whole time. She would ask questions and go
to the internet to see if the way the we did the repairs correctly since [redacted] doesn’t have a clue. There were no complaints at the time of repairs, I invoiced her, she was happy and paid me.
I don’t know any contractor charging less than $ 50.00 per hour.

Complaint: [redacted]I am rejecting this response because:
First, I would like to point out that Tom M[redacted] response misconstrues the events, their time-frame, what actually happened, and adds speculation, without any proof, of what I did/did not do or know, and has little to no truth in his response.
We did not buy this house online. We came to Aberdeen, toured the house twice, with our realtor and our inspector. At the time of the inspection there was no sign of water damage or intrusion. After we returned to CA to sell our house I found that I was going to have stay in CA for 3 major surgeries. We returned as soon as I could be at least partially ambulatory, approximately 16 months later. We had had local people caring for the yard and they inspected the house for us once to check for leaks, and they said everything was okay.
We were dismayed and distraught to arrive and find major damage on September 1, 2016. As we knew no contractors in the area, we took our next door neighbor's recommendation for a contractor to pour concrete paths with drains on both sides of the house. He did a great job and his worked stopped the water intrusion to the basement. He referred us to Tom M[redacted] for interior repairs, but also said we should consult the yellow pages. All the people I called from the online Yellow Pages were not available, as they were booked for up to 2 months.
The first job I asked of Tom was 1.) to clean the gutter & drainage so no water would be falling out of the gutters and back against the house, and 2.) to power was two areas of the roof (that were the closest to the ground) that had not been done by the person who had power washed the rest of the roof. He and Nick arrived at about 8:40 a.m. and I was told Nick would do the gutters and that Justin would come later with the power washer and do the roof as Nick did not want to get on the roof. Justin did not show up until much later in the day, approx. 12:30p.m. He assured me he would take care of the roof. We left the premises briefly (for about an hour) and when we returned we found Justin on the roof using our neighbor's garden house with a compressor nozzle on it.  He said that their pressure washer, that he had brought over, did not work, but tried to convince me that the garden hose was sufficient. I went in the house and consulted with my husband and we agreed that I should tell them to stop and leave. This I did. That was about 2:30 p.m. So, Nick was there about 6 hours and Justin about 2 hours. That's 8 hours total with the requested cleaning of the roof totally not done. But Tom charged us more than 10 hours and when I challenged the charge he said, "I just check their time cards". NIck's work was incomplete in that the drains did not drain, which we didn't realize until after/during the next big rain a could of weeks later. The very competent fellow we hired to redo Nick's work did charge us only $22 an hour, but he did a thorough job and cleaned all the downspouts and found some of the gutters had not been cleaned at all. There were not just a few leaves and bits of debris in those gutters. Rather there were handfuls of goop he took out. My husband [redacted] worked with him for 4 hours just redoing all of Nick's "work". This fellow also brought a real power washer that worked and washed the roof areas Justin failed to do AND he also did the breezeway roof and glass, and the garage roof, doors, and the concrete leading to the garage. I am not asking for reimbursement for what I paid him. I am asking for a refund for work that was not done by Nick and Justin. The hours were falsely tallied and the work was incompetent. It took me a long time to find someone, that I felt I could trust, to come out and fix this mess. We did know how bad a job Nick had done until we got someone else up on a ladder to look at it. My husband and I are both elderly and my surgeries were all on my knees, so ladder work is out.
As for the window job, the only reason I called Tom M[redacted] back is that I could not find anyone else and I had already started tearing out the wall myself to try and see how bad the problem was. What I found was black mold that went around the window. I sprayed with concorbium to kill the mold as I opened the wall. He brought Justin and Nick back again. I had actually expected he would bring someone named John, because I had complained to Tom about Nick and Justin after the first job and he mentioned maybe John could come. I was dismayed, but also felt like we needed to get on with the work. They tore out the walls to the lateral corners and to the floor under the window, put in some new wood under the window, sistered in studs. I did not see them put in insulation. What I did see when they left was that the drywall Justin has put in was the drywall was about 3/8" high from the surface of the walls, that the mud was put on very sloppily, that nails weren't even covered, and that the area under the window had air blowing through it. My understanding of the term glazing is that it refers to the installation of glass between the wood tines that hold the glass. No glazing, as such, was done by Justin. What I did notice was the shims he put under the glass were improperly placed, very loose at the middle and right side(they could easily be taken out without any pressure) and so tight on the left side that it couldn't be budged. When Perry and Rick from Aro Glass came to put in the new window, Perry told me that no seal had been put on the window, the sill and framing were done incorrectly and verified my assessment of Justin's reinstall as the reason the glass cracked. The window was torqued and improperly installed. When I told Tom that, he said "That could be true". When I originally spoke to Tom about the refund I had not gotten the final bill from Aro. The final total was $596 because of the extra work that was necessary to fix Justin's poor workmanship and help frame the window properly. There was also about 16 hours of work necessary to 1.) repair Nick's terrible job on the exterior sill (sanding off his crappy caulking job, recaulking, and priming while the window was out, 2.) fixing Justin's framing, redoing the interior sill, sanding, caulking, priming, etc., 3) fixing Justin's horrible drywalling of the walls (sanding down as much of the extraneous mud as possible then filling and feathering new mud to try to make it level, then priming, etc.). When I asked Tom for the receipts for the "materials he boought" he said he couldn't find them. He has no proof of the charges he made to me for materials. The time he charged me for the Nick and Justin debacle is just adding insult to injury, seeing how much time had to go into fixing it all.
I have never had to ask another contractor to clean up after himself. I heard Tom tell NIck and Justin to put up a plastic sheet screen to protect the rest of the bedroom, which they never did. Tom also did not check their work, but asked only for a report of what was done and then they left.
I have always gotten receipts for materials with the invoice from the contractors I have worked with in the past. The fact that Tom "lost them" or "doesn't know where they are" should be taken as lack of proof for his charges and I want a full refund for all those materials. I also heard Nick and Justin discussing Nick taking home materials to use on his apartment. I should not be paying for that.
I was never happy about the performance of Tom's crew. But the extent of their incompetence was not evident until after they were long gone, when we got a big heavy rain weeks later and the professionals at Aro Glass detailed the degree of fault in Justin and Nick's work when the new window was installed. I couldn't see the exterior sill until the window was out. Luckily there was time to repair the exterior sill between removal of the broken window and the installation of the new window.
Tom M[redacted] has not acted honorably or given an accurate account of the events. The simple math of refunding me for damages seems to elude him. In both cases, the work was not done as asked causing us to have to hire others to make good what M[redacted] crew either failed to do OR did incompetently.
$596 for the Aro invoice; $250 dollars for the botched gutter/roof job; and $800 for all the time and materials for the clean up of the walls around the window come to $1646. That is not the total I paid him, so he is still ahead, if you can call cheating your customers and doing a rotten job being ahead.
