In response to the complaint by Mr*** , he did express interest in our Pre-Owned vehicle, but he was unable to give a 100% commitment to purchase the vehicle, as his spouse first had to
test drive a similar vehicle (she was out of state at the time) to make sure that this would be a vehicle she would be comfortable drivingThis occurred on Saturday, February 28thOn Monday, March 2nd, Mr*** did contact us stating that his wife had approved of the purchase and he wanted to come in to complete the transactionIn the mean time, another customer had given us a 100% commitment to purchase the vehicle and was in transit to pick up the vehicleWe did inform Mr*** that another customer had given us this commitment, and that the vehicle was soldWe also informed Mr*** at that time that we do not take deposits on vehicles unless we have a 100% commitment to purchase, as Pre-Owned Vehicles are all unique, and that no two are the same and cannot be replicatedCompany policies are in place, so that vehicles are not reserved, with deposits, "subject to" specific conditionsOur salesperson was specifically instructed not to receipt any deposit from Mr*** until his wife approved of the purchaseAgain, at the time Mr*** contacted us with an approval to purchase, we had already had a commitment from the other customerWe never receipted any down payment of funds from Mr*** , nor did we have any kind of a written agreement, in regards to this transaction

The discussion about having my lady friend drive the car down in *** was just a part of the general information during the discussion about the carA deal was negotiated and my subsequent call verified the agreed transaction and no mention was made that the deal hinged on my lady friend having to drive a similar vehicle because she already had earlier that day and I knew that I wanted to buy the vehicleThe deposit was, in fact, taken and the deal was to be finalized on Monday morning in cashThe salesman did not raise any questions and did not tell me he was not going to process my credit cardIf he did not intend to accept the deposit, affirming the sale, why did he ask for a credit card to hold the dealMr *** admits the information was given to him and he decided that I was not sure that I wanted the carI certainly would not have authorirzed a $1,deposit if I did not intend to purchase the vehicleIf this was not a consummated purchase, Mr*** should have stated the fact

As was stated in our original response, we did not process a deposit on the vehicle, nor had any written & signed commitment because at the time Mr*** gave the credit card information to the salesperson, he still was not 100% committed to purchasing the vehicle.Unbeknownst to the salesperson, we did take a deposit from another customer, who had made a 100% commitment, and as such, took delivery of the vehicleWe would be willing to assist Mr*** in the purchase of any vehicle we have in our inventoryAs previously stated, all Pre-Owned vehicles are unique, and cannot be replicated

We have agreed to replace his bumper as a goodwill gesture. Although customer never requested to have the front plate bracket, not installed, prior to delivery. As an Illinois dealer, [redacted] Company
supplies us with front license plate brackets to install on every new vehicle, as the [redacted]...

[redacted] requires front and rear license plates.
