I received your notification of complaint # [redacted] yesterday 1/10/ Thank you for the opportunity to refute the claim from an unsatisfied customer Tomah Lumber has been in the construction industry since Despite our best efforts to leave every customer satisfied, this customer’s expectations were not something that we could meet We are a residential home builder in Tomah, WI We were hired by this customer in to construct a new home In constructing his new home, we subcontracted portions of the project to qualified contractors who are experts in their own fields (electricians, plumbers, HVAC professionals, concrete contractors, etc.) This is a very common practice We contracted with a local concrete contractor who has been in business since to pour the concrete driveway During the fall of 2016, the customer contacted us with regards to a crack that had formed in his concrete driveway He asked that we replace the portion of his driveway around the crack It was explained to the customer that concrete often cracks Furthermore, neither Tomah Lumber nor anyone else could guarantee that his driveway would remain without a crack after almost years He left unsatisfied He then pursued legal action to force Tomah Lumber to replace a portion of his driveway He claimed that the driveway was not poured thick enough Our day in court was 11/22/and the case was dismissed Attached is a letter signed by the City of Tomah Building Inspector with regards to the lack of restrictions when discussing concrete flatwork The inspector also attached a discussion describing this exact complaint and is authored by a professional engineer from Minnesota At no time does Tomah Lumber’s warranty imply a guarantee for the exterior concrete flatwork beyond the first year of occupancy Residing in our climate with the freeze and thaw process means that concrete is going to crack We try to control where the concrete cracks by providing control joints, but cracks don’t always follow the control joints The customer has resided in the home since the occupancy permit was provided by the City of Tomah Building Inspector on 11/1/ Having even one dissatisfied customer is unfortunate However, we cannot meet the expectations of a customer who asks us to replace his driveway ten years after it was poured I appreciate the Revdex.com attempting to moderate the situation Unfortunately, I do not see a resulting satisfied customer Travis [redacted] Tomah Lumber IncNSuperior AvenueTomah, WI [redacted]
