Response to Complaint ***: In responce to *** ***’s complaint, we acknowledge that there was an error madeHowever it involves a number of people and should be resolved by more than just our officeFirst of all Mr*** had a friend represent him on this propertyMr
*** never personally inspected it until after the closing and in fact after he had work done on the propertyAll of this we presume was done by his personal representative with a power of attorneyAt closing the title report should have been looked at by the buyer and compared to the property purchasedThis would have been the first opportunity to discover the problem before closingThe closing date was very short and my agent Ron Mendenhal did not get to review this paperworkThere was work done by a contractor named Jason C*** on the property that Mr*** thought he had bought for about $8,It was for grading and a driveway encroachment.The contractor did not get the appropriate permit which would have shown that the lot he did the work on was the wrong lotThis would have been another opportunity to have knowledge that the work was done on the wrong lotThe neighboring lot was improved by this work but because there were some trees cut the owner believed he was harmed by the value of the treesAfter reviewing the pictures of the downed trees I would disagree with thisI talked to him and as far as I can tell he is not pursuing either the contractor or Mr*** because he also realizes that Mr*** enhanced the value of his lot by installing a drivewayAll of the communications I have had with Mr*** were after the first week in July and I went on Vacation on a Rafting trip that took me out of all cell or e-mail service through mid JulyWhen I returned I asked Mr*** how he wanted to remedy the situation and it was not made clear to me what he actually wantedAfter our second or third conversation he sent me the bill for the work so that I could have a conversation with the contractor and the owner next door but the contractor has yet to return my callThis complaint is the first written request for a financial solutionThe neighbor next door was vague in his feeling about the lot damages but said he would sell the lot to Mr***Mr*** was interested but not at the neighbors asking priceAs far as it taking a long time for me to return calls, as you can see there is more to the story that I needed to explore before I could negotiate a settlementI have been doing this while waiting for other parties to return calls that I am sure were not high on there priority listI have had communication with Mr*** and offered to buy the lot back from him as a method to resolve this issue as the commission earned on this transaction was 10% of the damage claimed and I believe we can resell the lot he bought and pay him for his out of pocket expensesMr*** has indicated that he wants to keep the lot so my offer does not solve his issueHe wants us to pay for the driveway work on his property as far as I can tellI believe that there were three parties that made errors on this transaction including Mr***, both personally and by way of his personal representative, MrC*** ( the contractor), and MrM*** (our agent)Mr*** and I have been in communication by phone since this complaint was made and as he seems very reasonableI believe we can resolve this issueJeff B*** Chief Operating Officer T & B IncTomlinson Sotheby’s International Realty (direct line) www.tssir.com
