Tom's A+ Tree Service

Contracted ***'s Tree Service on 4/13/19 to remove 3 trees from my backyard. Was quoted over the phone a price of $400 to remove the 3 trees. I mentioned during the call that at some point we may consider also removing the trees from the front yard, but that it would require HOA approval and we were not interested in doing it at this time. *** (owner) agreed and confirmed someone would be coming to remove the 3 trees on 4/16/19 at a time during which nobody would be home to oversee the project, which I agreed to. On 4/16, *** called me while I was at work and let me know they started the job, but asked if I wanted to "make a deal" on cutting down a tree in my common area since they were already were there. I said he could ask my neighbor with whom we share the common area with if he was interested, but again it would require HOA approval and wasn't something we could do that day nor had the intent to do. He hung up and said he would ask my neighbor. After 10 minutes he called back and said my neighbor also said it was HOA property and was not interested. He then admitted that one of his employees accidentally cut down most of a very large bird of paradise tree before he got to my house and stopped him. I told him it was unacceptable that he lied to me and that I wanted him to make good on removing the rest of the tree at no charge. He pushed to charge me a discounted fee to remove it, but I declined as I never agreed to have him remove the tree and would like it removed at no charge. *** agreed to remove the tree free of charge, but did not give a date in which he would return. I paid $400 for the trees that were correctly removed in my back yard via check that was cashed on 4/17. I have since followed up with the business on 4/25, 4/30, 5/9, 5/31, 6/6, 6/24, 8/7, and 8/15. On 8/15 *** called me back, but after realizing who I am when I provided my name and address, said he would "get back to me" and hung up. I called again 8/17 and 8/20 with no call back.
