Contract states half payment up front and rest due at completion. We are paid in full since 11 Aug but work still not complete and getting run around.On 19 July we received a contract proposal for a covered back porch with ceiling fan to be installed and flood lights to be installed on it. we also were getting a deck on the right side of the porch. The quote for this was $8k. A material deposit of $4K was given up front with a balance of $4K due at completion. The quote was from Tony Hughes Construction. We paid $4K in form of a check which was cashed on 23 July 2014. work was due to start on 28 July but did not start until 30 July. We were due to go out of town on vacation and on 1 Aug [redacted] (a partner in the company) asked my husband for a check in the amount of $3K dollars in order to pay the workers who had been working on the deck and the porch. My husband wrote the check and it was cashed on 4 Aug 2014. We were out of town the week of 4 Aug, but my college age son was at home. On our way out of town we received a call from Tony asking us if we had left a check for $1k as he needed this in order to buy the fan and lights. At this time the back porch was completely finished as was the deck except for the ceiling fan and the lights. The original light that was on the house when we bought it was hanging off the back wall and a long piece of electrical wire was hanging out of the wall above it. The ceiling has a piece of electrical wire hanging from it as does the front of the porch. I am assuming these are all live as I can turn my light switch on and the original light still turns on and off. When we returned from vacation we contacted Tony to give him the remaining $1k check so he could buy the lights and fan. The check was written on 11 Aug and was cashed on 13 Aug. Tony's wife came and picked up the check as Tony had hurt his back. On 31 Aug we still had not heard from Tony in regards to getting the ceiling fan/ lights fitted and all messages my husband has sent to Tony were not answered. I sent Tony a text on 31 Aug and he responded via text that 'he would get to it this saturday'. On 6 Sept I again contacted Tony via text asking when he was coming over to complete the job. I wanted to try and plan the weekend and if he needed access to the breaker box then someone needed to be home. I did not get a response. I contacted again on the 7th and I explained in my text that it had been a month since he had been paid in full, He responded in his text on the 7th that he had had car trouble since we had paid him and had spent $750 on his wife's car on repairs and then another $500, and then had to take his truck to the shop which has cost $4200.00 so has not got the money to buy the fan and lights but he is due to get a deposit from another job Tuesday or Wednesday this week so he should be able to get the fan and light, he isn't going to forget us. On 13 Sept I sent him a text to see if he would be over and did not get a response, on the 14th I sent another text to him asking when he would be over with a response of 'she gets paid tomorrow and I get paid Friday so next weekend for sure.' On the 20th I sent a text as I was trying to plan the weekend again and I was told that they had more car trouble and it took all their money, they are trying to borrow money from his brother but he is out of town so he is not sure when he will finish the job, but he promises he will get it done. I responded with a text that he was running a bad business. I offered to go buy the fan and light and he can just pay me back for the fan and light and then give me back whatever it was he was allotting to pay for these items but he has not responded to this message. I am concerned that if these wires are live and my children are playing on the back porch and touch them that they could be hurt.Desired SettlementI would like the job completed.I would like a ceiling fan and flood lights installed on my back porch and the job finished. I want to enjoy my back porch without knowing there is a potential safety hazard for me and my family.
