MY NAME IS [redacted], I GO BY TONY, BECAUSE OF MY MIDDLE NAME. I AM RESPONDING TO AN EMAIL I RECIEVED FROM YOUR OFFICE, COMPLAINT # [redacted] THE CUSTOMER  , [redacted] HAD BEEN CALLING ME OFF AND ON TO DO A CONCRETE PROJECT AT HIS HOME. I VISITED HIM 2-3 TIMES BEFORE HE HIRED ME. EACH...

TIME I WENT, HE WOULD CHANGE HIS MIND ON WHAT HE WANTED OR HIS WIFE WAS NOT THERE TO GIVE HER INPUT AND WHEN HIS WIFE WAS THERE, SHE WANTED SOMETHING ELSE. FINALLY, THEY AGREED ON WHAT THEY WANTED.AS I BEGAN TO MEASURE, IT WAS VERY HOT AND I THINK THEY WERE GOING OUT, SO I FELT A BIT RUSHED. [redacted] HAD TOLD ME THAT HE HAD ALREADY MEASURED THE DRIVEWAY HE WANTED AND THAT THE SQUARE FOOTAGE WAS 1180. I SHOULD HAVE MEASURED IT RIGHT THERE AND THEN, BUT I DIDNT. I ASSUMED HE WAS RIGHT & AGAIN I FELT RUSHED., CAUSE THEY WERE GOING OUT AND HE SAID TO JUST TO MEASURE THE PATIOS, WELL I DID.THEY WANTED AN ESTIMATE AND I GAVE THEM AN ESTIMATE. IT WAS A DRIVEWAY AND 2 PATIOS THE FIRST DAY WE WORKED , AS THE CREW BEGAN FORMING, I TOLD [redacted], I WAS HEADING TO SPRING BRANCH TX TO PICK UP A RENTED BOBCAT /TRACTOR TO USE ON HIS PROPERTY TO LEVEL THE AREA OFF. WE HAD ALSO AGREED THAT HE WAS TO GIVE ME A DEPOSIT OF $3000 , WHICH HE DID. THIS WAS TO BE USED FOR LABOR, FUEL, THE RENTAL , MATERIALS, ETC. THE RENTAL WAS FOR ONE DAY ONLY, HE KNEW THIS ,CAUSE I TOLD HIM THIS. WELL I CAME BACK A FEW HOURS LATER AND STARTED WORKING WITH THE CREW. [redacted] AND HIS WIFE  WOULD COME OUT, MAKE CHANGES, ETC PERIODICALLY DURING THE DAY.BEFORE WE LEFT THE FIRST DAY, I EXPLAINED TO [redacted], THAT WE WERE DONE WITH THE TRACTOR AND THAT I WAS GOING TO LEAVE IT OVERNIGHT, SO I DIDNT HAVE TO TAKE IT HOME, WHICH WAS THE OPPOSITE WAY.OF WHERE I WAS GOING TO TAKE IT THE NEXT DAY,,,,AND THAT  I WAS GOING TO PICK IT UP THE NEXT MORNING, CAUSE I NEEDED TO RETURN IT BEFORE 10 AM OR BE CHARGED ANOTHER DAY. ONE OF MY CREW MEMBERS AND I WENT EARLY IN THE MORNING, THE FOLLOWING DAY, TO PICK UP AND RETURN THE TRACTOR. WHEN WE ARRIVED, I REALIZED THE GATE WAS LOCKED. SO I TEXTED [redacted],HE DIDNT RESPOND. I CALLED HIM AND WE KNOCKED ON THE DOOR AND AGAIN NO ANSWER. SO WE HAD NO CHOICE BUT TO LEAVE. AS SOON AS I GOT HOME, HE RESPONDED WITH A TEXT " IM HOME". BY THEN IT WAS TO LATE,,,,,ANOTHER DAYS RENTAL WAS ADDED TO MY BILL $213.00. THE NEXT DAY THE CREW CONTINUED TO GET READY AND I WENT TO RETURN THE TRACTOR.BEFORE I ARRIVED TO TAKE THE TRACTOR AWAY, [redacted] HAD MY EMPLOYEE REMOVE 40-50 ROCKS, STONE & BOULDERS WITH THE TRACTOR AND PLACE THEM OUTSIDE HIS BACK YARD,,,,THIS WAS NOT IN OUR CONTRACT. ( THIS BRINGS AN ADDITIONAL CHARGE $450.00) THE DAY WE WERE SET TO POUR,[redacted] WAS STILL MAKING LAST MINUTE CHANGES, WHICH COST TIME, MONEY AND MORE MATERIALS. ALL THIS TIME MY SON AND CREW MEMBERS WERE TELLING ME, WE THINKS THE AREA IS ALOT MORE THAN WE HAD DISCUSSED.PLUS WITH ALL THE CHANGES THEY MADE, ETC, MAKE A DIFFERENCE AT THE END. [redacted] PAID THE CONCRETE PLANT ABOUT $3000 OR SO FOR THE CONCRETE, WHICH WAS PART OF THE TOTAL WE HAD AGREED ON. THEN ON THE DAY OF THE POUR HE PAID ME THE BALANCE, WHICH WAS $3000-$3500,,,AND ASKED FOR A RECIEPT. I HAD A CONTRACT ALREADY WRITTEN OUT FOR HIM, BUT I WAS GOING TO RE-DO IT, TO SHOW THE EXTRA TRACTOR RENTAL AND AD ABOUT 500 MORE SQ. FT TO THE JOB AT $3.00 X SQ FT, IT WOULD AD ANOTHER $1500.00 FOR THAT, TOTALING $ 2,163.00 WELL HE GOT THE ORIGINAL CONTRACT SOMEHOW , WHICH HAS ALL 3 COPIES AND REFUSES TO GIVE IT BACK, WONT ACCEPT THE NEW ONE AND WONT AKNOWLEDGE THE EXTRA SQ FOOTAGE. I ASKED HIM SEVERAL TIMES TO MEASURE IT WITH ME. IFI WAS WRONG, NO PROBLEM, BUT IF I WAS RIGHT, HE NEEDED TO PAY THE EXTRA FEES.I TOLD HIM THAT IF HE HAD ANY ISSUES, WE COULD TAKE CARE OF THEM, BUT I NEEDED HIS NEW BILL TO BE PAID IN FULL. I HAVE ALL THE TEXTS, HE SENT ME AND THAT I SENT HIM, I CAN GO BY YOUR OFFICE AND SHOW YOU.HE WONT LET ME ON HIS PROPERTY. I DONT EVEN HAVE TO GO, I COULD SEND SOMEONE ON MY BEHALF.    AS FAR AS ANY STEPS HE WANT INSTALLED OR A CURB THAT HE WANTS , WE CAN DISCUSS THAT AND IM SURE I CAN TAKE CARE OF THAT, AT NO CHARGE. NOW BECAUSE HIS DRIVEWAY HAS SUCH A DRASTIC DROP (15-20) WATER WILL TEND TO RUN VERY FAST DOWN THE DRIVEWAY. WE PITCHED IT IN DIFFERENT AREAS SO THE WATER WOULD RUN OFF TO EITHER SIDE, BUT SOME WATER WILL STILL RUN AND STAY ON THE SIDEWALK AND POSSIBLY GO INTO THE GARAGE. I WOULD NEED TO CUT INTO THE CONCRETE AND PLACE A DRAIN TO CATCH THE WATER AND HAVE IT DRAIN TO THE RIGHT AND  INTO THE OUTSIDE OF HIS YARD. AGAIN THAT COSTS MONEY, HE WAS OUT THERE AND SAW EVERYTHING AND GAVE THE OK TO POUR. I POUR CONCRETE, IAM NOT AN ENGINEER. BUT IAM WILLING TO FIX THE SITUATION . BUT,,,,,,,I NEED THE NEW CONTRACT PAID IN FULL.   I HONESTLY BELIEVE THIS IS FAIR.   I NEVER THREATENED HIM IN ANY WAY, IM NOT CRAZY. I DID TELL HIM THAT I WAS GOING TO LOOK INTO PLACING A LIEN ON HIS HOME IF HE DIDNT PAY ME THE BALANCE.   THIS PERSON LOOKED INTO MY CREDIT REPORTS.
