I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution would be satisfactory to me. This has been resolved. Valley Nissan went over and above to resolve the issue

I have reviewed the response offer made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below. I am not satisfied because business isn't addressing the issue of the BAIT AND SWITCH. How do you sell the same car two times in two days. As I said before I have a text message from their internet sales person ***, he LIED about the car being sold and another salesman LIED to my daughter saying the car was sold two days earlier. What is the business going to do about the fact they are running a SCAM!!!!!

In response to complaint ***, our Service Director spoke to the customer on August 17, The customer stated his wife made the complaint and he did not want her toCustomer stated he took the vehicle to another shop and they said a leak was not present The customer is to bring

I just wanted to follow up and give you a breakdown of what happened here at Valley Nissan with the Nissan Maxima, owned by *** ***. Mr*** was not our customer, the car was brought to us by a local body shop after it had been in an accidentThe car had been partially fixed at
the body shop and was brought to us to have some malfunction lights diagnosedThe technician contacted Nissan Technical Assistance and was advised to replace electrical harnesses that run through the vehicleWe ordered the parts, but they were backordered and took about a month to come in. Once we received the parts we started working on the car, but it is a huge job that required the entire interior to be removedOf course, this was all in the midst of trying to repair and take care of our regularly scheduled customers as wellOnce completed, we took the car back to the body shop for them to continue workThey then brought it back for us to repair a couple of lingering issues that took a few more days to resolve. We stayed in contact with the body shop that brought the car to us, since they were our customerThe repair order was written up in the name of the body shop, not the owner of the vehicle. The owner came into Valley Nissan upset that it took so long when finished and out of courtesy I offered him $in service creditI also got Nissan to offer an extended warranty at no chargeHe refused and said he wanted us to pay half of his $deductibleWhen I didn't agree to that he started threatening legal action, so I stopped communicating with him at that point. My understanding is that this was all caused by an accident in which the owner hit a deer with his vehicleThat is very unfortunate, but that was not the fault of us here at Valley Nissan, and we also have no control over the time it takes to receive back ordered parts. I wanted to follow up and give a response to Mr***s responseFirst of all ,I am the owner of the vehicleThe PARTS Valley Nissan replaced have a warranty, which makes ME the costumerNEVER and I do mean never did Mr***s ever offer me an extended warranty from NissanThat is a total lieHe did offer me the $maintenance voucher which as I said in the complaint I have FREE MAINTENANCE on the vehicle for as long as I own it, so yes I said that wasn't good enough As far as me threatening with legal action, when Mr*** offered the voucher ,and when I didn't think that was good enough, he promised me he would see what he could do and would call back THAT day with an answerHe never said he COULD do more but, he said he would tryI called for days after that conversation, leaving voicemails, messages ectI then left a message and said if he couldn't respond to me , I would talk to a lawyer. As I stated before ,my insurance adjuster *** *** told me he has confirmation when Nissan got the partsThey took their sweet time fixing the carBusy , on back order , whatever excuse Valley wants to useI think their costumer service is horrible I know how long it took *** *** to fix what they needed too (not long) and I also have the documents on how long it took Nissan to do what they did(way too long)Mr*** to this day or anyone else there for that matter at Valley Nissan has not returned any phone calls. In closing I unfortunately have to deal with them once again, my car has many electrical things wrong with it , that Valley Nissan has left unrepaired .*** has graciously excepted the chore of taking the car to Valley Nissan, because I simply can't deal with the unprofessional attitudes of the service department any longer.Thank You*** ***

Our stance is this claim is a case of buyer’s remorse, which is a sense of regret after having made a purchase of an expensive item such as a car or house.  As the complainant states, “A couple months down the road my fiancé accepted a job that required him to have a 4 door vehicle....

 Sadly, we decided at this point in our life we would have to trade-in the Corvette for another vehicle.”   The contract which is signed by the complainant and the co-buyer clearly shows the cash price, total down payment (trade-in, gross trade-in allowance, less pay off made by seller, equals net trade in – cash & other), unpaid balance of cash price, official fees paid to government agencies,government license and/or registration fees, government certificate of title fees,other charges (seller must identify who is paid and describe purpose), total other charges and amounts paid to others on your behalf, and the amount financed.  Unfortunately, it appears the complainant does not understand loan structure and simple finance charges.As per your letter stating our response will be publicly posted on the Revdex.com website, I have not included any information that personally identifies the customer(s).  Please feel free to contact me should you require additional information or assistance.  Regards,[redacted], Managing Partner and General ManagerValley Nissan

I am rejecting this response because:I am going to post the response from Acura Honolulu below so that I can reference some points:"Dear Mick McKenzie:This letter is in response to ID # [redacted] filed by [redacted]. On October 17, 2015 Ms. [redacted] brought her 2015 [redacted] to our dealership, with a complaint of, “Front brakes are starting to squeal/squeak when applying brakes at least 5 mph during traffic and car is warmed up already.” Her Acura had approximately 6,831 miles on the odometer at the time of write up. Our technician test drove the vehicle to test the brake system operation, and found that the brake system was operating normally, as designed. Did hear a light, intermittent squeak, but noise can be attributed to driving conditions, or driver input. Technician inspected front brake components, including brake pads, brake pad retaining clips and spring, brake rotors, brake calipers, brake lines/hoses, and fluid level/condition. All brake components found to be in safe operating condition, no defects found at this time, noise does not impair use, safety, or value of the vehicle. No repair performed at this time, client was notified of our findings and vehicle was picked up from the dealership the same day.Sincerely,Ruben L[redacted]"I do agree that the brakes do work.  The issue is the high-pitch squeal that is produced when applying the brakes.  Brand new brakes should not make noises as if they are indicating that they need to be replaced, as the current brakes that are outfitted on our 2015 [redacted] do.  In my opinion, the noise that the brakes produce do bring down the value of the vehicle.  Who would want to pay such a high price for a vehicle that has issues?  Acura Honolulu stated to us that they are aware of the noise issue with the [redacted] model's brakes and currently do not have any solution or alternative at this time.  They did also said that once they do have a solution, they would notify us.  That was told to us in October 2015 and it is now December 2015.  The brake issue can also be seen as a safety concern not only for us as the consumer, but also for the other drivers in the vicinity of us that can hear the high-pitched noise.  I have noticed that some drivers and passengers in the vicinity cover their ears and cringe as the noise is produced and are clearly affected by it.   My children complain about the noise when they are passengers in the vehicle saying that it hurts their ears.All we want is for Acura to fix this issue so that we can fully enjoy this product that we have purchased from their company.  It seems that Acura does not have any concern for the consumer's safety in mind in regards to this issue.  How will we understand when the brakes need to be replaced when the same noise is produced every time we apply the brakes?  Are we to bring the vehicle in for inspection every time we hear the noise just to be safe?  We would like to have peace-of-mind for my family with this product.
