Tony's landscaping installed a $9,000.00 Sprinkler System and within 5 months the system sustained a leak and they refuse to come out and fix it.

I have attached the invoice for ***. First, I would like to note the sprinkler system is $6500.00. Second, the sprinkler system was installed 6 months prior by us. Third, I have verbally spoke with ***. He stated, two other companies, ***, and ***, who I spoke to, come out to fix his problem . I would like to note there is no warranty offered. The problem has already been corrected.. I do not feel comfortable sending my employees to touch an irrigation system thats been worked on by two other companies. I would also like mention that on April 7, 2020, *** came out to mow ***s property. *** and ***s *** agreed to mow and trim some shrubs in the front of property for $200.00. *** got into a small disagreement with *** because he wanted *** to trim the shrubs in back at no addition charge.. ***, then asked *** to leave and never return. This having been said there is no warranty on the system. The error *** has complained of has been touched by two other companies at the cost of almost $300.00, and ***s real complaint seems to be he failed to get the shrubs in back of property trimmed free of charge. As since, the initial agreement was only for front shrubs.

Complaint: ***

I am rejecting this response because:

1. The irrigation system was installed in October and was hardly used until this spring.

2. Tony’s landscaping came out and briefly looked at a leak we had back in February. He said it was a masonry problem.

3. The second leaked occurred approximately 1 month ago. I tried calling several times and they would not return my call. They said they could not warranty the work after someone else works on the system, however, they refused to come and fix the problem and I had large amounts of water standing in my yard. The second leak was extremely severe and and to be addressed immediately. Both company’s are willing to issue a statement to what they had to fix due to improper installation.

4. I hired *** to look at the first leak and they fixed it. He repaired the leak and informed Tony’s Landscaping that it was installation error. He informed Tony’s landscaping that the cost for the repair was $228.00

5. I hired *** to fix the second leak and he said it was also due to improper installation. That cost me an additional $250.00,

6. Tony’s Landscaping never requested a permit from my water company (AMUD). They told me this is a violation and will be further pursuing this issue.

7. My water bill for last month was $740.00.

8. Tony’s landscaping informed me they do not warranty their work. Then why do the work? This was not brought to my attention when I hired them to install the system.

9. If Tony’s landscaping would have been upfront and forthcoming, as well as, practicing ethical business none of this would have been a problem.

This is a very unethical company and I hope that they are not allowed to continue business as usual. This would not be a fair to all the unknowing potential victims in Granbury.

In an effort to put to rest many false statements made by *** against my 10 year blemish free business and give this Bureau a time line of events that hopefully will clarify this situation, I am presenting the following facts and documentation.
We installed a water sprinkler system for *** in October, 2019. Later, *** contacted us April 1, 2020, requesting his yard be mowed. We were unable to confirm an appointment until April 7. During that appointment, ***'s significant other requested another job that consisted of trimming shrubs in their front yard. The price was agreed upon and the job completed. Yet as my employee was preparing to leave, *** requested the trimming of the backyard shrubs as well, but became angry when he found there would be an additional charge for. After the passing of words, *** told my employee to leave his property and not return.
*** claimed he made several calls to "Tony's Landscaping" with no answer. However, as the enclosed phone records will show, there was only one call made after the initial mowing request which happened to be the same day in which he filed the complaint with the Revdex.com, April
25. Our office has also been accused of operating without a permit which is enclosed as well.
***'s call on April 25, was made after normal business hours, and did not leave a message. However, he did leave an intimidating text message demanding attention even though we were told to leave the premises.
I contacted *** May 5, 5:51PM, apologizing the delay was due to medical reasons and to investigate the matter. It was at this point *** explained he had already contacted 2 other companies and the problem had been corrected; ***, and ***. Having stated the problem was repaired, *** called a week later requesting us to cover his $740 water bill.
After consulting with our Legal Advisor, I am advised Tony's Landscaping has a Right to Terminate since he was kicked off the property by ***, and we were not given an opportunity in which to make the necessary repairs. In lieu of the fact two other companies have worked on the system, since its installation, therefore, releases Tony's Landscaping of liability. *** could have avoided his excessive water bill by simply turning the water off that lead to the irrigation system.

Complaint: ***

I am rejecting this response because:a These statements are not true. The person saying they were kicked off was not even present. I told them I no longer wanted them to maintain my lawn by never told them to not ever come back. I explained this to the person filing the response. I called them several times and have the phone records to prove so. This company continues to falsely represent what happened. And in the reply persons on words, she was to ill to know what was happening. My intimidating text was and I quote "I'm calling ***, my sprinkler system has a huge leak and you are obligated to come fix it". This text was sent after calling several times and being hung up on before I could even speak. As you can see the business owner has a gift at twisting the truth.
