Went out today and repaired roof leak. Found 1 nail backing up through shingle. Inspected complete roof to see if there were any other problems and found none. The roof looked almost as good as it did when it was installed in 2006. Mr [redacted] told me that he had not actually seen any water dripping from the roof just some stains on the wall . I believe after this minor repair the roof will be fine. Told him to call if he sees anything further.

NATURE OF DISPUTE:This is a follow up on case # XXXXXXXX I have been out of town for the last two weeks. Yes he did come out he was here 6 minutes he must be real good to check my whole roof and come inside with in 6 minutes.He did say if I had a problem to call him, but I have called him for over a year and he did not come. So why should I think he will come next time.
DESIRED RESOLUTION::DesiredSettlementID: Other (requires explanation)
I have wash down all walls and if it has water stains now I want him to man up, and come out and fix the problem. That all I have ever wanted be a man and stand behind what you say. THANKS

[redacted] in Reidsville North Carolina. I had received a call from Mr. [redacted] pertaining to Leaking problems in his roof. I stated to him that I was out of town and would call and come down when I come back. I was delayed on my return to town and when I did get back I did call him and he said it was OK to come down . When I did send one of my guys down there he already had another company that Had perform some repairs on his roof. They were there at the time my man got there so he went on the roof so repairs of been done and before he left the contractor came back to the house and continued to do some work on the roof. By Mr. [redacted] having another contractor perform repairs on the roof automatically void any warranty that he may have. According to the manufacturer of the product that was used on the roof there was not a warranty transfer done between Mr. [redacted] and the original owner of the property. I do not have any problem trying to make this right for him this one time with in reason. You can respond to him from my reply and find out what he has to allow on his end. Thanks so much. in the mail to him today and he should have them tomorrow no later than Saturday. The reason I sent you the copy of my proposal contract a couple of the items he stated were not in the contract. that 4 by 6 34 foot panel that he was talking about is not in the contract. The two pieces of decking that were replaced on the roof were over the garage area of the house. Thanks [redacted] have a good day.

Contractor's Response: all decking replacement was over the garage. We agreed to replace decking which was bubbling over the garage, near the offset sections of the roof which appeared to have serious water damage. Mr. [redacted] never investigated the cause for the bubble or inspect the roof from inside the attic. I was not consulted in regards to not replacing decking over the garage or the decking above the leak in the attic, as noted in the contract. Mr. [redacted] did not give any explanation why he did not replace the decking over the garage or the decking over the attic.
Two separate contractors were brought in to repair water damage from the roof. One contractor repaired walls and flooring in the living room, and another contractor repaired and re-blew the ceiling in the den. The leak from the attic was by far the more severe water damage... decking under flashing and boot was completely saturated. I pulled the boot and flashing back down in place, nail down and re-caulked several areas to stop leaks at three different areas on the roof. I also had to place tarp in the attic, under the leaks to prevent water from leaking from the attic down to the next level.
In regard to the [redacted] Warranty and Guarantees of Contractor's workmanship have no direct influence on either party. Registration of a customer's installation is not required. It is pretty much the customer's responsibility provides proof of installation, ensuring contractual criteria have been met and forwarded to [redacted] Technical Services Department; ensuring the installation is on file and eligible for [redacted] extremely limited repairs or replacements of shingles.
Contractor's response: Offset (4x6) panel between garage and dining room not included in contract... Mr. [redacted] agreed to replace panel prior to work beginning... at the same time he requested $4,500 to purchase materials. Neither change was noted on the contract. Mr. [redacted] actually forgot about the panel and when I reminded him only the final walk through the panel had not been replaced... simply stated he would give me several bundles of (my own) left-over shingles to cover my utility building.
Mr. [redacted] misrepresented services and contractual obligations. Contractor did not provide quality assurances at time of installation; failing to meet all manufacturers' criteria and installation specification. Nullifying enforcement of all contract warranties and workmanship guarantees.

Mr [redacted] carried me and my son into the attic under the garage roof to check damaged wood. When the roof was taken off the garage 2 pieces of decking were replaced as best of my knowledge. With decking on the main house backside was dark underneath but was not damaged on the outside so that was not replaced. When he talks about two contractors that came and did repairs that he states was from water damage from the roof which is correct but this was prior to the new roof being putting on. He showed us damage on the wall and the floor just to the right of the front door when you enter
the front of the house. all the water damage was done prior to me installing the new roof. He almost makes it sound like by his response that this was done after the roof was installed. I have had no notification of any leaks in the roof since we installed it. And for the warranties they are as stated they do not need to be registered which they can be at the owners discretion but is not required. The material warranty is with the manufacturer and labor warranty is from [redacted]'s Roofing to make such repairs if he has these problems which I don't think so far there are any problem with material and or workmanship. Job was done just as the proposal States no more no less. I did have a couple bundles of shingles leftover and told him he was welcome to keep them since he had paid for them.As far as any other damaged wood there was nothing in the proposal to replace that. That's something a carpenter would have to do.
One other thing on the warranty it is the customers responsibility to notify each party manufacturer and contractor if there is problem with roof.

Final Response Mr. [redacted] Breach of Contract: Roof Replacement
Mr. [redacted]'s statements regarding decking replacement are completely untrue: Decking Mr. [redacted] and I discussed was never replaced at the original leak (pipe boot) or over the garage.
Mr. [redacted]'s original quote noted decking was completely soaked (turning black) and had to be replaced noted in the original contract; also weak and sagging panel (bubble per Mr. [redacted]) over the garage; must be replaced.
Mr. [redacted] stated two contractors did repairs for water damage from the roof prior to the new roof being putting on. There was extensive damage to the wall and the flooring just to the right of the front door when you enter the front of the house; all water damage was done prior to installing the new roof. Mr. [redacted] implied water damage was occurred after the roof was installed. I have had no notification of any leaks in the roof since we installed it.
This statement is a complete fabrications... the roof replacement was completed December 21, 2013. [redacted] / [redacted] Services repairs were made from 29th of Dec through January 15th. Contractors were called in to replace walls and flooring due to water damage from leaks from flashing, siding, behind and between the gutters at the overhang... which [redacted] stated was not a current weather event for water damage. Mr. [redacted] and his workers attempted to repair the area while replacing the roof. Mr. [redacted] actually worked on the area himself stating his roofer repaired the area; but he personally placed additional chalking at the flashing to insure there would be no additional leaks. I called Mr. [redacted] a week later (December 28th) stating I still had a leak... he stated he would be out shortly to take a look at the leak; he never showed up to inspect the area, nor called back or answer my repeated calls.
September 20, 2014 Mr. [redacted] reports warranties do not need to be registered; but they can be at the owners' discretion but is not required. The material warranty is with the manufacturer and labor warranty is from [redacted]'s Roofing to make repairs for ten years (materials and or workmanship). But if the materials are defective when the shingles were installed who's responsible for the next (20 years)?
Mr. [redacted] states the job was done just as the proposal states... I contest it was not. [redacted] states if any portion of the roof's installation was not prepped properly or wet or damaged panels were not replaced; [redacted] will not honor the material portion of the warranty.
Per Mr. [redacted] the warranty is the customer's responsibility to notify each party manufacturer and contractor if there is problem with roof. That's exactly what I am trying to do.
Mr. [redacted] told me on the day of completion (12/21) I would receive a warranty from [redacted] in the mail within 15 days. I did not receive anything. I called [redacted] they advised me to register. Once I registered I received a Limited Warranty Notification of Registration #XXXXXXXX from [redacted] stating acknowledgement of warranty registration of the Asphalt Shingles for my home. I followed-up with [redacted] with a call requesting full explanation of the warranty... [redacted] @ XXX-XXX-XXXX from the [redacted] advised the warranty would be null and void if any portions of roof preparation or installation were not met. Contract indicates panels to be replaced... (2) panels of decking (pipe boot original leak) and weak and sagging panel over the garage (Mr. [redacted] identified this area panel with a bubble need replacing). I was extremely upset when the (Mr. [redacted] Mgr. Claims Adjuster told me Mr. [redacted] did not replace panels as indicated on the original contract and also noting roof was not in as bad a shape as original thought. Mr. [redacted] never shared that information with me.
Mr. [redacted] states he had a couple of bundles of shingles leftover and told me I was welcome to keep them since I had paid for them. This is simply not true... Per Mr. [redacted] damaged wood was not in the proposal to be replaced. That's something a carpenter would do. Mr. [redacted] did not refer me to a carpenter; the board was completely rotted out from water damage which I feared caused the bubbled panel Mr. [redacted] referenced to over the garage. Everyone was packing up to leave and I reminded Mr. [redacted] he had not repaired the off-set board. He said I tell what; I give you (8) sqs of shingles, (2) sqs of capping, (12"x36"roll) of felt paper, for replacement of the off-set board... that's more than what it would cost to replace and paint the board. It never cross my mind this was left over materials I had already paid for.
Mr. [redacted] agreed to replace the board with a handshake and a check for $4500. There was not a great deal discussion because Mr. [redacted] had to get to bank to cash the checks for most of his workers.
I've been up-front and very professional with Mr. [redacted] from the start. Mr. [redacted] fail to return any of my calls; refusing to answer any of my questions for nearly six months... not until I filed the complaint with Revdex.com. Base on Mr. [redacted] accusations and position taken; it appears he has chosen an extremely unprofessional and unethical approach. I also feel Mr. [redacted] and Mr. [redacted] Mgr. Claims [redacted] discussion and contradictions in regards to replacement my roof brings into question some degree of professional ethics. I requested a written copy of Mr. [redacted]'s statement to Mr. [redacted] comments regarding statement by Mr. [redacted] to Mr. [redacted] my roof did not need replacing... initially Mr. [redacted] stated he would document the conversation; after several months no communication at all. There has been a lot of he said - he said; which I find extremely unprofessional. It was my hope to remedy this complaint through the Revdex.com quickly and fairly and receive documents requested. Mr. [redacted]'s accusations and position taken appears to be headed for a long drawn out affair. Truly, unfortunate!!!
Please advise of your final resolution.
