[redacted] contract never contracted for stump removal.  The bottom of contract Spells out payment arrangements as job progresses.The 5% only states a hold back of total until stumps are completed if they are contracted to be done.Thank you Cindy [redacted]

I absolutely reject their response!  Though I guess I shouldn't be surprised by it.  I've done some research after sending the letter the first time - I wish I would have seen the complaints I've found before hiring Tony's!  Of course, when I said that I would like the night to think about it before signing the contract, the fast-talking Tony insisted if we didn't sign right then and there, "the cost would go up because they would no longer be in our neighborhood and would have to come back."  HIS words!  It may not be an illegal practice, but it sure isn't a good, ethical business practice! I received the letter I sent to Tony's back as "undeliverable" just this past Friday (one month after it had been mailed.  It had been mailed to [redacted], which is the address that came up when I Googled them (I didn't have the contract on my person when I typed the letter).  Perhaps they could suggest an edit to Google regarding the PO Box to avoid further confusion for customers.  The envelope had been opened and taped shut by someone.  I re-sent the letter on Saturday (10/14) to their PO Box, so they should receive it any day.  (I also mailed you - the Revdex.com - a copy of the "new" cover letter I sent with it.)  The letter sent to Tony's included pictures illustrating all of my claims.  I have attached electronic copies of those same pictures to this email for your files if you wish to have them.  First, of what significance is it that we "contracted as a walk"?  Does that make us any less important as customers? Second, yes, the contract said the wood stays "where it lands" - I certainly would never take that to mean in a neighbor's yard OR hanging on electrical & cable wires!  If it does, then that is a terrible, dishonest & unethical business practice.  (In fact, I wonder if that is even legal to do, especially leaving branches on the wires.)  Third, regarding "removing, reinstalling & repairing fence":  We were told the crew would not be there until 7-10 days, so that would mean we had 7-10 days to properly remove the portion of fence tony showed us (three sections at the front end of the fence), right?  Well, that is, until we get a call TWO days later, while one of us is at work, and the other in Hamburg, saying the crew would be there in a couple hours!  And another portion of the fence (2 sections), further toward the back of the yard, was NEVER mentioned as having to be taken down.  Instead, his crew took it upon themselves to take it down, ruining parts of it in the process.   Our neighbor had someone help him fix that portion. Finally, the business' response to you doesn't even touch on most of my complaint:  The portions of our neighbor's tree that was cut off at the fence line and left in our yard (that was much more than the wood from the portion of our one tree that was removed)...that neighbor paid to have his wood removed so the claim about "leaving wood where it lands", definitely wouldn't apply in this case;The scraps left behind that could have and should have been put in the chipper, according to the contract;The bottles left behind by the crew (maybe not a big deal, but inconsiderate, disrespectful business practice at best); The damage - huge ruts everywhere because the crew was careless and didn't bother to take any care when driving the truck back (we still have standing water & mud issues because of the ruts in the photos); the ruined fence posts because the crew ignored my husband's direction about the small portion of post above ground that the truck COULD have and SHOULD have easily avoided. (Due to being rushed with the whole two days rather than expected 7-10 day arrival, fence posts had to be cut off instead of dug out. We cut them at a level that could be avoided by the truck, and then used to reattach the posts to in a clean manner, but the truck drove right over them anyway, burying them.); a damaged patio canopy due to having to rush to take down, again due to the unexpected two day arrival);  and, not mentioned in the first letter, the holes everywhere through out the yard from carelessness in the handling of large limbs & branches - it's a wonder none of us has twisted or broken an ankle in one of these holes! The fact that we had to take time off of work to rush and the fence & canopy down (leading to damage) before the crew arrived (because we were told flat out - several times - by Tony, that it would be 7-10 before the crew would be able to come do the work....then showed up TWO DAYS LATER!).  As I mentioned in my first letter, I realize that some damage is likely to occur in such a job.  But certainly not to this degree, all due to bad, careless & dishonest/unethical business practice.  I'm pretty certain that a lawyer could easily counter most, if not all, of his claims regarding the contract.  As stated in my original letter, I have since talked to people who have had trees taken down, and have since observed the work of several other tree companies, both while in progress and after completion, and none have displayed the carelessness and disregard for homeowners like what we experienced. None had the mess, ruts, holes & damage left behind that we did. None.  So, what we experienced with Tony's is definitely NOT common practice among those in the same field of service.I again will state that, everything considered, a $450 refund is more than a fair request on my part given the expense we have to endure for carelessness, repairs, having to take time off of work & rush with our yard preparation due to the EARLY and UNEXPECTED & UNPLANNED arrival of the crew, etc.  This was, without question, an unacceptable job performance on his crew's part.Regards,[redacted]

I have spoken with Philip and explained the delay in having the stumps ground.  Weather pending the stumps will be done soon.

Complaint [redacted] has been resolved with [redacted]. The clean up and seeding has been completed according to the contract.

I called [redacted] had a discussion, and met with her on 5/17/16.  I looked at her yard and her fence.  She explained her concerns.  In our contract it states line 24 Customer will be responsible for any damage to neighbors property.  Line #26 Customer will get permission from...

neighbors to access property with trucks, equipment & staff.  The crew was cleaning up her yard, she told them they did not have permission to be on her property.  Tony did have a conversation with [redacted] at the time the work was being performed.  I took a picture of the one slate on her fence which has a crack.  We are working with [redacted] to resolve this issue.

Consumer stated the work has been completed.

When I eventually got to speak with Tony about this issue after a few failed attempts,I couldn't get a word in edgewise. He kept repeating that it was an 'honest mistake" but did not listen and/or  offer any resolution for this mistake. The conversation with Cindy wasn't any different either. Her cold answer to my experience was, Oh I don't know anything about that, you will have to talk with Tony " She certainly did not explain that the refund will take 2 to 7 business days.  And the text was a third party transaction receipt.I am very disappointed with their customer service.The money is still not refunded to my account today-06/03/2016..

took a Revdex.com complaint to get the fence repaired. I am further disgusted with the fact that Tony's left the broken fence laying in between the outside of my fence and the main road- broken into smaller pieces and with nails sticking out of it for me to clean up.   Tony's should have properly  disposed of the fence. This just further shows their lack of respect for people's property and safety as I have children and also people in the neighborhood that walk in that area the old fence was left due to no sidewalk.  After my experience, I would never recommend Tony's services to anyone. Regards,

I am writing in response to your notice that you closed the file due to a lack of response from us.   As we had stated we would be out of town , and unfortunately in a remote area with very limited access to modern technology--- Imagaine that.We did Finally get our deposit very reluctantly refund from Tony's , and I had to wait 10 days to be sure the check cleared. I read their response.  What a joke.   We have the phone records to prove the dates and times we called and they called.The time line and reply in not accurate.While we did resolve the matter, I STRONGLY URGE YOU to read the letter we had to send to get a reply.   Other consumers should be aware of the type of people they are dealing with.  Tony is extremely unprofessional, a LIAR, and he threated that he owns "several smaller tree companies and knows alot of people; and we would not be getting our tree trimmed any time soon".I thank you for the service you provided , it did get their attention.   I certainly with do more extensive research the next time I seek out a contractor.    [redacted] and [redacted] ratings on this company are not favorable by any means

We apologized for the delay and inconvenience, unfortunately topsoiling is weather permitting.  Due to rain the topsoil becomes mud and you can not spread it.  We take pride in the work we perform.  This job has been completed to full satisfaction to the customer.

In response to Mr [redacted], his contract was signed on May 27th, the work in his area was expected to be scheduled in the next 7 to 10 business days.  Due to the high volume of emergency calls we have received in the last two weeks his work has been delayed.  The work is always scheduled...

around the weather.  Emergency jobs, trees on houses, garages, fences etc take precedence.  Unfortunately due to the tornado in Rochester and the heavy rains in Buffalo the emergency jobs are higher in volume.I have spoken with Mr [redacted] and have explained the situation, which is he is understanding. I will be in touch with Mr [redacted] to let him know the ETA on his job.  His response " that's not a problem.  Really appreciate you keeping me in the loop. Thanks!"He also has a number to contact me directly, if he has further concerns.As a company we appreciate and respect our customers, we thank them in their understanding of weather dependent work!

As you can see on the bottom there is an amount listed as a percentage for stump removal. I will be sending several more emails with the pictures as well of what they left and the three spaces where they did remove the stumps. Sincere thanks for your assistance. They removed from some smaller trees that were also cut and left the larger ones which are in another photo. If no stumps were included in the contract they would not have done these either. Which further supports our claim they Tony did not complete the contract properly on his end or come back and talk with us to make sure everything was done to our satisfaction as it stated would be done.

This customer signed up to have 6 trees cut down  see line 2 of contract, line 14. grind stumps was checked then crossed off because customer could not afford to have stumps done.Refer to top of contract Job Company name states what to be performed 6 tree removals and 1 bush removal....

 Refer to Key sheet there is a drawing of work to be done and top of contract states what work is to be performed.  There are no stumps no this contract, no refund is due.Under Payment ArrangementsThis shows a break down of how the payments are taken for the work that is contracted.The customer specifically had the stumps excluded from the contract, to make the job more affordable.  No Stumps on Contract, No Refund Due

The customer contracted Tony's Tree & Landscaping as a walk, when we where performing work in their neighborhood.  When the contract is written the salesmen goes over the contract with the customer.  The contract was signed August 12, 2017.  Reference Line item 2a Cut Down 5...

Trees, Leave Wood Where It Lands.  Line 25 Customer will Remove Fence, Reinstall Fence, Repair Fence.  This job was performed to specifications of their contract.If a letter was sent, it was not received, if you sent it to [redacted] we do not receive mail there.  Our mailing address is clearly stated on every contract is [redacted] No Refund is due.

there fence back.  The utility companies then have to flag the property before stump grinding is done.  During this time there where many storms that hit Buffalo and Rochester causing emergency jobs, which take precedence, do to severity of the damage.  This was also communicated to the [redacted] family. We also experienced a stump grinder that needed repair, I called [redacted] and explained the delay.  I reassured them they would be at the top of the list, the machine was repaired we received it on aFriday and that Monday their job was completed.We regret the delay in the stump grinding, but do to heavy rains, emergency jobs and a repair, we kept the lines of communication openThe office manager even provided her personal cell number, to keep the communication going.I would like to Thank the [redacted]'s for choosing our company and working with us.
