Review: Case:

After seeing a newspaper ad about Toothsavers Dental Center, [redacted], I, [redacted] and my wife [redacted], decided that we wanted to have some dental work done. We called the office and made an appointment for November **, 2015 at 11 a.m. On Friday, November **, 2015 at 11 a.m., my wife, our daughter, and I went to the office for our appointment. We were greeted by a man who introduced himself as Jerry L[redacted]. He stated that he was the man in charge.

We were then examined by a man that Mr. L[redacted] introduced to us as his son. 'Jerry's son' checked and measured our mouths and informed us that they would only do x-rays today. Jerry immediately ordered his assistants to administer x-rays to my wife and I. Once the x-rays were printed out, Jerry informed us that we needed a lot of work done. He told us that this amount of work would be very costly and we sat down to discuss/negotiate pricing. He immediately asked if we had credit cards so we could pay for the work. I informed him both my wife and I had insurance and presented him with our insurance cards. His receptionist made copies of our insurance cards and Jerry told us that he would send the claim to the insurance, but our money would come back to us after we paid him. He demanded the money up front, in cash, before he does any work at all. Mr. L[redacted] stated that he wanted to help us out because we were nice people. He told us that he wanted to give us a bargain for the amount of work that needed to be done. We then discussed the scope of the work that needed to be done.

We made a deal with Mr. L[redacted] to install 13 implants for myself. In regards to my wife, Mr. L[redacted] stated that she needed more work than I did. He said he was going to try and save her teeth, but if they are not able to save them, he would have to take them out and install implants. Also, if she had any missing teeth, they would install implants, but he did not give a specific number of teeth that needed to be shaved, replaced, or taken out. We agreed on a price of $15,000 for all of this work.

I then gave Mr. L[redacted] my debit card and he informed me that he was going to take out some money before he started any work and told me to bring the rest of the money tomorrow. He also told me that he was not going to start any work until he received all of the money. Mr. L[redacted] transferred $9,000 from my account to his. He spilt it into three payments of $5,000, $3,000, and $1,000. He informed me to bring the other $6,000 in the next day, which was Saturday, November [redacted], 2015. Mr. L[redacted] told me that he would begin work on my wife's teeth the next day when I brought the $6,000 and made an appointment to start work on my mouth for Wednesday December [redacted], 2015.

After we set up appointments, I signed some papers that I did not have the time to read because I was in a rush to get to work, but I asked him what the papers were for and he said, "[redacted]." After signing the papers, I left for work and left my wife and daughter at the office. After I left, Mr. L[redacted] then ordered his son to take my wife into a room and give her five numbing shots in her mouth, pull out 4 teeth, shave 2 teeth, and install six temporary porcelain caps. My wife reported being in a lot of pain from the shots and Mr. L[redacted]'s son apologized but said that he had to give her the shots. After giving my wife the shots, Mr. L[redacted]'s son gave my wife some papers to sign. She asked Mr. L[redacted]'s son what are these papers because she was in pain and was not able to read them. He stated that they were papers that said it was ok to begin work. My wife then made an appointment with the receptionist for the next day, Saturday, November [redacted], 2015 for 10 a.m. to continue work on her mouth. Mr. L[redacted]'s son mentioned my wife to bring the $6,000 to the appointment. My wife and daughter left the office around 2 p.m. and returned home.

The fact that my wife was in a lot of pain led us to cancel our appointment for the next morning. On Saturday morning, we immediately went to our bank and put in a claim for the $9,000 that Mr. L[redacted] withdrew from our account. Unfortunately, after two weeks, the bank was not able to stop the transaction. It is for this reason that we are writing this complaint.

Review:

Jerry L[redacted] is 81 years old and had lost his dentist license in 2002 for, "rendering substandard dental treatment," according to state records. However, he has continued to treat patients at his various offices. This explains why he told us to make a check payable to Robert W[redacted]. Another article we came across also divulged that he is the most sued dentist in New York City. He also owns many businesses and residences and is a self-proclaimed millionaire. Therefore, Our $9,000 should mean nothing to Mr. L[redacted].

Countless times, Mr. L[redacted] seemed very pompous and arrogant. Mr. L[redacted] stated to us during the negotiation for the price that, "[redacted]" He was overly insistent and very confrontational during negotiations. If he is a millionaire, he would have no trouble giving back the money. After we received word from our bank about our unsuccessful claim, I called Mr. L[redacted] and asked for our money back. Mr. L[redacted] then proceeded to yell at me and stated that he knows people in the police force and that no one is able to do anything to him. He also explicitly claimed, while shouting, that he was not going to give us back our money back.Desired Settlement: For the reasons stated above, we have decided against Mr. L[redacted] doing our dental work. We feel that the $9,000 that we paid to him should be refunded in full. I do not want to take the chance to do dental work with Jerry L[redacted] based on the many negative reviews about him and his company, based on my feelings about the way he conducts himself and his shoddy business, and because of my wife’s pain and suffering that she is still currently experiencing.

The work that Mr. L[redacted]'s son performed on my wife, along with the measurements and x-rays, should be paid by our insurance and should not be included in the $9,000 that we paid Mr. L[redacted] because he started working without receiving payment in full. Because Mr. L[redacted] is no longer doing work on us, we should be refunded our money. We do not want to become yet another litigant against Mr. Jerry L[redacted], but we will do whatever we have to get our money back. I am also asking the court for Jerry L[redacted] to pay for my lawyer and for the pain and suffering of my wife if this matter makes it to court. Thank you.

Review: I am writing this letter on behalf of my mother who at almost 80 years of age was scammed into signing a credit card by Tooth savers Dental Services, owned by Dr. W[redacted], [redacted], ###-###-####.

My mother is diagnosed with Parkinson disease which is a progressive disorder of the nervous system. It affects her movement, speech, and unfortunately her cognitive abilities.

On October **, 2015 she went to see Dr. L[redacted] at Toothsavers with a severe toothache. After separating her from the caregiver. The dentist along with the dental treatment coordinator told her to sign a form before they could begin medical treatment. In excruciating pain, she signed the form. No one explained to her that she was signing a credit card nor did they give her a copy to review. She has been with this dental practice for over 6 years and has always paid in cash.

On October **, 2015 we went to Dr. W[redacted] office to discuss what I believe to be a discrepancy in the bill. She received a credit card bill of $10,000 dollars. Julia the dental clerk was disrespectful and ill-mannered as soon as their billing practices were questioned.

She referred us to Dr. [redacted] who stated that each tooth they work on was $1000 dollars. He looked at her chart and counted from 1 to 13. He stated “[redacted]”. I replied “The bill was for $10,000”. He then said “[redacted]”. I turned to Dr. [redacted] and said “That does not make any sense to me". He yelled” [redacted]”. He jolted out of the room and slammed the door.

I turned to the dental clerk, Julia and told her “You scammed my mother into signing that form and she will not be paying that bill”.

While we were at the front desk, Dr. [redacted] returned and yelled at my mother. “[redacted]”.

Signing patients up for credit cards without their knowledge and charging them thousands of dollars for services not yet provided, paints a disturbing picture of unethical treatment of the elderly.Desired Settlement: This dental office charge my mother $10,000 dollars for treatment that was not completed. The provider yelled at her and told her not to come back to his practice. We have requested a copy of her records to take to another dentist. We would like the bill to be adjusted. We have contacted the credit card company who stated that the dental office has already been paid. This business has a responsibility to adjust the bill.

Review: I came to this dental office for a treatment about 4 months ago. We had a written agreement which clear states that I pay $5000 when I start receiving the treatment and pay another $5000 when the treatment is totally completed. In the middle of the treatment they refuse to continue seeing me unless I pay the rest of $5000. The doctor says " I changed my mind, you have to pay the rest of $5000". This is a scam, he left me in the middle of the treatment.Desired Settlement: They must finish this treatment.

Review: I scheduled dental surgery on 8/**/2013 for 9/*/2013. I paid upfront $2200.00 before the surgery. I cancelled the surgery after further investigation of this provider. I have had extreme issues getting a full credit back to my Visa account. Everyday, I speak with an office representative to request the full refund. After almost 3 weeks, I finally received a partial credit of $1400.00. However the remainder of the refund is still pending as of 9/**/2013. This dental practice has held onto my funds for almost a month now without providing the service and refuses to expedite a full refund.Desired Settlement: I would like the remainder $850.00 credited back to my visa account in a timely fashion.
