Sep 11, 2017RE: Refund for unused drives from 2016Dear Sir,The State of Ohio Dept of Public Safety requires s teen driving student accomplish the classroom (hrs) and in-cars (Hrs) with a month time frame from when the student starts the classroom portionThis student started class May 14th but never finished class, had drives scheduled that his father cancelled July 13th "because student has to work".It is not our process to allow a student that is past one year to make up missed appointments.I don't know who [redacted] is but he was not open with the fact that his agency assists foreign students in obtaining their drivers licenseWe are a teen driving school and deal with parents and underage students working to attain their drivers licenseWe do assist state or county agencies for students with special needs. We occasionally transfer "unused" drives to siblings of the same family but not in a case such as listed on the complaint[redacted] Top Driver Ohio

I am rejecting this response because: I talked with the instructor in the class in Westlake many times about the arrangement that we had with this refugee family. I do not know who cancelled the drivers class, although I know it was not the father as this young man's father was killed in a civil war in Sudan many years ago. I would like to know why no one at Top Driving School contacted me when the student was not completing or cancelled their in car instruction as my contact information was on the form as the parent. I signed up for the "package" with classroom and in car at the same time to receive a discount, yet when I called to schedule in car I was told that there were no available drivers and to call back in 2-weeks. I called several times to schedule in car and was told the same thing each time. If the company does not have enough driving instructors they should not offer this package option

Initial Business Response /* (1000, 5, 2016/05/16) */
Please see the business's response attached:
"May 16, 2016
To: Revdex.com
From: TopDriver
Subject: Case# [redacted]
Mr. [redacted] signed up for Driver's Education June 5, 2015. The program was for a [redacted], she...

completed her classes and took three of the state mandated 4 drives. These drives took place on June 21, August 5 and August 10th.
The student never signed up for her fourth and final drive. The State Law requires each student to complete their State Mandated requirements within 6 months of their start date,
This a State law not a TopDriver law. if the requirements are not completed within these 6 months the student must start over, again this is a State requirement, not a TopDriver requirement.
Ms. [redacted] had plenty of opportunities to complete the final drive and choose not to. The student and parent signed a State requited contract that outlines this information within the body of the agreement.
Once the student passes the 6-month date we are required to re-active the student.
Mr. [redacted] is well aware of this. We would be more than willing to complete his final drive but he must get approval from the State. He can contact them at [redacted], and if they provide us with written authorization, we will reactivate the student.
We provided Mr. [redacted] this phone number already.
Please find enclosed a copy of the signed agreement.
Thank you for your time, please call if you have any questions"
Initial Consumer Rebuttal /* (3000, 7, 2016/05/17) */
(The consumer indicated he/she DID NOT accept the response from the business.)
In response to Mr. [redacted]'s letter dated May 16, 2016, first of all, I would like to point out that I signed up both [redacted] and [redacted], not just [redacted] as indicated by Mr. [redacted], for the driving program. They took the in-class lessons and in-vehicle lessons at the same time. Secondly, I do not dispute the 6-month requirements, whether it is a state law or a Top Driver law. I know now that there are such requirements. What I do not understand is how Top Driver could simply deactivate my account without informing us, even though I had paid in full for the entire driving program.
I agree with what Mr. [redacted] said in his response regarding the agreement we signed, however, he missed the point. As a legitimate business, shouldn't Top Driver at least give me a call or send me an email before closing my account?
