July 9, 2015Dear [redacted] :I am responding in reference to your letters to my client in reference to the above matterI apologize for not getting back to you sooner.The basis for [redacted] **'s complaint is that he was somehow defrauded into believing that there was a loan forgiveness program that did not exist and which anyone could apply for freeMy client contests these allegations as not true and states that the matter has been settled when my client refunded $to [redacted] which he accepted.Specifically, [redacted] came to my client seeking assistance with payment of his current student loanMy client suggested President Obama's Pay As You Earn Repayment Plan (PAYE) as an option to reduce loan paymentOf course, [redacted] did not know about this program prior to meeting my clientAs my client does with any of their customers, my client offered to provide financial consulting service to help with repayment of [redacted] **'s student loan, which included assistance in applying for PAYE [redacted] could have simply declined my client's services and look up the plan himselfHowever, he agreed to have my client provide financial consulting services, which included assistance with PAYESee Exhibit A, Contract Agreement.After signing the contract, my client reviewed [redacted] **'s tax returns and financial information, as well as assist in completing the PAYE applicationSee Exhibits B - DThus, my client already started work on [redacted] **'s case per his instructions and contract agreementAfter the work was performed, [redacted] contacted my client and asked for a refundMy client told him that the work had already begun and refund was not possible per the contract, which states that the "client may cancel this agreement at any time prior to midnight of the third (3rd) calendar day after date of this agreementif the client did not receive federal loan consultation services"See Exhibit A, Contract Agreement.When [redacted] got unruly, however, my client decided to cut her losses and proposed a settlement agreement whereby my client would refund $of the $paid [redacted] agreed and signed his name on the top of the Contract Agreement wherein it is handwritten "Contract Cancelled Client [seal] Top Edupia [seal]"See Exhibit A, Contract Agreement and Exhibit E, copy of refund check.Therefore, not only has my client provided the services as requested, but the matter has been settled by the parties when [redacted] accepted the refund check of $and signed his name on the cancellation agreementMy client is upset, to say the least, that [redacted] has decided to induce my client into signing the settlement agreement and paying money, when he had no intention of honoring his agreement and making the same complaint to the consumer bureau.Thus, my client takes issue with each and every one of [redacted] **'s allegations as and, even if dispute arose between consumer and merchant, states that the matter has been resolved when [redacted] accepted $as full refund.If you have any questions or need anything, do not hesitate to contact meThank you.Sincerely,Jason H

I am rejecting this responseAfter reading the response, I have a couple things I would like to point outFirstly, a document that he enclosed was a document that the college has on their website as a print outThey did not put in any work to get that document and should not be taking credit for thatAnyone could easily go on the website, print it out, and sign their nameAlso, Top Edupia states that they spoke to my daughter's college, but after I called the school, they tell me that they have no record of ever speaking to a Top Edupia representativeThe school also stated that they would not have given out my daughter's personal school records because Top Edupia is not on the authorization formEven so, Top Edupia keeps insisting that they had access to her school records and used to talk to me about how well she did in schoolNow, I have asked Top Edupia and their lawyer, Jason, numerous times, to tell me when they spoke to the college, the name of who they spoke to from my daughter's school and who from Top Edupia spoke to themThey have yet to answerThey just insist that they did, but do not provide that informationAs the client, I feel I have the right to knowAlso, Top Edupia is stating that they negotiated a payment plan with the schoolI have email records from way before Top Edupia, from when my daughter was still in school, of making a payment plan with the collegeTop Edupia did not make the payment planI did that the year beforeI could show you all of the email messages between the college and I proving that I hadAs for the harassment complaint, I simply emailed them for answers because they would notI could also show you the email records between Jason and I, and show you how he did not answer any of my questionsAs a client, and a father who really wants her daughter to be in school, it is frustrating to be cheated by people I went to, desperate, for helpI feel as a client, I should have my questions answered, thoroughly, and not have the answers be dodged with a change of subjectIt is unfair that Top Edupia is trying to play victim when numerous clients, who all went to them as desperate parents, were cheated on by Top EdupiaAll I would like at this point is for Top Edupia to answer that one question: what date they spoke to my daughter's college, who they spoke to from the college, and who from Top Edupia spoke to themNow, I know they will not be able to answer this, because they have not been able to for months of me asking, therefore, I would like your help, MsHorne, to be able to report them to Consumer Reports, and for someone to investigate Top Edupia so that everyone that has been wronged can feel a little more refreshedIt is just not fair that Top Edupia is taking advantage of financially unstable parents, who do not speak English as their first language, and cheating them, when all the parents want is a better life for their kidsPlease help meThank you

June 11, 2015Dear [redacted]:I am responding to your letter dated May 29, 2015 and June 9, 2015 in which you asked my client, Top Edupia, to respond to a complaint filed by [redacted]. My client denies all allegations as baseless and without merit, with some allegations bordering on...

slander/libel.Specifically, [redacted] came to my client to seek help with tuition and other financial matters related to her daughter. My client offered to talk with the college to determine what options were available. In numerous contacts with the college, my client negotiated a term in which [redacted] was to pay the back the college arrearage by August 1, 2015, in which case the college would take her daughter back and she can apply for a loan. See Exhibit A, Contract with Top Edupia; Exhibit B, Payment Plan Application and Agreement; Exhibit C, Work Summary. As part of overall financial consultation, my client also offered to assist in filing Free Application for Federal Student Aid (FAFSA).This has been communicated to [redacted] numerous times by my client and myself. At one time, [redacted] was repeatedly calling my client to harass them and to obtain information that had nothing to do with the above work. My client took issues with [redacted]'s constant and harassing calls and we sent him a cease and desist letter. Since then, while [redacted] has been in contact with me regarding his complaint, he has now taken it upon himself to complain to the Revdex.com. However, my client denies any wrongdoing and takes issues with [redacted]'s bald allegation that a “former employee" is bad mouthing my client and alleging fraudulent wrongdoing without any support in fact. This borders on libel/slander.Please be advised that my client takes issues with all false allegations in Mr. Kwak's complaint.
