Top Gun Watersports

Review: In April 2014 I had contacted [redacted] from Top Gun Watersports about a 2010 Yamaha XV sport Jet Ski. The transaction worked well for both of parties involved. I again contacted [redacted] on August 15, 2014, about a 2011 blue Yamaha XV deluxe. On his website www.topgunwatersports.com the Jet Ski was listed at having 221 hours on it for $4000. [redacted] had asked me to send a deposit of $500 to hold my place in buying the Jet Ski from him. I did so on August 20, 2014. I know he received the check because he had cashed it on August 26, 2014. I went to see the Jet Ski in Fenwick Island on Labor Day September 1, 2014. [redacted] one of [redacted]s employees showed the Jet Ski. It had over 600 hours and the hull had damage to it. [redacted] had mentioned that it was rough season with renters of the jet skis were crashing into each other. On farther inspection of the Jet Ski the engine inside of the hull smelt like burnt oil. [redacted] had suggested the hull damage could be fixed at my expense at [redacted] other business Top Gun Collision Repair, Fredrick MD, 21701. (NAICS Code [redacted]. With everything that was wrong with the Jet Ski such as damage to the hull. Burnt oil smell on engine inside the hull. Over 600 hours of running time instead of the 221 hours stated to me. I decided that I did not want this Jet Ski and asked [redacted] to let his boss [redacted] know.[redacted] contacted his boss [redacted] on the same day and let him know that I did not want the Jet Ski. I contacted [redacted] via text on September 5, 2014 that I was sorry that we did not make a deal with the Jet Ski, and that I wanted my $500 check refunded to me at my home address. On September 5, 2014 at 11:29 am, [redacted] texted back with his thoughts. In the same text he sent a PDF statement that was signed only by [redacted]. I was not aware of any policies that he said he had in place until he sent me the PDF statement. [redacted] keeps making excuses for not being able to returning my deposit. He also has discontinued communications with me. I have documentation for backup.Desired Settlement: I would like my $500 deposit back from [redacted] Top Gun Watersports/Top Gun Collision Repair.Thank you in advance for your time and consideration.
