I am rejecting this response because: there is no proposed offer.
        In her letter Mrs. Aurora mentions one small issue - the conveyance fee which was resolved. Still, it took a lot of struggle and time to finally receive it back, that we would definitely not call this a "courtesy" of the ERA company.  This what still remains the problem, and what we would like Mrs. Aurora to concentrate on, is the negligence of Mr. R[redacted] and lack of communication with the buyer.  Mr. R[redacted] did not pass our offer of $165.000 to the buyer and made us potentially loose $5.000 on the sale of our house.  Next, Mr. R[redacted] told us over the phone on the day we accepted the offer of $160.000 to leave in the house all the appliances as part of the deal.  That was: washer, dryer and French door refrigerator, all almost new and in excellent condition, worth over $3,000.  And just to correct Mrs. Aurora, the initial date of closing was scheduled for Jan 2nd which Mr. R[redacted] changed to Jan 9th and made us pay additional costs. Furthermore Mr. R[redacted] who was supposed to represent us failed to show up on the closing date and was not accessible by phone to help us resolve all those issues. Still ERA company did not have a problem to charge us a full amount of commission fee $8.000 as agreed.  Those are the issues we would like Mrs. Aurora to concentrate on. Our next step in this matter is contacting State Real Estate Commission Office as previously advised.

June 24, 2016Dear Attorney [redacted],I have received your facsimile dated June 23, 2016 and have the opportunity to review the same. At the outset, let me state that we did not receive three (3) written contacts from your office.With regard to the subject matter of the correspondence, specifically [redacted]...

[redacted], I have spoken with Sunita A[redacted] and she has informed me that the matter complained about involves the return of an earnest money deposit.Specifically, [redacted] put in an offer on a property listed with ERA. One Source Realty and provided an earnest money deposit with his offer. Said deposit was placed in ERA. One Source Realty's escrow account. [redacted] proceeded to go through the inspections period but after the results of the inspections, determined he did not want to purchase the property and requested the return of his deposit monies. Pursuant to the terms of the Agreement of Sale, that being the standard form provided by the Pennsylvania Association of Realtors (PAR), earnest money deposits cannot be released by the Real Estate Broker holding said monies if there is notice of a dispute. [redacted] submitted a termination of agreement of sale form as well as a request for return of deposit form (again these are standard PAR forms provided by the state). However, the sellers did not agree to return the monies, Since the sellers did not agree to execute the return of depositforn, ERA. One Source Realty is prohibited by law from releasing any monies unless someone procurs a court order or 180 days elapse from the original date of the Agreement of Sale. All of this language is contained in the Agreement of Sale, and I am attaching herein the relevant page of that document.I hope it is clear now that ERA One Source Realty is not holding [redacted]'s monies for any reason except that there is no agreement to release them, he has not obtained a court order or arbitration order providing they be released to him, nor has 180 day elapsed.If you have any further questions or concerns, please do not hesitate to contact me at ###-###-####.Sincerely, Nisha A. I am rejecting this response because:This realty firm (and in particular the realtor, Sunita A[redacted]) demonstrated such poor communication and follow through with us that we asked to be released from our real estate contract (so that we could find another realtor) on August 10th 2016.  There was no response to this request.This led me to appeal to the parent company, ERA.ERA responded to me on August 22nd, and they too asked Sunita A[redacted] to address my complaint.She still chose not too.Only after this complaint to Revdex.com and also 2 further complaints to ERA, Sunita's daughter finally responded (more than a month after my initial enquiry) stating that she couldn't understand why I was "griping" about poor commination (!), and refusing to terminate the contract.Now she posts this unprofessional message here.The accusation that I have another buyer is untrue, and actually may constitute grounds for a libel charge.In any event, a realtor is supposed to obey a professional code, and have a trusted relationship with his/her clients.How can we possibly have such a relationship moving forward?They should release me from the contract, and allow me to find another realtor.

I believe the issue is resolved and the escrow monies have been returned.  PA Real Estate law does not allow brokers to return escrow monies without the consent and agreement of both parties or until the time period specified in the agreement of sale (180 days if no other specification is made)...

Please be advised that [redacted] has firstly provided incorrect contact information - his address is [redacted], Clarks Summit PA [redacted].His complaint is unclear and was received by this office just last week.  Apparently he would like to be released from his listing agreement, but said...

agreement is a binding contract with an expiration date of 12/31/16.  **. and [redacted] are apparently going through a divorce and only [redacted] was residing in the residence - numerous attempts were made to get in for pictures, etc. and she refused to let anyone in.  ERA One Source Realty sent a handyman to help her clean and paint, finally took photographs, and was able to procure the video tour in August after three months of attempts to get in to do so.The company has not violated the terms and conditions of the listing agreement and refuses to release the [redacted]' from the same.  The Agreement is a valid and binding contract and no release shall be granted.  Feedback was given for the one showing and one open house was done - the property has been further advertised in regular rotation in all publications utilized by the company.[redacted] may have procured his own buyer but that does not release him of his obligation to pay a commission to the company.  He needs to understand that he signed a contract and the same will not be voided because he files a complaint.  His complaint directly to our office has been addressed but he doesn't like the answer so he keeps going and filing new complaints.  He already left 1 star reviews on [redacted] for no reason except that he doesn't want to face the fact that his house is not worth what he thinks it is worth.
