To whom it may concern, On 6/11/2015 I Derrick O[redacted] owner of Top Notch did perform an estimate for [redacted] at [redacted]. This estimate was executed without Ms. [redacted] because she did not show up for the estimate. I then made Ms. [redacted] aware that her roof was not...

in good condition and a roof replacement was needed but a roof repair could be performed as requested. The amount of repair was $750.00 for material and labor. On 9/9/2015 her daughter [redacted] contacted me about performing repair. After a brief conversation both parties agreed to a time and date for repair to be executed and Ms. [redacted] then asked if Top Notch took credit cards. I assured her that we do take credit cards and merchant services charges my business an extra % fee for using credit cards. On 9/11/2015 I contacted Ms.[redacted] via text for address confirmation and to give her an ETA. Our appointment was set for between 430-5pm which I arrived approximately 4:35 at her property in my SUV. One of my guys pulled up with my work truck at approx. 4:40. As soon he arrived we set up a ladder and began the repair on the roof. We found there to be three small holes in the same area on the back side of the roof in which we repaired and installed shingles over the area of concern. This completed the repair at [redacted] at approx. 5:10. In this same time frame I did talk to Ms.[redacted] on her sisters phone stating she would be late and was in route from Oakland. I informed Ms.[redacted] that we were finishing up and loading tools on to truck. I also told her that I would wait at property for payment in full since job was complete. After I waited for 15-20 min Ms.[redacted] showed up to property around 5:30. At this time I explained the repair that was executed and showed Ms.[redacted] pictures of the holes and the shingles we installed on back side of roof. My roof mechanic and I then proceeded to explain the poor condition of the roof and offered to show Ms. [redacted] the repair from the ground in the rear of her property. We again talked about how old and in bad condition the roof was in. We then took measurements for Ms.[redacted] for a whole new roof replacement as she requested. Ms.[redacted] then asked what other work my company does. I told her a broad scope of work and she proceeded to show my roof mechanic and I some other issues on the inside of the property. Ms. [redacted] then asked for business cards and I looked in my SUV and told her I did not have any business cards or job invoices on me. I told Ms.[redacted] to text me her address and I would mail her business cards and a job invoice. Ms.[redacted] then informed me she had a new credit card and that she needed to go an ATM and asked if I wanted to follow her or ride with her. I rode with Ms.[redacted] to the ATM and she proceeded to take out cash. Ms.[redacted] then got in the car with $500.00 cash and counted the money out to me. I stated that the repair was not as extensive as I thought and $500.00 was okay and the $750.00 as originally quoted was unnecessary. Ms.[redacted] then drove me back to my SUV at her property. Ms.[redacted] then asked me for business cards and a job receipt as I exited her vehicle. I told Ms.[redacted] my business cards and job invoices were not in my SUV and then I texted Ms.[redacted] at 6:06pm “send me your address” and told her I would mail her cards and job invoice. This text was never answered to this day and a job receipt invoice was mailed to [redacted] st the next morning. Before I left [redacted]st. I told Ms.[redacted] I appreciated her business and that I have built my business through referrals and looked forward to hearing from her or people she knew that need work done. We both then left the property approx. 6:15pm. The next morning around 9am on 9/12/15 I received some text messanges from Ms.[redacted] about the roof was still leaking and she wanted her money back since we didn’t do anything. I responded at 9:56 stating “you paid for a repair. We repaired 3 holes and installed new shingles. Im 100% sure that is not whats leaking. Your roof is old this is what we were telling you yesterday” and at 9:59am “let me see how soon a mechanic can come and see what else is going on. We are referral based so your satisfaction is my priority”. We spoke that afternoon around noon and I told Ms.[redacted] I personally would go or send a mechanic that upcoming Sunday or Monday. The next time we spoke Ms.[redacted] informed me that someone put a tarp over back section of roof. I offered to re evaluate roof and within days I received this letter in the mail. I always tell customers before a repair that I cannot warranty roof repairs because there are too many variables out of my control.  Ms.[redacted] was polite and understanding throughout this process and I value her as a customer. I regret that Ms.[redacted] felt this was the best course of action since I answered and responded to all her calls and text messanges. I would be willing to go back and make sure our roof repair is sealed and not the cause of the leak. Also look over the roof again and reevaluate it so she can have peace of mind in her home. Thank you, Derrick O[redacted] Owner Top Notch Roofing, Remodeling & Construction LLC
