I have reviewed the response offer made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below.Much of this can be resolved if the builder would simply answer his phone or respond to emails, better yet if he took just a few minutes to come look at the issues described he could see why is in error of his "believe to be statements"Garage Door: Why would I be making this up? A level was put on the concrete, it is abundantly clear the concrete is slanted toward the garage, this is what is causing the leaks.Debris: Incorrect, again, why would I be bringing up this issue if it was in my neighbors yard, this makes absolutely no sense If the builder would look at the property he would realize this.Sidewalk & Driveway cracks: Incorrect, both parties have not agreed it is not structural This will cause many issues down the line and it needs to be resolved.Creaking: Would request that I am home during this visit, once again I can assure the builder it has not been taken care of properly If the builder would simply come to the property, this also would be abundantly clear This may not be able fixed from the crawl space, carpet/flooring may need to be removed to drill down the boards properly I talked with framers building nextdoor and they said the issue could be that my builder used nails instead of screwsHoles: Yes don't worry about it, I spent the money and days worth of work transporting loads of dirt and filling them in myself All the other lots in the area (including my next door neighbor, who closed on her house well before I did) had the builder come in and fill the holes & ruts All of which are exact duplicate issues that I experienced, and yes they did not have a shed installed, it was the Septic Drain Field Just a completely frustrating process with this builder and his decision to not respond to any type of communication Regards, [redacted]

As far as communication goes, our office has not received any further communication from Mr [redacted] directly since this has begun During the process previously, our office had responded to emails in a timely manner, although scheduling subcontractors may not have happened in the time Mr [redacted] would have preferred However, we were working with multiple schedules, including Mr [redacted] 's, and that takes time There was also an occasion that had to be rescheduled due to Mr [redacted] 's schedule The claims of ignoring emails are and unwarranted

The home in question was closed on November 23, Before closing, the homeowner was informed that the debris near the perimeter of the lot was located on another property and we cannot move items from another person’s propertyOn October 9, our office received a list of items that the homeowner requested be fixed and the project manager at the time began working to schedule subcontractors and the homeowner’s schedule to have the items that are covered in a one year express home warranty fixed Unfortunately, there were items listed that were not coveredIn the month of December, the office was informed by the then project manager that the items were completed On February 12, 2018, after the project manager was no longer employed with the company, the office received an email that there were still a few items outstanding The remaining items were scheduled by the office with the subcontractors and homeowner to ensure everything was done in a timely manner The tile technician informed the office that the cracked tile appeared that it could have been caused by someone dropping something heavy on the floor, but the office requested it be fixed for the homeowner and five tiles were replacedOf the items not covered: The debris near the property line was explained again as not being on the propertyThe garage door technicians contacted the homeowner regarding water coming into the garage after checking the seal and explained to the homeowner that the heavy winds and rains that we had been receiving lately will sometimes cause water to come into the garageA crack in the sidewalk was deemed cosmetic and therefore not covered in the one year express home warrantyThe creak in the Master Bedroom had been addressed on three separate occasionTwo of which occurred before closing in which the homeowner was satisfied with the outcomeFebruary 26, 2018, the office received an email concerning holes that appeared in the yard Although this was over three months past the one year warranty, the office sent out the landscaping technician to assess the issue as a courtesy to the homeowner The office was informed by the technician that there were tracks leading back to where a shed now sat on the property and he believed the holes and tracks were caused by the shed being placed

The office again checked with the garage door technician and was informed that they did not mention any issues with the concrete causing water to get into the garage and did not know who would have told this to the home owner. Nothing further can be done about the debris as it is believed to not be located on the homeowner’s lotThe sidewalk cracks are agreed to not be structural by both partiesThe project manager went out after closing and reinforced under the home in the crawl spaceSince this project manager is no longer with us, a technician will check in the crawl space to make sure this has been done properlyAs stated before, the mention of holes came months after the one year warranty had expired
