Complaint: [redacted] I am rejecting this response because: / [redacted] Style Definitions */ Federal Law states that a person that wants to ship a firearm needs to have One (#1) Federal Firearm License (FFL) that is associated with the shipment, preferably at the receiving end since the recipient needs to be a gun dealerThe firearm also needs to be shipped via private carrier such as [redacted] or ***The United States Postal Service will not ship firearmsBefore knowing what the law actually said about shipping firearms other then making sure to inform the carrier of the contents and having one associated Federal Firearm License, I attempted to ship the handgun to my sister in North Carolina via ***, since [redacted] customer service told me all I needed was to make sure I shipped to a gun dealer that had an FFL at the receiving end The person (***) at the Grand Junction, CO [redacted] shipping center told me that what I was told by customer service was false I needed to have an FFL License at the shipping end and also at the receiving endShe recommended Top Shot GunsI called Top Shot Guns and they verified that I needed two FFL’s to ship a handgunThey said that they do this type of shipping frequentlyI took the handgun to them on Wednesday morning 10/14/and they said they would take care of the shipment and will coordinate with the dealer at the receiving end Three days went by without a word from Top Shot GunsI called them on 10/16/and they said they never received the FFL License from [redacted] Pawn and Guns in North CarolinaI called Mr [redacted] and he said he sent the FFL to Top Shot Guns within minutes of receiving the email from them and also had confirmation since he never received either a bad address or a confirmed download from Top Shot Guns [redacted] in NC sent the FFL License again while I was on the phone with himTop Shot Guns still didn’t get itTop Shot Guns also never logged the gun in on the day I delivered it to them 10/14/It was logged in the next day, Thursday 10/15/apparently another discrepancy Thursday is the day [redacted] received the request to email his FFL license It was now Saturday 10/17/I called Top Shot Guns and they were somewhat annoyed and said they didn’t receive the email yetI called Mr [redacted] again and he sent the email again only this time with a “test” subject line and Top Shot Guns finally got it downloaded from their server while I had to coordinate the transferTop Shot’s email address was not wrong and didn’t have any syntax errorsSince it was already Saturday and nothing could be done now until Monday, I said that I would be there at Top Shot on Monday morningI called them on Monday and wanted to know if they were going to ship the handgun todayThe person Mark or Martin said he’d try to get to it todayI asked Mark what he meant by that and reminded him that the handgun has been in their possession since Wednesday of last week, making it already daysHe got offended by that and told me that he was done with this whole thing and to come pick my gun up because they are not going to ship it nowI went to Top Shot to pick up my handgun and was presented with a background check formMark said, I needed to fill the form out and do a background check for my handgun that I already owned and registered several years ago from another dealerI just came from the Ophthalmologist and my eyes were dilated so I couldn’t see the words on the formI was quite annoyed at this point because the form was presented like it was just to give me more of a hard time Finally I filled the form out with the help of Mark, but the background check was delayed so I still couldn’t get the handgunI left and returned an hour later but the background check still wasn’t completeDuring the hour I checked with the Police to make sure this background check was legitimate, it was, although that took a few policeman before someone finally said it was correctI sat down and waitedIn the mean time Daniel L***, the owner of Top Shot came in and started asking me questions about what happenedHe was clearly not supportive of the situation or me and told me his employee was rightI wasn’t arguing about who was right or wrongI just wanted the handgun mailed or given back to meHe said well we’re not going to mail it nowFinally the background check was done and I went to the counter to get the handgunHowever, Daniel informed me that the background check cost $I wasn’t going to get my handgun returned unless I paid the $feeAfter I paid Daniel L [redacted] the owner of Top Shot Guns, He picked up the box that the handgun was in and proceeded to walk it out the front door while shouting profanity to get out of his store This was exceedingly unnecessary and an attempt to humiliate me furtherIf I didn’t grab the box out the front door, he would have thrown it out the door and it would have landed on the pavement outsideHe also very forcefully asked me if I had anything to say as a threat and possibly an excuse to assault meHe used excessive profanity again and told me to never come backYou can bet that I won’t Top Shot Guns either wanted to rip me off or was ignorant of the lawI would expect the laterAs it turns out, I didn’t need Top Shot Guns to mail my handgun at all since I already had an associated FFL license with the mailing at the destinationI would expect that Top Shot Guns who is allegedly a federal gun dealer, would know the law since they indicated they did firearm mailings frequentlyI informed the Grand Junction Police of the incident has no employee by the name of Martin, nor have we ever. I can only make the wide assumption that the customer is confused and referring to our sales representative Mark. Mark explained to me the situation and incidence that Mr. [redacted] filed the complaint regarding. Mark has been a part of our team for almost 2 ½ years and has never had one complaint against him. He is very kind and hardworking. The charge of $7.00 being disputed is required by the state of Colorado. Our employees are required by law to charge $7.00 and complete a background check for any person who wishes to leave with a specific firearm. Any firearm received by employees is logged in our Federal Firearm License Acquisition/Disposition Log Book and the make, model, serial number, caliber, type of firearm, and who the firearm came from are documented. If the customer wants that specific firearm back into his/her possession, then, he/she by law is required to pass a background check and pay the $7.00 fee that is paid by our  accountant to the Colorado Department of Public Safety for each individual that leaves our location with a firearm in his/her possession. If Mr. [redacted] would like the $7.00 fee from the Colorado Department of Revenue or has any additional questions regarding the state law he can contact the Colorado Bureau of Investigation.
