Alma Jean [redacted] purchased a 2013 Toyota 4Runner Limited from my dealership on 03/03/17. The 4Runner had 86,362 miles at the time of sale.  I personally drove this 4Runner 367 miles from the time I purchased it until I sold it to Mrs. [redacted] on 03/03/17.  The 4Runner was thoroughly...

inspected by a local certified shop, and they found no mechanical issues with the vehicle.  I personally drove the vehicle 367 miles as stated before with no issues whatsoever.  Mrs. [redacted] checked and drove the vehicle prior to purchase, and she did not find any issues either.  Mrs. [redacted] signed the paperwork in my office on 03/03/17.  This included the North Carolina AS/IS Buyers Guide which states “THE DEALER DOES NOT PROVIDE A WARRANTY FOR ANY REPAIRS AFTER SALE”. The dates given by Mrs. [redacted] in her complaint are completely incorrect.  I had no contact with the [redacted]s from 03/03/17 until the week of 07/24/17. I received a call from her husband during the week of 07/24/17, over 4-½ months from the date of sale, stating the transmission was having issues and wanted my opinion on [redacted]’s quote of $4494.65 to replace the transmission. The [redacted]s claimed the 4Runner had a transmission shutter between 20 and 40mph in slow traffic according to the work order from [redacted] dated 07/28/17 with vehicle mileage of 94,557.  I researched pricing online for the repair quoted by [redacted] and told the [redacted]s the quote they had received was overpriced, and it would be best for them to have another reputable shop give a second opinion and quote to which they agreed. It was approximately a week later that I spoke with the [redacted]s again. This time they stated that another shop, [redacted] Services, verbally quoted $1850.00 to replace the transmission.  That amount was $2644.65 cheaper than the previous estimate by [redacted].  Without my prior knowledge or consent, they had already agreed for [redacted] Services to order the transmission and do the repair. I agreed that this was much cheaper than the first quote and to fax the bill to my office for review after completion. On 08/21/17, I received a fax with both the repair quote from [redacted] and the completed repair bill from [redacted] The [redacted] repair bill showed the vehicle had been repaired on 08/17/17 at the agreed upon price of $1850.00 with mileage of 95,499. After receiving the fax, I called the [redacted]s to follow up on the repair and to get more information on the timeline for the transmission issues to see if we could possibly help them absorb some of the cost of the repair, keeping in mind I was not notified prior to the week of 07/24/17 of any issues regarding the transmission. During the conversation, the [redacted]s stated that the transmission had been having the symptoms since mid-March.  They purchased the 4Runner on 03/03/17, but I was never made aware of any issue until the [redacted]s contacted me during the week of 07/24/17. The purchase mileage on 03/03/17 was 86,362.  The [redacted] quote mileage on 07/28/17 was 94,557. A total of 8195 miles had been put on the vehicle with a “repeated jump between 20 and40 mph” according to the [redacted]s within a 4-½ month span. Between the [redacted] quote on 07/28/17 and the [redacted] repair on 08/17/17, the vehicle had been driven another 942 miles.  I personally believe if the vehicle had exhibited the symptoms since mid-March the customer would have contacted me prior to the week of 07/24/17. The vehicle was driven 8195 miles over 4-1/2 months from the date of sale prior to being checked by a mechanic or myself being notified of any issue, and the vehicle was driven 9137 miles over 5 months from the date of sale until the repair was completed.  In addition, this vehicle was purchased As Is with a Buyers Guide that clearly stated that any expenses relating to future repairs would be the responsibility of the buyer.  For these reasons, my business cannot fully or partially reimburse the customer for an issue that was determined not to be underlying at the time of the sale or occurring shortly thereafter (within 30 days)
