One member was still active until September. We looked through our records, we were never contacted twice (I am the manager). The contract states that once signed, it goes through one year and then is month to month after the first year. Also, the contract states that in order to
cancel, a certified letter must be sentI will cancel now so they stop receiving payment, but we cannot refund for the time used

I am rejecting this response because:
1) While I reject their claim that "one member used the membership into September" (I believe this is not true), that would still leave two members who did not. Further, they are not telling you that of the three memberships paid for, one was used for less than two months and one membership was never even activated by using it even one single time. So, even during the valid contract time, they were paid for months of service that were never used. That may be our own fault, but we understood the contract and didn't ask that it be abated in any way. However, even leaving that aside, the gym admits that two of the memberships were not used in order to be auto-renewed and one was only to September, which leaves three full months that should be refunded without question (October, November and December.)2) It is simply not true that they were not provided cancellation in writing -- as well as numerous follphone calls.3) I have been in contact with other past members who have told me that they have had the same problems trying to cancel a membership with this merchant. This behavior when a client attempts to cancel an auto-renewed contract appears to be an ongoing pattern with this merchant. While I do not believe the gym was used in September, it is impossible to "prove a negative" (i.ethat it wasn't used) so I am willing to agree to foregoing a refund for that month. However, that leaves three full months for which there is no dispute that the memberships were not used. I will not accept any agreement that does not include a refund of those three non-disputed months. As I said in the original complaint, we have our documentation and should this merchant not be willing to solve this amicably at no cost to either of us via your service, we will proceed with suit in Jefferson County Small Claims Court

The next cycle months cycle was due on 5/20 and would repeat until he wanted to cancel with a 30 day notice. He cancelled on 6/18/2015 and his final draft with the 30 day cancellation would be...

on 7/18/2015 as per the contract. He felt the last dues was not owed to Total Body Fitness( TBF) and should be refunded. Total Body Fitness has been in business for over 15 years and I try and address any complaint we may receive in a timely manner. I spoke directly to [redacted] and informed him that according to our contract and policy, with our billing company that, that membership cancellations require a 30 day cancellation notice.  Thus, He was drafted on 7/18/2015 which would have fulfilled that requirement and we would not be  reimbursing his $44.00. He became frustrated and didn't agree with the information I provided him, as is his choice. He then stipulated that he would be letting all his friends, etc know about our club and process. Which he did and again is his choice. If he didn't like our club, atmosphere and equipment then he could have cancelled within the 3 days by law and received a full reimbursement of his membership. But he chose to continue until his school or work started 3 months later. We even addressed his complaint on the social media and he again didn't agree with our response or policy.
