Review: I cancelled my membership in August of 2009 in-person at [redacted] Fitnes on [redacted] in [redacted] MD. It was brought to my attention today, 6/4/2013 that my bank account has been charged a monthly fee of $39.00 every month since August of 2009. Upon contacting the manager at [redacted] Fitness, [redacted], I was told that [redacted] Fitness has no record of my cancellation even though I did it in-person, as I was told in August of 2009 over the phone that I could not cancel on the phone and that it needed to be done in person. I did that, and after that it is unbeknownst to me as to what happened to my cancellation notice. The manager I spoke to today also claims that I, or someone else, used my membership card to use the facilities sometime in 2011 even though I had since moved to [redacted], MD which is over an hour away. I was also told that I cannot be refunded my money because [redacted] Fitness does not have a copy of my cancellation from August of 2009 even though I submitted one at the facility on [redacted] in [redacted].I also contacted the gym I joined after cancelling my Membership with [redacted] Fitness, [redacted] and [redacted] and they said I joined on August 18, 2009 and cancelled August 31, 2010. I moved to [redacted] Maryland at that time and was nowhere near [redacted].Desired Settlement: I would like all of the monthly payments of $39.00 between September of 2009 and today, June 4, 2013 refunded to me. That is a total of 45 months and $1755.00. It is no fault of my own that the gym did not properly cancel my membership even though I took the correct steps to do so. It would have been nice of them to notify me that my acount was still open even though I had not been there in four years. Instead they just kept charging my account.

This letter is a Response to the June 19, 2013 correspondence received from Revdex.com of Metro Washington DC, concerning a complaint that was filed from [redacted] pertaining to La Plata Fitness.

On June 1 1 , 2008 **. [redacted] joined La Plata Fitness for a 1-year membership. He! was able to cancel his membership at any time: AFTER THE 1 -YEAR OBLIGATED TIME PERIOD WITH A REQUEST TO US, EITHER BY MAIL OR IN PERSON TO COME IN AND FILL OUT ONE OF OUR CANCELLATION FORMS.

WE WELCOMED **. [redacted] AND OFFERED MANY OF OUR COMPLIMENTARY SERVICES TO HIM OVER THE FIRST YEAR VIA BY CONTACTING HIM ON THE PHONE. HE WAS VERY HAPPY. AFTER THE FIRST YEAR WE SWITCH TO EMAILING FOR CORRESPONDENCE.

WE HAD ONLY CONTINUED TO SEND OUT MASS EMAILS TO **. [redacted] VIA MASS EMAILS. WE WERE UNAWARE OF ANY REQUEST TO CANCEL HIS MEMBERSHIP BECAUSE WE DID NOT EVER RECEIVE ANYTHING FROM HIM. AFTER SEVERAL YEARS, **. [redacted] IS NOW COMING FORWARD SAYING THAT HE THOUGHT HE HAD CANCELLED BACK IN SEPTEMBER OF 2009. HE SAID HE CAME IN AND USED A FORM THAT WE PROVIDE

Again, we have no record of any request to have the membership terminated. We have a record of **. [redacted] checking in our health club over in 2011 .

When I spoke to| **. [redacted] regarding this matter, he said he did not have a COPY OF THE CANCELLATION. I INFORMED HIM THAT WE DID NOT SHOW A COPY EITHER OR ANY ENTRIES FROM ANYONE THAT HAS ACCESS TO OUR MEMBER'S ACCOUNTS. WE REGRET THAT **. [redacted] DID NOT SEE THE DEBITS FROM HIS BANK ACCOUNT, WHICH CLEARLY SHOWS THAT THE DEBIT FOR THE GYM DUES IS FROM LA PLATA FITNESS, WE ALSO ATTEMPTED to REACH OUT TO **. [redacted] MORE THAN 35 TIMES THROUGH OUR MASS EMAILS.

I can offer **. [redacted] an additional 1-year membership to our facility if INTERESTED. I'M DEEPLY SORRY FOR ANY MISUNDERSTANDING THAT **. [redacted] REGARDING HIS ACCOUNT WITH US.

WE BELIEVE IN INTEGRITY AND HONOR AND WE OPERATE IN AN HONEST MANOR, WE FEEL THAT THE ACCOUNTABILITY TO MAKE SURE THE ACCOUNT WAS TERMINATE FALLS BACK onto **. [redacted].

We at La Plata Witness have not had any complaints in the past and feel this COMPLAIN IS UNWARRANTED.

I am rejecting this response because:

[redacted] Fitness claims that I did not cancel my membership and that I had checked into their health club two years after I had cancelled membership. [redacted] Fitness was not willing to give me information so that I could verify the falseness of these claims and demonstrate that I had in fact cancelled my membership since I do not have paperwork from four years ago.
