I am rejecting this response because:
As stated by the letter from the Electrical Inspector, BuildingSafety, ***, ***, the prime issue to granting a use permitis to have UL Certification or its equivalent received from theManufacturer. In addition, the wiring and plumbing must be inspectedand made code compliant by a licensed *** electrician andplumber(See attachment)Either Total Focus or BOCA Walk in Tubs provided to my CooperativeProperty Manager, which I submitted to the Electrical Building SafetyInspector, an American Industrial Testing Lab, LLC (AIT) compliancetesting of the product that was done for one tub they installed in theState of Washington. The report was deemed inadequate because the AITreport did not meet a National Testing Standards such as a UL ***ing.(See attached letter from *** Hyrkas, Elec Inspector, BuildingSafety).I sent Mr*** a copy of the *** MN Building Inspector'sLetter by e mail. He forwarded it to *** ***.Although literature provided by the Manufacturer on installationstates components of the tub are UL ***ed, neither Total Focus LLC orthe Manufacturer have been able to provide any documents other thanthe AIT study(First page of AIT study attached).On January 22, 2015, I also sent both parties a letter asking them toprovide me with a response to the Elec Inspector's letterMr.*** refused to accept the letter, so it was returned unopened.The Manufacturer accepted the letter but never provided a response.That is why I contacted the *** Attorney General's office, whotold me to file complaints with you and the Revdex.com ofGeorgia.Yesterday, March 3, I did call the Manufacturer of BOCA Walk in Tubs.He told me he would provide me a tub that would meet UL standards,would have *** ***, a *** licensed electrician, obtain therequired permits, and install the tub. I replied that I wanted allparties-- my Housing Director and the Electric Inspector-- there to besure it meets his approval, before any work was doneI was not toldthat if my husband had died, they would replace the BOCA tub with asimilar model that was removed at no cost to me.I called *** ***, the *** licensed electrician. To date,(March 4) *** *** has not been contacted by anyone.I placed my faith in Total Focus LCC and their Agents and they can saythat they have no responsibility. The obvious fact is that they broke*** Law and Safety Standards by selling and installing the BOCAWalk in Tub without a permit, using an unlicensed installer withabsolutely no supervision of any kind.I would appreciate receiving the information given to me by theManufacturer over the phone yesterday be sent to me in writing

I am rejecting this response because:
I remain firm in my complaint that Total Focus LLC and their Agents who sold me the BOCA Walk-in-Tub.  I remain steadfast in the facts that they have clearly misled me in their promise to sell and install a hydro-massage tub.  I have filed complaints in three states:   [redacted], Kansas, Georgia, with the Attorney General Office of [redacted], Kansas, and Georgia, with the [redacted] Department of Labor and Industry, CCLD Enforcement Services Unit  for both plumbing and electrical offenses, with the Revdex.coms of Kansas and Georgia, the [redacted] Commissioner for District #6, and with the Federal Trade Commission.  I fear that Total Focus and their Agents deceptive sales practices will hurt other Senior Citizens like they have hurt me financially and emotionally.I will reiterate the true facts of the situation:Multiple websites about hydro-massage tubs point to the Total Focus LLC distributorship with promising names like BathingSafetyWalkinTubs. Com.Total Focus LLC responded to my inquiring by sending a Sales Representative who said he was an authorized representative of Total Focus.  Based on my telephone conversation with Total Focus as to what I could spend, I was sold a Boca Walk in Tub.  The Sales Agent clearly represented himself as speaking for Total Focus LLC and received and forwarded my payment, which was deposited by Total Focus LLC.When I purchased the tub, the Sales Agent never said the tub did not meet [redacted] Law for sale and installation of Hydro Massage tubs because it was not UL Certified.  How in the world was I, a 67 year old woman trying to fulfill a prescription for my husband who is in Hospice Home Care with severe dementia, supposed to know whether a complex product met NEC and [redacted] law standards?The Sales Agent also assured me when I said I did not know how I could have the tub installed that he has a qualified installer in Michigan who installed this tub around the country.The installer proved to be unlicensed to do such work in [redacted], did not seek permits for electrical or plumbing work, and did not seek inspection of the installation by the City of [redacted] Electric Inspector, Building Safety.  I did not select him-- I just agreed with the Total Focus Sales Agent to pay him $2500 for a proper installation.I have had many phone calls and e mails--each time the story seems to be the same as the current response:  I, as a senior citizen with no engineering background should have known what was required, and Total Focus LLC and its Agents have no responsibility, even though they have broken [redacted] law.I placed my faith in Total Focus LCC and their Agents and they can say that they have no responsibility.  The obvious fact is that they broke [redacted] Law and Safety Standards by selling and installing the BOCA Walk in Tub without a permit, using an unlicensed installer with absolutely no supervision of any kind.I will not close my complaint until they remove the tub at no cost to me, install a standard tub of the same model they removed from my Cooperative living apartment, and refund my $9000.I owe it to all Senior Citizens that their deceptive practices be communicated and made available to anyone who considers them for a purchase.  They are simply not trustworthy and the Revdex.com record should warn others of the danger of dealing with them.

[redacted], I want to lay out everything the way it happened with Mrs. [redacted]. I have bent over backwards trying to help this lady. I have taken every phone call (even recorded some), always returned her calls, answered every text and provided her with information every time she asked.I received a...

letter from the [redacted] Attorney General requesting information and explanation, which I provided to their satisfaction.Mrs. [redacted] sought out to purchase a BOCA Walk in Tub on her own --we did not solicit her.Total Focus sells many different manufacturers walk in tubs as an independent contractor. She states a sales rep in [redacted] who is part of Total Focus came to visit. We have no sales reps anywhere from Total Focus. [redacted] was there just to gather information.When I first spoke with [redacted], I found out she lived in a Housing Project/Community --- to which I asked her if she had permission from the complex to have one of these installed --which is a requirement. She led us to believe she did just from the fact of going forward with the transaction.I then asked her if she had somewhere there that could install . She said she did not and if we had someone we could provide. I explained to her that we use certain contractors throughout the United States and that they were totally independent and not part of Total Focus. That is why you pay them for their directly for their work when it is done. Total Focus gets no kick back or referral fee of any sort. The check is paid directly to them upon customer satisfaction. The pictures she showed me afterwards were of something incomplete --leaving a whole in the wall. I asked her why did she pay him and sign off on his work? I gave her his name and number for follow up. It is up to each contractor to know  the requirements of operating in a State/City/County.As I told [redacted] on many occasions, I handle a variety of walk-in tubs from many different manufacturers. Some have a variety of code markings: IIAPMO, ETL, UL, etc.I have absolutely no say over the manufacturers testing and certifications. I cannot make a manufacturer attain certain these certifications.[redacted] wanted a Boca Walk-in tub. I sold her a good quality product that does everything I claim it would do. I did not mislead in any way shape or form. The Boca tub runs, fills, air jets and water jets all operate, and does not leak.From Total Focus standpoint, everything else is out of our control. I spoke with her on many occasions and told her I would try and help her the best I could.[redacted]

Today, 3/3/2015, I spoke with [redacted] Classman, Plumbing Inspectors Office in the State of [redacted] and I also spoke directly with [redacted], Owner of Boca Walk In Tubs.[redacted] stated that she had spoken to [redacted] directly and was satisfied. Boca Walk In Tubs were certified by a Nationally recognized independent laboratory--- copies of which were sent to the building inspectors of the state.[redacted] then said that Mr. [redacted] offered the following solution: to replace the  current walk in tub with a new walk in tub that would meet all the State of [redacted] certifications and requirements --and be installed by a licensed [redacted] plumber and electrician.      OR      If Mr. [redacted] has passed away, to  reinstate the bathroom and bathtub as it was originally and all repairs made as needed.[redacted] said she then spoke with Mrs. [redacted] who agreed to the offering.I then spoke directly with the owner of the company, Mr. [redacted], who said he has also spoken personally to Mrs. [redacted], making the same offer and her accepting.Mrs. [redacted] is saying we made statements to her which we did not. I have over 3000 tubs installed and ZERO complaints.Please let me know what else I can do.Thanks, [redacted]
